HomeMy WebLinkAboutR-02-1142J-02-950 10/10/02 RESOLUTION NO. 02-1142 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING RESOLUTION NO. 00-758, AS AMENDED BY RESOLUTION NO. 02-1097, RELATING TO THE ACQUISITION OF MULTIFAMILY PROPERTIES AT 1435, 1455 AND 1475 NORTHWEST 61ST STREET AND 1606 NORTHWEST 58TH TERRACE, MIAMI, FLORIDA, LOCATED IN THE MODEL CITY REVITALIZATION DISTRICT, TO DECREASE FROM FOUR TO THREE THE NUMBER OF PROPERTIES TO BE ACQUIRED, THEREBY EXCLUDING THE PROPERTY LOCATED AT 1606 NORTHWEST 58TH TERRACE, AND TO REFLECT THE FUNDING SOURCES FOR THE ALLOCATION OF A TOTAL OF $385,000 FOR THE ACQUISITION COSTS AS FOLLOWS: FUNDS IN AN AMOUNT NOT TO EXCEED $300,000 ALLOCATED FROM COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM INCOME FUNDS, AND FUNDS IN AN AMOUNT NOT TO EXCEED $85,000 FROM MODEL CITY REVITALIZATION TRUST FUNDS, SUBJECT TO APPROVAL BY THE MODEL CITY REVITALIZATION TRUST BOARD OF DIRECTORS. WHEREAS, in the early 19901s, the City of Miami provided assistance in the form of a second mortgage to Devecorp, Inc., in the amount of approximately $1,651,565, for the rehabilitation of certain multifamily apartment buildings as listed herein (the "Properties") and as legally described in "Exhibit A", 1435 Northwest 61St Street, 1455 Northwest 61St 'ATTACH a T J deb i CITY COMMISSION MEETING CIE 0 C T 1 n 2002 Resolution Mo. 02-1142 Street, 1475 Northwest 61St Street and 1606 Northwest 58th Terrace, Miami, Florida; and WHEREAS, the Properties are located in the City's designated Model City Homeownership Zone, and the City's acquisition of the Properties will be a significant step toward the City's Comprehensive Neighborhood Revitalization Strategy for the Model City Revitalization District; and WHEREAS, Resolution No. 00-758, adopted September 14, 2000, authorized the City Manager and City Attorney to purchase the tax deeds and take all other actions necessary to acquire the Properties, including execution of all necessary documents for such acquisition; and WHEREAS, it is in the City's best interest to take title to the Properties in the form of a warranty deed and the seller of the Properties has agreed to convey title to the City by warranty deed; and WHEREAS, pursuant to Resolution No. 02-1097, adopted September 26, 2002, the City Commission authorized an increase in funding in the amount of $85,000, from $300,000 to an amount Page 2 of 5 02-1142 not to exceed $385,000, to be allocated from Community Development Block Grant Program funds; and WHEREAS, the City Administration and the Model City Revitalization Trust Administration have reached an understanding that, to consummate the acquisition of the parcels (1) the property located at 1606 Northwest 58th Terrace is to be excluded from the transaction, (2) $300,000 to cover the costs associated with the acquisition and payments related to the subject properties will be provided by CDBG Program Income funds, and (3) $85,000 will be provided by the Model City Revitalization Trust, subject to approval by the Model City Revitalization Trust Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 00-758, adopted September 14, 2000, as amended by Resolution No. 02-1097, adopted Page 3 of 5 02-1142 September 26, 2002, is further amended in the following particulars:'/ "RESOLUTION NO. 00-758 Section 2. The acquisition of the following feur 444- three (3) multifamily properties as legally described in "Exhibit A", attached and incorporated, is authorized: 1435 NW 61St Street, Miami, Florida 1455 NW 61St Street, Miami, Florida 1475 NW 61St Street, Miami, Florida 1606 PdkQ Section 3. The allocation of Community Development Block Grant (CDBG) pProgram Income funds, in an amount not to exceed �' '-5,-eP $300,000, and Model City Revitalization Trust Funds, in an amount not to exceed $85,000, for a total of $385,000 to cover the costs associated with ate acquisition and payments related to the subject properties is authorized. Section 4. The City Manager and the City Attorney are authorized to take the appropriate legal steps required to acquire the subject multifamily properties. Section S. The City Manager is authorizedl' to execute all necessary documents, in a form acceptable to the City Attorney, for said acquisition. Section 6. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
