HomeMy WebLinkAboutR-02-1184J-02-916 10/21/02 RESOLUTION NO. 02-11--84 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE THAT PORTION OF A PUBLIC RIGHT-OF-WAY, BEING THE PORTION OF APPROXIMATELY NORTHWEST 63RD STREET BETWEEN NORTHWEST 6TH AVENUE AND '7TH AVENUE, MIAMI, FLORIDA, AS LEGALLY DESCRIBED IN ATTACHED "EXHIBIT A." WHEREAS, the Miami Zoning Board at its meeting of September 23, 2002, Item No. 8, duly adopted Resolution No. ZB 2002-0609 by a six to three (6-3) vote, RECOMMENDING APPROVAL of closing, vacating, abandoning, and discontinuing a portion of the public right-of-way as set forth herein; and WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the subject vacation and closure and determined that it will not affect pedestrian or vehicular traffic circulation or access for public service; and WHEREAS, the Plat and Street Committee has reviewed the subject tentative plat and determined that all technical 77 A� £`d( 21 CITY COM =ON MEW m 0 G T 2 9 2002 Readlutim moo. 02-1 1 R4 requirements have been met, but found the vacation and closure of the subject right-of-way would not benefit the general public and therefore recommended denial; and WHEREAS, the City Commission, notwithstanding the recommendation of the Plat and Street Committee, finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants to grant the vacation and closure of a portion of the public right-of-way as hereinafter described, and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A portion of public right-of-way, being a portion of approximately Northwest 63rd Street between Northwest 6th Avenue and 7th Avenue, Miami, Florida, as legally described in "Exhibit A," attached and made a part hereof, is closed, vacated, abandoned and discontinued for public use. As you may know, Edison Plaza anchors the Edison Center Business District, the largest commercial district in Liberty City area. The businesses in the area have suffered from the loss of customer traffic caused by the 17,000 transactions the center generated each week. As you may know, this project won approval on September 23, 2002 from the City of Miami Zoning Board for Official Vacation and Closure for a Public Right of Way. The final hearing is scheduled before the City of Miami Commission on October 29, 2002. The proposed plan incorporates N.W. 63rd St., which has primarily served as a service and patron access road to Edison Plaza. By formally incorporating the street into the center's redevelopment, many beneficial alternatives will result for both vehicular and pedestrian circulation. The incorporation of the street will eliminate conflicts and safety issues resulting from the daily leading activity of large vehicles and both automobile and pedestrian traffic entering and leaving the center. Further, it will address the safety issue resulting from cars entering the center, often at high rates of speed, and patrons crossing the street to the parking lot with shopping carts. The plan will resolve these concerns with the provision of an exclusive loading area located in the rear of the center, and designated for the larger tenants responsible for large deliveries along with the use of traffic calming devices such as the shortening of straight roadways, speed bumps and signage. Pedestrian -friendlier walkways will be created with wider sidewalks, bollards, etc. Moreover, Edison Marketplace will provide convenient access to goods and services to neighborhood residents and the elderly who live in close proximity to the area. The Plat and Street Committee has further considered the criteria contained in the Subdivision Regulations of the City Code concerning the vacation and closure of NW 63 Street between NW 6 Avenue and NW 7 Avenue and has voted 0 in favor and 6 in opposition to this street closure and vacation request. 02-1184 PLANNING AND ZONING DEPARTMENT ANALYSIS Case No. 2002-0583 VACATION AND CLOSURE OF A PORTION OF NW 63rd STREET BETWEEN NW 6TH AVENUE AND 7TH AVENUE Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department has reviewed the proposed street vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the closure of the right-of- way. The following findings have been made: • It is found that the general public and patrons of businesses in the neighborhood are currently using the street. • It is found that the street serves as an alternate route to heavily traveled NW 62nd Street. • It is found that closing the street would create a mega block, which is not consistent with the height, bulk and scale of the existing buildings in the area. • It is found that the property owner has failed to demonstrate any public benefits that would be provided as a result of the proposed street closure.
