HomeMy WebLinkAboutR-02-0988J-02-745 9/11/02 RESOLUTION NO. v A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR-FIFTHS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS, AND APPROVING THE EMERGENCY PURCHASE TO REPLACE THE ELEVATOR CYLINDER IN THE PARKING GARAGE ELEVATOR LOCATED AT THE CITY OF MIAMI POLICE DEPARTMENT HEADQUARTERS BUILDING, FROM EDFM CORPORATION, IN AN AMOUNT NOT TO EXCEED $35,000; ALLOCATING FUNDS THEREFOR FROM THE CAPITAL IMPROVEMENT PROGRAM, PROJECT NO. 312025.299301.6.830. WHEREAS, during the initial phase of the refurbishment of the five (5) elevators at the Police Department Headquarters Building facilities, it was discovered that the elevator cylinder in the parking garage was ruptured (cracked and oversized) and that the damage was irrepairable; and WHEREAS, upon reviewing the scope of work and all of the available options, with all interested parties, it was determined that replacement of the elevator cylinder was not covered under the existing scope of work and that this portion of the CITY COMMISSION MEETING or S F P 1 1 2002 Resolution No. �2- 988 refurbishment project should be suspended until the cylinder was replaced; and WHEREAS, suspension of that part of the refurbishment project would not further delay the elevators project and would not prevent compliance with the requirements of the code in order to obtain the Certificate of Use; and WHEREAS, the City Manager approved the emergency purchase order to replace the elevator cylinder in the parking garage elevator, in an amount not to exceed $35,000, from EDFM Corporation, the vendor awarded the contract pursuant to Public Works Bid #B-6350, for the refurbishment of the five (5) elevators at the Police Headquarters Building. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By an affirmative vote of four-fifths (4/5ths) of the members of the City Commission, ratifying, approving and confirming the City Manager's finding of an emergency, waiving the Page 2 of 4 02— 988 requirements for competitive sealed bids and approving the emergency purchase order to replace the elevator cylinder in the parking garage elevator located at the City of Miami Police Department Headquarters Building, from EDFM Corporation, in an amount not to exceed $35,000, with funds therefor hereby allocated from the Capital Improvement Program, Project No. 312025.299301.6.830. Section 3. The City Manager's issuance of an emergency purchase order for this purpose is further ratified, approved and confirmed. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' ` If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. BACKGROUND Pursuant to Public Works Bid #B-6350, EDFM Corporation was awarded a contract for refurbishment of the five (5) elevators at the Police Department Headquarters Building facilities. During the initial phase of renovations, it was discovered that the elevator cylinder in the parking garage was ruptured (cracked and oversized) beyond repair. On July 3, 2002, Officer Martin Garcia met with Jorge Avinos and Jose Briz from the Public Works Department, Andres McDonald from the Building & Zoning Department, and Fernando Rodriguez, from EDFM Corporation, to determine the proper course of action. After reviewing the scope of work and all of the options, it was determined that replacement of the elevator cylinder was not covered under the existing scope of work and that this portion of the project must be put on hold until the cylinder was replaced.
