A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), AMENDING RESOLUTION
NO. 00-758, RELATING TO THE ACQUISITION OF
FOUR (4) MULTIFAMILY PROPERTIES AT 1435,
1455 AND 1475 NORTHWEST 61ST STREET AND 1606
NORTHWEST 58TH TERRACE, MIAMI, FLORIDA,
LOCATED IN THE MODEL CITY REVITALIZATION
DISTRICT; AUTHORIZING THE ALLOCATION OF
COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
PROGRAM FUNDS, IN AN AMOUNT NOT TO EXCEED
$385,000, TO COVER ALL COSTS ASSOCIATED WITH
THE ACQUISITION AND PAYMENTS RELATED TO THE
SUBJECT PROPERTIES; AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY ATTORNEY
TO TAKE THE APPROPRIATE STEPS REQUIRED TO
ACQUIRE THE SUBJECT PROPERTIES; AND
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR SAID ACQUISITION.
WHEREAS, in the early 1990's, the City of Miami provided
assistance in the form of a second mortgage to Devecorp, Inc.,
in the amount of approximately $1,651,565, for the
rehabilitation of certain multifamily apartment buildings as
listed herein (the "Properties") and as legally described in
"Exhibit A", 1435 Northwest 61St Street, 1455 Northwest 61St
Street, 1475 Northwest 61St Street and 1606 Northwest 58th
Terrace, Miami, Florida; and

WHEREAS, the Properties are located in the City's
designated Model City Homeownership Zone, and the City's
acquisition of the Properties will be a significant step toward
the City's Comprehensive Neighborhood Revitalization Strategy
for the Model City Revitalization District; and
WHEREAS, Resolution No. 00-758, adopted
September 14, 2000, authorized the acquisition of the Properties
by purchasing the tax deeds; and
WHEREAS, it is in the City's best interest to take title
to the Properties in the form of a warranty deed and the seller
of the Properties agreed to clear the title to the Properties
and convey title to the City by warranty deed; and
WHEREAS, it has taken the seller almost two years to
complete the process of clearing title to the Properties and
therefore, additional costs have been incurred which requires
the City Commission to authorize an increase of funding
authorized by Resolution No. 00-758 by $85,000, from $300,000 to
an amount not to exceed $385,000, in Community Development Block
Grant Program funds;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Resolution No. 00-758, adopted September 14,
2000, is amended in the following particulars:'/

Section 4 3. The allocation of Community
Development Block Grant (CDBG) program funds, in an amount
not to exceed $390,009 $385,000 to cover the costs
associated with the acquisition and payments related to the
subject properties is authorized.

Section -5 4. The City Manager and the City Attorney
are authorized to take the appropriate legal steps required
to acquire the subject multifamily properties.
Section -6 5. The City Manager is authorized!' to
execute all necessary documents, in a form acceptable to
the City Attorney, for said acquisition.

immediately upon its adoption and signature of the Mayor./

all necessary documents, in a form acceptable to the City
Attorney, for said acquisition.
Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.!/
zi The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.
3i If the Mayor does not sign this Resolution, it shall become
effective at the end of ten (10) calendar days from the date it
was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.
