A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
PAY CERTAIN INDIVIDUALS AND PARTICIPATING
AGENCIES AS SPECIFIED HEREIN FOR PROFESSIONAL
SERVICES PROVIDED RELATING TO THE ACTIVATION
AND DEPLOYMENT OF THE URBAN SEARCH AND RESCUE
("USAR") TASK FORCE, FL TF2 (THE "TASK
FORCE") TO ASSIST IN THE RESCUE EFFORTS IN
NEW YORK CITY FROM SEPTEMBER 11TH THROUGH
26TH, 2001; ALLOCATING FUNDS FROM ACCOUNT
CODE NO. 11095.000000.2224, IN THE AMOUNT OF
$1,401,989.22, SUCH FUNDS HAVING BEEN
PREVIOUSLY REIMBURSED TO THE CITY AT 100% BY
THE FEDERAL EMERGENCY MANAGEMENT AGENCY
("FEMA") FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 93-224, the City entered
into a Memorandum of Agreement ("MOA") with the Federal Emergency
Management Agency ("FEMA") and the State of Florida, to sponsor a
local Urban Search and Rescue ("USAR") TASK FORCE, FL TF2 (the
"Task Force") to provide immediate response to save lives and
protect public health, safety and property in the event of a
catastrophic disaster; and
WHEREAS, the provisions of the MOA provides that all costs
associated with any Federal activation shall be 100% reimbursable
by FEMA, and it further stipulates that the Sponsoring Agency

shall be responsible for disbursement of funds to the various
municipalities, individuals, and entities; and
WHEREAS, the Task Force was deployed from September 11th
through 26th, 2001, to assist in the rescue efforts in New York
City due to the terrorist attack against the United States that
caused multiple deaths and injuries in New York City; and
WHEREAS, FEMA has reimbursed the City in full for all
personnel costs associated with the deployment to New York, and
the City, in accordance with the MOA, must now pay the
participating individuals and agencies;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized and directed
to pay the individuals and participating agencies as specified
hereinbelow for professional services provided relating to the
activation and deployment of the USAR Task Force to assist in the
rescue efforts in New York City from September 11th through 26th,
2001, with funds allocated from Account Code
No. 11095.000000.2224, in the total amount of $1,401,989.22, such

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayorll.
1� If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the
City Commission.

It is respectfully recommended the City Commission adopt the attached Resolution authorizing the City
Manager to process payment for the individuals and participating agencies associated with the activation
of the Urban Search and Rescue ("US&R") Task Force, FL TF2 (The "Task Force") by the Federal
Emergency Management Agency ("FEMA") for deployment to New York City from September 11-26,
2001, for a total cost of $1,401,989.22. Funding is available from Account Code No.
110095.000000.2224.
BACKGROUND
The Department of Fire -Rescue, pursuant to Resolution No. 93-224, functions as the lead department in
fulfilling the City's responsibilities as a Sponsoring agency as outlined in the Memorandum of
Agreement (MOA) with FEMA. An updated version of this Memorandum of Agreement is being
executed at the Federal level; therefore, the existing Memorandum of Agreement is still in effect.
The Memorandum of Agreement specifies that all costs associated with any Federal Activation will be
100% reimbursed by FEMA, and further stipulates that the Sponsoring agency will be responsible for
disbursing these funds to the various municipalities, individuals and entities. Resolutions No. 01-484 and
02-843 allows for these funds to be dispensed.
On September 11, 2001, the South Florida Urban Search and Rescue ("US&R") Task Force, FL T2 (the
"Task Force") was deployed to participate in the search and recovery efforts in the World Trade Center
disaster from September 11 — 25, 2001. The Federal Emergency Management Agency (FEMA) has
reimbursed the City in full for all costs associated with mission to New York City. The City of Miami
must now disburse these funds to the proper entities and individuals as per the Memorandum of
Agreement.

