WHEREAS, the Miami Zoning Board at its meeting of June 17, 2002, Item No. 7, following an advertised public hearing, adopted Resolution No. ZB 2002-0586 by a vote of seven to one (7-1), DENYING a request for a variance from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, schedule of district regulations, to waive 48 of the required 185 parking spaces and to waive four of the required loading docks for an affordable housing project for the properties located at TTCp1 T CONT IIE CITY C MEETING S E P 2 6 2002 Resolution ATO. 02-10'78 approximately 1.505-1551 Northwest 15th Street Road, Miami, Florida; and WHEREAS, the applicant has appealed the decision of the Zoning Board; and WHEREAS, the City Commission after careful consideration of this matter finds that the stated grounds for the appeal and the facts presented in support thereof do not justify reversing the decision of the Zoning Board denying the variance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission denies the appeal, and affirms the decision of the Zoning Board (Resolution No. ZB 2002-0586 adopted June 17, 2002), thereby denying a variance from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, schedule of district regulations, to waive 48 of the required 185 parking spaces and to waive four of the required loading docks for an affordable housing project for the properties located approximately at 1505-1551 Northwest 15th Street Road, Miami, Florida, legally described on attached "Exhibit A." Case No. 2002-0562 Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for Variances as follows: Variance for loading docks: Required - 4 Proposed - 0. Variance for parking: Required - 185 parking spaces. Proposed - 137 parking spaces. Request to waive- 48 parking spaces The following findings have been made: • It is found that the omission of the required loading docks is the result of an over- building of the subject property that will have an overall adverse impact on the neighborhood and adjacent properties. • It is found that although the use is compatible with the area and will be beneficial, the parking deficit of 48 parking spaces could have an adverse impact on the surrounding area due to overflow parking having to be accommodated on the adjacent streets. • It is found that there is no hardship to justify the requested variances. • It is found that since this proposal is new construction, it should be designed to comply with all zoning requirements. As proposed, the development, in response to City Community Development staff recommendations, would provide two bedroom condominiums units of a comparable size and price to rental units in the area. Zoning requires two parking spaces for each two-bedroom unit, resulting in 185 required spaces of parking. Although, statistically speaking Census Data research for the year 2000 tells us that the low-income population in that specific census tract does not own as much cars; therefore, we are planning to build 138 spaces, requesting an overall 25.4 % parldng reduction. b) The economic conditions and real estate market in Allapattah have created an environment where affordable ownership opportunities for lower income residents are unavailable. The petitioner in recognition of these conditions is pursuing the project to address these conditions, which are beyond his control and without the variance requested it will not be able to provide the needed housing. c) Application of the literal interpretation of the Zoning Ordinance would result in the applicant not being able to provide the housing that is needed and cause the petitioner to abandon the project. d) Granting the Variance requested for this subject property dos not confer that we the owner will apply this ordinance to other lands, buildings, or structures in the same zoning district as Rio del Sol. e) The variance required is the minimum required to provide for reasonable use of the land, while not building unnecessary parking spaces for its designed purpose of affordable housing. f) The request is in harmony with the general intent and purpose of the Zoning Ordinance and will not be injurious to the neighborhood or otherwise detrimental to the public welfare since the Zoning Ordinance recognizes the community benefits of affordable housing. Commissioner Gonzalez: I understand that Jubilee CDC's parking variance request is coming before the City Commission at its next meeting. Unfortunately I will be out of town, so I will not be able to attend and speak to the Commission on this matter. I happen to own four lots directly across the street from the proposed project, i.e. at 1516, 1520, and 1538 NW 15' St. Rd. For reasons which I spell out below, I STRONGLY SUPPORT THIS PARKING VARIANCE APPLICATION. First of all, I have driven past some of Jubilee's other affordable housing projects and I'm impressed with the quality of project that they develop. This is critical, since the whole Jackson/medical complex is an important source of jobs for City residents, and the replacement of deteriorated housing with quality, affordable housing is a win-win situation for all concerned and a crucial effort for Miami's long-term future welfare. Specifically on the question of adequate parking, I know from a number of other affordable housing projects in Miami there always seems to be a vast amount of unused parking. This is true of the two existing projects just a few 02-1078 blocks to the north of the proposed project. It's really quite irritating to anv taxpgyer who notices it because it represents wasted tax dollars. I asked Jubilee's staff if they had any documentation of this problem, and they gave me copies of the two attached letters. The letters prove, I think, that blind application of the City's standard parking requirement is truly foolish and self-defeating. I say "self-defeating" for a very specific reason. As a real estate broker I have worked with a few entities that develop affordable housing, including with Jubilee as their broker on this project, and I've come to understand something of the economics of affordable housing: • THE COSTS OF BUILDING AFFORDABLE HOUSING UNITS IS ABOUT TO EXCEED DADE COUNTY'S MAXEvIUM UNIT PRICE FOR THESE UNITS, SO DEVELOPMENT OF AFFORDABLE HOUSING IN GENERAL IN DADE COUNTY IS ABOUT TO BECOME FINANCIALLY IMPOSSIBLE. • AND RISING LAND COSTS REQUIRED TO PROVIDE UNNECESSARY PARKING HAS BECOME A TERRIBLE DRAIN ON THE LMTED DOLLARS AVAILABLE FOR AFFORDABLE HOUSING, THE STRAW THAT IS ABOUT TO BREAK THE CAMEL'S BACK. Since you personally have real expertise and, I know, a deep concern for the thousands of Miami residents who desperately need decent, affordable housing, I appeal to you to please give Jubilee's parking variance application not only your support but your leadership.
