HomeMy WebLinkAboutR-02-1311J-02-1004 11/13/02 RESOLUTION NO." 2 m 1 a i ll A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE RELEASE OF A COVENANT RUNNING WITH THE LAND DATED OCTOBER 6, 1988, AND RECORDED IN OFFICIAL RECORDS BOOK 13979, AT PAGE 2512-2514, OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA, FOR THE PROPERTY LOCATED AT APPROXIMATELY 2145 NORTHWEST 19 TERRACE, MIAMI, FLORIDA, AS DESCRIBED IN "EXHIBIT A", SINCE RECORDED IN CONNECTION WITH A PROPOSED DEVELOPMENT WHICH WAS NOT BUILT AND THE COVENANT IS THEREFORE NOT NEEDED; FURTHER DIRECTING THE PROPER CITY OFFICIALS TO EXECUTE A RELEASE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN CONNECTION THEREWITH. WHEREAS, the property located at approximately 2145 Northwest 19 Terrace, Miami, Florida (the "Property"), as described in attached "Exhibit A," is subject to a Covenant Running with The Land, ("Zoning Covenant") dated October 6, 1988, recorded in Official Records Book 13979, at Page 2512-2514, of the Public Records of Miami -Dade County, Florida; and WHEREAS, the Property owner has requested the City to release the Zoning Covenant; and WHEREAS, the covenant was recorded in connection with a proposed development which was not built, and the covenant is therefore not needed; and CITY COMOSSION V=TING OF D E C I ? 2002 R::solution No. o2 -MI WHEREAS, the Acting Zoning Administrator has reviewed the property owner's request and recommends the release of the Zoning Covenant; and WHEREAS, the City Commission after careful consideration of this matter finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants to release the Zoning Covenant for the Property as set forth herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. PLANNING RECOMMENDATION Recommended approval. BACKGROUND AND ANALYSIS The subject covenant was recorded in 1988 as the result of a request for additional height and density for a proposed housing project. The subject housing project was subsequently abandoned and never constructed. The project that was built instead meets all applicable zoning codes in effect today and does not require variances or density bonuses per the attached memorandum from Juan Gonzalez, Zoning Administrator, dated November 8, 2002. In conclusion, it is found that the subject covenant is related to a project that was never implemented on the above referenced properties; therefore, the covenant is no longer applicable nor necessary. Another condominium project has been built that is in compliance with all codes. The only concern the Planning and Zoning Department had was as to whether the original project had received any CD funding for affordable housing. After checking with the Community Development Department and Finance, to the best of our knowledge and records, no such funding, was ever given.