AGREEMENT, IN SUBSTANTIALLY THE ATTACHED
FORM, BETWEEN THE CITY OF MIAMI, THE STATE OF
FLORIDA AND THE FEDERAL EMERGENCY MANAGEMENT
AGENCY (FEMA), FOR THE PURPOSE OF SETTING
FORTH THE PARTIES RESPONSIBILITIES IN
CONNECTION WITH THE DEVELOPMENT AND SUPPORT
OF A LOCAL URBAN SEARCH AND RESCUE TASK FORCE
SPONSORED BY THE CITY OF MIAMI FIRE
DEPARTMENT, CONTINGENT UPON'FUNDING FOR SAID
PROJECT BEING SECURED IN THE FORM OF GRANTS
AND REIMBURSEMENTS FROM STATE AND FEDERAL

WHEREAS, the Robert T. Stafford Disaster Relief and
Emergency Assistance Act (Public Law 93-288, as amended) (the
"Stafford Act") provides the authority for the Federal government
to respond to disasters and emergencies in order to provide
assistance to save lives and protect public health, safety, and
property; and
WHEREAS, the Federal Response Plan (for Public Law 93-288,
as amended) (the "Plan") addresses the consequences of any
disaster or emergency situation in which there is a need for
Federal response assistance under the authorities of the Stafford
Act; and

WHEREAS, in accordance with the Plan, the Federal Emergency
Management Agency (FEMA) has created a nationwide network of
Urban Search and Rescue (US&R) Task Forces strategically located
throughout the United States; and
WHEREAS, the scope of US&R activities in response to a
catastrophic disaster includes locating, extricating and
providing for the immediate medical treatment of victims trapped
in collapsed structures; and
WHEREAS, the National US&R Response System will assist and
provide support to local fire departments which sponsor US&R
activities and assume responsibility for developing and training
a Task Force capable of being deployed within six hours in
response to a catastrophic disaster; and
WHEREAS, the City of Miami Fire Department is willing to
undertake the role of sponsoring organization for purposes of
developing an US&R Task Force in Dade County with the
participation of members from the Fire Departments of the cities
of Coral Gables, Miami Beach, and Hialeah; and
WHEREAS, funding for the training of personnel and purchase
of US&R equipment is anticipated in the form of a grant from the
State of Florida; and

WHEREAS, any and all expenses incurred by the US&R Task
Force mobilized at the request of FEMA in response to an event
requiring said assistance are fully reimbursable by FEMA; and
WHEREAS, the City of Miami's participation in the Plan is
contingent upon the City executing a Memorandum of Agreement with
FEMA and the State of Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the

thereto and incorporated herein as if fully set forth in this
Section.

MEMORANDUM OF AGREEMENT
This Agreement entered into this day of , 19 , by and between the
Federal Emergency Management Agency (FEMA), the State of Florida, (the "State"), and
the City of Mimi, a municipal corporation of the State of Florida, (the "City").
This Agreement delineates responsibilities and procedures for Urban Search and
Rescue (US&R) activities under the authority of "The Robert T. Stafford Disaster
Relief and Emergency Act," Public Law 93-288, as amended, 42 U.S.C. S5121, et seg•
and relevant state authorities, or when otherwise properly directed.
The provisions of this Agreement apply only to US&R Task Force activities performed
at the request of the Federal government according to the Federal Response Plan (for
Public Law 93-288, as mended), which may be provided at the option of the City, and
the State and in conjunction with, or in preparation of, a Presidential declaration
of a disaster or emergency and upon activation as outlined below in section V. (A)
pRUCIDURES. Details concerning specific working relationships on various projects
may be appended to this Agreement as they are developed.
III. DEFINITICN
A. Activation: the formal request by FEM& to a Sponsoring Jurisdiction,
via procedures outlined in section V. , to mobilize and
respond utilizing their Task Force. The Task Force is to arrive at a
designated point -of -departure within six [6] hours of being activated.
B. Alert: the formal ratification by FEMA to a Sponsoring Jurisdiction,
via procedures outlined in section V. PROCEDURES, that an event has
occurred or is projected to occur, and that the Task Force might be
activated. Sponsoring Jurisdictions, placed on alert by FEMA, should
initiate activities which enhance their capability to respond to a
pending activation.
C. Associate Director: the Associate Director for. the State and Local
Programs and Support. Directorate, FEMA.
D. Department of Defense (DOD): the DOD, to include the military and
civilian canporwnts. DOD is the primary agent for coordinating US&R
efforts under Emergency Support Function (ESF) #9, US&R, of the Federal
Response Plan.
E. Director: the Director of the Federal Emergency Management Agency.
F. Disaster Assistance Employee (DAE): a temporary Federal employee, hired
under the provisions of the Robert T. Stafford Disaster Relief Act.
G. Disaster Medical Assistance Team (CHAT): a functional unit activated
under the NEM which provides austere nedical care in a disaster area or
medical services at transfer points and reception sites associated with

