RESOLUTION NO. 119-12 09-3
A RESOLUTION OF THE MIAMI CITY COMMISSION RELATED
TO THE 40TH ANNUAL WASHINGTON MUTUAL COCONUT GROVE
ARTS FESTIVAL, CONDUCTED BY THE COCONUT GROVE
ASSOCIATION, INC., HELD ON FEBRUARY 15-17, 2003;
AUTHORIZING THE CITY MANAGER TO ISSUE A THREE-DAY
PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES DURING
SAID EVENT IN THE AREA OF McFARLANE ROAD FROM
SOUTH BAYSHORE DRIVE TO MAIN HIGHWAY AND SOUTH
BAYSHORE DRIVE FROM MCFARLANE ROAD TO MAIN
HIGHWAY, INCLUDING ALL STREETS, AVENUES, ALLEYS,
WAYS AND THOROUGHFARES WHICH INTERSECT SAID AREAS
IN COCONUT GROVE, MIAMI, FLORIDA; AUTHORIZING THE
WAIVER OF ADMINISTRATIVE IN-KIND SERVICES AND OF
ALL EQUIPMENT RENTAL AND PERMIT FEES PERMITTED BY
LAW; FURTHER AUTHORIZING THE WAIVER OF THE COCONUT
GROVE SPECIAL EVENTS DISTRICT SUPPLEMENTARY USER
FEE, IN THE AMOUNT OF $10,000,00; SAID
AUTHORIZATIONS CONDITIONED UPON THE ORGANIZERS:
(1) OBTAINING ALL PERMITS REQUIRED BY LAW,
INCLUDING BUT NOT LIMITED TO A TEMPORARY PERMIT TO
SELL ALCOHOLIC BEVERAGES BY THE FLORIDA DEPARTMENT
OF BUSINESS REGULATION, DIVISION OF ALCOHOLIC
BEVERAGES AND TOBACCO, PURSUANT TO SECTION 54-13
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED; (2) PAYING FOR ALL OTHER NECESSARY COSTS
OF CITY SERVICES AND APPLICABLE FEES ASSOCIATED
WITH SAID EVENT; (3) OBTAINING INSURANCE,
INCLUDING BUT NOT LIMITED TO LIQUOR LIABILITY, TO
PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY
THE CITY MANAGER; (4) INSTITUTING AN
IDENTIFICATION PROGRAM TO ASSURE THAT ONLY THOSE
INDIVIDUALS OVER THE AGE OF TWENTY-ONE MAY
PURCHASE ALCOHOLIC BEVERAGES; (5) ADVISING ALL
ADJACENT BUSINESSES, PROPERTY OWNERS, AND
RESIDENTS OF STREET CLOSURES ASSOCIATED WITH SAID
EVENT; AND (6) COMPLYING WITH ALL CONDITIONS AND
LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY
MANAGER.

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager is authorized to issue a
three-day permit for the sale of alcoholic beverages during the
40th Annual Washington Mutual Coconut Grove Arts Festival,
conducted by the Coconut Grove Association, Inc., held on
February 15-17, 2003, in the area of McFarlane Road from South
Bayshore Drive to Main Highway and South Bayshore Drive from
McFarlane Road to Main Highway, including all streets, avenues,
alleys, ways and thoroughfares which intersect said areas in
Coconut Grove, Miami, Florida.
Section 2. The waiver of administrative in-kind
services, all equipment rental and permit fees permitted by law,
and the Coconut Grove Special Events District Supplementary User
Fee, in the amount of $10,000,00, is authorized.
Section 3. The herein authorizations are conditioned
upon the Organizers: (1) obtaining all permits required by law,
including but not limited to a temporary permit to sell alcoholic
beverages by the Florida Department of Business Regulation,
Division of Alcoholic Beverages and Tobacco, pursuant to
Section 54-13 of the Code of the City of Miami, Florida, as
amended; (2) paying for all other necessary costs of City
services and applicable fees associated with said event; (3)
obtaining insurance, including but not limited to liquor
liability, to protect the City in the amount as prescribed by the

City Manager; (4) instituting an identification program to assure
that only those individuals over the age of twenty-one may
purchase alcoholic beverages; (5) advising all adjacent
businesses, property owners, and residents of street closures
associated with said event; and (6) complying with all conditions
and limitations as may be prescribed by the City Manager.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.V

�i If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

Ms. Carol Romine appeared before the Coconut Grove Special
Events & Marketing Committee on October 9, 2002 :to request
approval of the Coconut Grove Arts Festival which is scheduled
for February 14, 2003 through February 17, 2003 and to seek a
waiver of .fees for City services. The Coconut Grove Special
Events & Marketing Committee recommends a waiver of fees, and
therefore would like to request that Ms. Romine be scheduled to
appear before the City Commission at its November 19, 2002
meeting to seek a waiver of fees for this event.

Personal Appearance
The administration recommends approval of the Coconut Grove Arts
Festival's request for in-kind service and fee waivers for all
permits, equipment costs, administrative fees and supplemental
fee paid to the Coconut Grove Marketing & Special Events
Committee in the amount of $38,400. It is the Coconut Grove
Special Events & Marketing Committee's request that the City
Commission reimburse the Committee $10,000 which is the cost of
the supplemental fee for use by the Committee for promotion in
connection with the event. The administration also recommends
approval of the Coconut Grove Arts Festival's request to sell
alcoholic beverages, subject to the following:
• Paying for the labor cost of all City services required by
law.
• Obtaining insurance,- including liquor liability, to
protect the City of Miami in the amount stipulated by City
requirements.
• Instituting an identification program to assure that only
those over the age of twenty-one will buy alcoholic
drinks.
• Notifying adjacent businesses, property owners and
residents of the upcoming street closures.
BACKGROUND:

including the Police Department and NET office. The Coconut
Grove Special Events & Marketing Committee has approved the
event subject to compliance with all rules and regulations
prescribed by the City of Miami. The event will require street
closure on South Bayshore Drive from McFarlane Road to Chart
House Drive and McFarlane Road from South Bayshore Drive to Main
Highway.
