HomeMy WebLinkAboutR-02-1238J-02-943 11/06/02 02_1238 RESOLUTION No. A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOURTH -FIFTHS (4/5THS ) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT COMPETITIVE SEALED BIDDING METHODS ARE NOT PRACTICAL OR ADVANTAGEOUS FOR THE REPAIR OF SIDEWALKS IN THE ALLAPATTAH AREA; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS, AND ACCEPTING THE BID OF METRO EXPRESS INC., IN THE AMOUNT OF $97,950, FOR THE PROJECT ENTITLED "ALLAPATTAH SIDEWALK AND CURB REPLACEMENT PROJECT B-4660"; ALLOCATING FUNDS, IN THE AMOUNT OF $97,950, FROM CAPITAL IMPROVEMENT PROJECT NO. 341200, FOR THE CONTRACT COSTS AND $11,357 FOR EXPENSES INCURRED BY THE CITY, FOR AN ESTIMATED TOTAL COST OF $109,307 FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5tns) affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's finding that competitive sealed bidding methods are not practical or advantageous for the repair of sidewalks in the Allapattah area is ratified, approved 4'Y1`7f C-�� ft$vc 2002 02 r W and confirmed, the requirements for competitive bidding methods are waived and the bid of METRO EXPRESS, INC., in the amount of $97,950, for the project entitled "Allapattah Sidewalk and Curb Replacement Project B-4660", is accepted. Section 2. The City Manager is authorized!' to execute a contract, in a form acceptable to the City Attorney, with Metro Express, Inc., for said purpose. Section 3. The total estimated project cost of $109,307 is allocated from Capital Improvement Project No. 341200 as appropriated by the Capital Improvement Ordinance. Total project costs consist of $97,950 for the contract costs and $11,357 estimated for expenses incurred by the City. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor Y 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2/ If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. The estimated total cost for this project is $109,307 consisting of $97,950 Total Bid and $11,357 for expenses. JUSTIFICATION Based on my investigation of numerous damaged sidewalks throughout Allapattah neighborhood, I have found that an EMERGENCY exists which justifies the selection of a contractor by informal bids. The Public Works Department has conducted a survey of the condition of sidewalks on the Allapattah area and has identified 14,500 square feet of sidewalk and 5,500 lineal feet of curb as being in poor condition and in need of replacement. The total cost estimate, including construction, design, project management, inspection and city expenses, is $150,000. This project is scheduled to be funded from the Impact Fees. Such conditions indicate the need for extraordinary measures to protect the health, safety and welfare of the community and the tenants and customers of the local business and residential areas throughout the Allapattah neighborhood. In order to initiate the construction of the sidewalk and curbs as soon as possible, formal competitive sealed bid procedures shall be waived for the procurement of contracting services required for said emergency pursuant to sections 18-83' and 18-84 of the city code. Informal bids shall be obtained and a contract shall be awarded by the city manager to the lowest responsive and qualified bidder. All costs of this project will be funded from CIP Project No. 341200. Estimated total cost for the project is $ 150,000. This action shall be ratifidd at the next available City Commission Meeting.
