A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), APPROVING THE RELEASE OF
A COVENANT RUNNING WITH THE LAND DATED
OCTOBER 6, 1988, AND RECORDED IN OFFICIAL
RECORDS BOOK 13979, AT PAGE 2512-2514, OF THE
PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA,
FOR THE PROPERTY LOCATED AT APPROXIMATELY
2145 NORTHWEST 19 TERRACE, MIAMI, FLORIDA, AS
DESCRIBED IN "EXHIBIT A", SINCE RECORDED IN
CONNECTION WITH A PROPOSED DEVELOPMENT WHICH
WAS NOT BUILT AND THE COVENANT IS THEREFORE
NOT NEEDED; FURTHER DIRECTING THE PROPER CITY
OFFICIALS TO EXECUTE A RELEASE, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, IN
CONNECTION THEREWITH.
WHEREAS, the property located at approximately 2145
Northwest 19 Terrace, Miami, Florida (the "Property"), as
described in attached "Exhibit A," is subject to a Covenant
Running with The Land, ("Zoning Covenant") dated October 6, 1988,
recorded in Official Records Book 13979, at Page 2512-2514, of
the Public Records of Miami -Dade County, Florida; and
WHEREAS, the Property owner has requested the City to
release the Zoning Covenant; and
WHEREAS, the covenant was recorded in connection with a
proposed development which was not built, and the covenant is
therefore not needed; and

WHEREAS, the Acting Zoning Administrator has reviewed the
property owner's request and recommends the release of the Zoning
Covenant; and
WHEREAS, the City Commission after careful consideration of
this matter finds that it is in the best interest of the general
welfare of the City of Miami and its inhabitants to release the
Zoning Covenant for the Property as set forth herein;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The release of the Zoning Covenant dated
October 6, 1988, recorded in Official Records Book 13979, at
Page 2512-2514, of the Public Records of Miami -Dade County,
Florida, is approved for the Property, and the proper City
Officials are authorized!:' to execute a release, in a form
acceptable to the City Attorney, in connection therewith.
�i The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

BACKGROUND AND
ANALYSIS The subject covenant was recorded in 1988 as the result
of a request for additional height and density for a
proposed housing project. The subject housing project
was subsequently abandoned and never constructed.
The project that was built instead meets all applicable
zoning codes in effect today and does not require
variances or density bonuses per the attached
memorandum from Juan Gonzalez, Zoning Administrator,
dated November 8, 2002. In conclusion, it is found that
the subject covenant is related to a project that was never
implemented on the above referenced properties;
therefore, the covenant is no longer applicable nor
necessary. Another condominium project has been built
that is in compliance with all codes.
The only concern the Planning and Zoning Department
had was as to whether the original project had received
any CD funding for affordable housing. After checking
with the Community Development Department and
Finance, to the best of our knowledge and records, no
such funding, was ever given. Based on these findings,
the subject covenant should be released.

2 A.N.I Terrazas Inc. developed a 26 Unit Condominium, that conforms with all the
current Zoning codes and no variances were requested for this development.
3 AXI Terrazas Inc. is not affiliated in any way with the previous developers, and
did not benefit in any way from the above Hearing Board Decision.

Pursuant to a request from the current owners of the site to release a covenant running with
the land and as per your request the Zoning Division has completed the review to ascertain
compliance with current code and the following are the results.
The project built under our present Zoning Ordinance 11000, meets all current applicable
regulations in effect and will not require a rezoning or any zoning variation for what is
currently constructed on the site.
Therefore, the rezoning that was approved under our prior Zoning Ordinance 9500 that was
the cause for the recorded covenant is no longer in effect or necessary for the existing
project which is conforming to current regulations.
