A RESOLUTION OF THE MIAMI CITY COMMISSION
APPOINTING AN INDIVIDUAL AS A MEMBER OF THE
BOARD OF TRUSTEES OF THE CITY OF MIAMI FIRE
FIGHTERS' AND POLICE OFFICERS' RETIREMENT
TRUST FOR A TERM AS DESIGNATED HEREIN.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The following individual, whose name was
selected from a list of six individuals submitted by the
Fraternal Order of Police, certified bargaining unit, is hereby
appointed as a member of the Board of Trustees of the City of
Miami Fire Fighters' and Police Officers' Retirement Trust, to
serve a term as designated herein:

The Fire Fighters' and Police Officers' (FIFO) Retirement Trust was created to provide retirement
benefits pursuant to the provisions of City Code Chapter 40, Division 2; to establish and maintain functions
as are necessary to administer, manage and operate the retirement plan. There are nine members on said
trust, appointed as follows:
• One trustee selected by the City Manager
• Two trustees selected by fire fighters
• Two trustees selected by police officers
• Four trustees selected by the City Commission (two of which are selected from list of six
individuals submitted by Miami Association of Fire Fighters; and two selected from list of six
individuals submitted by the Fraternal Order of Police)
Two appointments are needed at this time to fill seats currently held by Al Gurdak and Marshall
Barry, whose terms expired March 8, 2002. On March 14, 2002, the City Commission deferred
consideration of appointments being requested by the Miami Association of Fire Fighters
(nominated Marshall Barry) and the Fraternal Order of Police (nominated Robert Williams) with a
request for the City Manager to explain why only one name was submitted for each category
instead of six names as required per City Code Chapter 40, Division 2.
The Commission at large is requested to appoint one of the following individuals submitted
by the Fraternal Order of Police to replace Al Gurdak, who resigned:

• Jerome Wolfson
■ Yolanda Aguilar
■ Clarence Dixon
■ Herminio Ramirez
The Miami Association of Fire Fighters has not submitted any further nominations. For your
information, attached please find a copy of the current membership of said board. By copy of
this memorandum, we are requesting the Agenda Office to place this issue on the October 29,
2002 Commission agenda.

This letter is to request that you place on the next available City Commission agenda the
appointment of an individual to fill a vacancy on the FIPO retirement Trust. As you know at the
Commission meeting of March 14, 2002, the Commission deferred the item because they
wanted to have six names to choose from. In both the FOP's and the IAFF's case these were
re -appointments to the board with individuals that have served on the board for over a decade.
You may remember that 1 spoke to you at the Commission meeting and related that in the past
re -appointments did not require the additional names.
In an attempt to resolve this issue I will include five additional names, however, it is our position
that Robert Williams is the most qualified for the post because of his years of service and in fact
he is currently the chairperson of the board. This is the same Robert Williams that during his
tenure on the Board worked with the City on the Gates re -settlement and the most recent
assumption changes which had a positive effect on the City's cost. I highly suggest that
members of the Commission give this candidate the utmost consideration.

This memorandum serves as a reminder of our conversation of April 5, 2002 regarding
additional nominations needed from the Fire Fighters' and Police Officers' unions for
appointments to the Fire Fighters' and Police Officers' (FIFO) Retirement Trust. Two
appointments are currently needed: there is a vacancy because Al Gurdak resigned and
Marshall Barry's term expired March 8, 2002.
On March 14, 2002, the City Commission passed Motion 02-315 (copy attached)
deferring consideration of appointments of members to the FIPO Retirement Trust. The
Commission expressed a concern about having only one name submitted by each of the
Fire Fighters' and Police Officers' unions.
As soon as I receive information from you, I will schedule the needed appointments in
the next available agenda.
