RESOLUTION NO. 02-1275
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENTS, APPROVING THE GRANT OF A
PERPETUAL, NON-EXCLUSIVE FOUR (4) FOOT WIDE
EASEMENT AS MORE PARTICULARLY DESCRIBED IN
"EXHIBIT A" ATTACHED AND INCORPORATED, AT
DOMINO PARK LOCATED AT 1444 SOUTHWEST 8
STREET, MIAMI, FLORIDA TO FLORIDA POWER AND
LIGHT COMPANY FOR THE CONSTRUCTION, OPERATION
AND MAINTENANCE OF AN ELECTRIC TRANSFORMER,
WITH THE RIGHT TO RECONSTRUCT, IMPROVE,
CHANGE THE VOLTAGE, AND REMOVE SUCH FACILITY
WITHIN THE EASEMENT, WITH FULL RIGHT OF
INGRESS AND EGRESS, AND FURTHER, AUTHORIZING
THE CITY MANAGER TO EXECUTE A GRANT OF
EASEMENT, IN SUBSTANTIALLY THE FORM ATTACHED
AND INCORPORATED AS "EXHIBIT B", FOR SAID
PURPOSE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The grant of a perpetual, non-exclusive four
(4) foot wide easement, as more particularly described in
"Exhibit A" attached and incorporated, at Domino Park, located at
1444 Southwest 8th Street, Miami, Florida, for the construction,
operation and maintenance of an electric transformer, including
the right to reconstruct, improve, change the voltage, and remove
such facility from the easement, with right of ingress and
egress, is approved.

Section 2. The City Manager is authorized'I to execute a
Grant of Easement, in substantially the form attached hereto as
"Exhibit B," to Florida Power & Light Company, for said purpose.

1/ The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
2/ If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

The undersigned, in consideration of the payment of 51.00 and other good and Valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents, successors, and assigns, an easement for
the construction, operation and maintenance of underground electric utility facilities (including
wires, cables, conduits and appurtenant equipment) to be installed from time to time; with the right
to reconstruct, improve, add to, enlarge, change the voltage, as well as, the size of and remove
such facilities or any of them within an easement 4 feet in width (the approximate location of
which is shown in the sketch on Page 2 of this instrument) located within the following described
property:
See attached Exhibit "A" consisting of 2 pages.
Subject to the condition that FPL shall relocate the easement to a mutually agreeable location, upon request by the
City, provided that City shall pay all costs of the relocation.
Together with the right of ingress and egress to said premises at all times; the right to clear the land and keep it cleared of all trees,
undergrowth and other obstructions within the easement area; to trim an and cut and keep trimmed and cut all dead, weak, leaning or
dangerous trees or limbs outside of the easement area which might interfere with or fall upon the lines or systems of power
transmission or distribution; and further grants, to the fullest extent the undersigned has the power to grant, if at all, the rights
hereinabove granted on the land heretofore described, over, along, under and across the roads, street or highways adjoining or through
said property.

The administration recommends that the City Commission adopt the attached Resolution
authorizing the City Manager to execute a grant of easement, in substantially the attached form,
to Florida Power & Light Company at Domino Park, located at 1444 S.W. 8th Street, of a four
(4) foot wide, perpetual, non-exclusive easement, as more particularly described in Exhibit "A"
attached hereto and made a part hereof, for the construction, operation and maintenance of an
electrical transformer, with the right to reconstruct, improve, change the voltage, and remove
such facilities or any of them within the easement, with full right to ingress thereto and egress
therefrom.
BACKGROUND:
Florida Power & Light Company has requested that they be granted a four (4) foot wide
easement on City property in which to locate an electrical transformer, with the right to
reconstruct, improve, change the voltage, and remove such facilities or any of them within the
easement, with full right of ingress thereto and egress therefrom. This easement is necessary in
order to bring electrical service to Domino Park Plaza, a City of Miami project located between
the Tower Theater and Domino Park along SW 15th Avenue from 8th to 9th Streets.
Financial Impact
Ther is no negative financial impact on the general fund.
