Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.11 �i If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. This purchase will be on an as needed contract basis, for the initial term of one (1) year with the option to renew for one (1) additional year, at an estimated annual cost not to exceed $510,871.50 for the first year and $334,974.60 for the 2nd contract year, for a total contract cost not to exceed $845,846.10. BACKGROUND Pursuant to Resolution Nos. 01-1134 and 01-1135, approved by the City Commission as a sole source on October 25, 2001, the Department of General Services Administration Communications Division has recently begun to upgrade the existing City of Miami 800 MHz Trunked Radio Communication System. In accordance with the existing upgrade, the Department of Fire -Rescue requires the acquisition of Motorola XTS 5000 portable radios and Digital Spectra Consolettes base stations with Smartnet Type 11 software and accessories on an as needed contract basis. This equipment is necessary for the final conversion to type 2 radios needed, which are directly compatible with the new 800 MHz communication system upgrade. The XTS 5000 portable radios are considered newer technology and are an upgrade from the XTS 3000 radios currently used by the Fire -Rescue Department. The XTS 5000 model provides the same functionality as the XTS 3000 radio; however, the XTS 5000 features improved audio quality with the Noise Reduction Software and Auto Gain Control and includes many standard hardware features in a convenient ergonomic design. In addition, this purchase will provide the City a cost savings of $650.00 for each radio including trade in credit. Funding, for the initial term of one (1) year, with the option to extend for one (1) additional year, is available at an estimated annual cost not to exceed $510,871.50 for the first year, and $334,974.60 for the renewal contract year, for a total amount not to exceed $845,846.10, from the Capital Improvement Program, Project No. 313303, Account Code 289401.6.840, funded by the Fire Assessment. Motorola, Inc., due to the proprietary nature of their trunking technology, is also the sole manufacturer of the XTS 5000 portable radios and Digital Spectra Consolettes base stations, with Smartnet Type II software, and accessories. On prior occasions, the City determined the acquisition of Motorola portable radios with the SMARTNET software and related accessories acquired from Motorola, Inc. was a sole source and compatible with the existing communication system. Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings be approved: Motorola, Inc., is the sole source provider of Motorola XTS 5000 Portable Radios with SMARTNET Type II Software, and accessories, for the Department of Fire -Rescue.