H. Emergency Information and Coordination Center (EICQ : a control center
located within FEMA headquarters in Washington, DC, to provide inter-
agency coordination of assistance to emergency or disaster areas.
I. Emergency Support Function (ESF): annexes to the Federal Response Plan,
numbered 1 through 12, that define functional areas of responsibility,
describe organizational structures, and provides specific assignments to
federal agencies and departments to facilitate a coordinated Federal
delivery of disaster response assistance to supplement State and local
emergency response of fort .
J. Federal Response Plan: the Federal Response Plan (for Public Law 93-
288, as amended), establishes the basis for the pixmision of Federal
assistance to a State and its affected local its impacted by a
catastrophic or significant disaster or emergency which results in a
requ=wmt for Federal response assistance. The Plan outlines the
planning assumptions, policies, concept of operations, organizational
strictures and specific assignments of responsibility to the 27 Federal
agencies and departments, grouped into Emergency Support Functions
(ESF), who will provide coordinated response assistance to supplement
State and local response efforts.
K. FEMA: the Federal Emergency Management Agency -
L. Hard Match: FEMA's process of matching a Sponsoring Jurisdictions cash
expenditure with a cash reimbursement at.aratio.
M. Incident Cammanier: the individual in charge of coordinating response
activities within a disaster site. Under normal circumstances this
individual will be an emergency manager from the local community
responsible for incident activities including the development and
implementation of strategic decisions, and who approves the request and
allocation of resources.
N. National Disaster Medical System (NMV): a cooperative effort of the
Department of Health and Human Services (IM), Department of Defense
(DOD), Department of veteran Affairs (VA), FEMA, sand State and local
gvvernrments and the private sector designed to care for a large number
of casualties resulting from either a domestic disaster or an overseas
war. The Public Health Service (PHS) heads the procg .
0. National pwrgenpy Coordinating Center (NEOC): a twenty four [24] hour
flrimary ratification center located in Berryville, VA.
P. Participating Organization: a public, private, or individual entity who
has entered into an agrewmt with the Sponsoring Jurisdiction to
provide support (personnel, equipment, services or funding) for the
establishment of an US&R Task Force.
Q. Soft Match: FEMA's process of matching any type of expenditure by
Sponsoring Jurisdiction with a cash reimbursement at a predeteamined
ratio.

R. Sponsoring Jurisdiction: For purposes of this Agri- rn t, the Sponsoring
Jurisdiction shall be the City of Miami, a municipal corporation of the
State of Florida; a public entity Providing official sanction to a FEMA -
endorsed US&R Task Force. The City of Miami Fire Department will be the
administrating agency of the US&R Task Force for the City.
S. State: the State of Florida. The Division of Emergency Management will
be the administrating agency of the US&R Task Force for the State.
T. Task Force: a tactical component of the Federal Response Plan, under
ESF #9 - Urban Search and Rescue, composed of 56 persons divided into
functional elements of search, rescue, medical, technical support and
management (refer to the FEMA US&R Response System Manual).
U. Task Force Leader: a Sponsoring Jurisdictions representative
responsible for team training, equipment maintenance, mobilization and
tactical direction of the Task Force.
V. Urban Search and Rescue, (US&R): the tern used to define the strategy,
tactics and operations for locating, providing medical stabilization and
treatment, and extrication of entrapped victims encountered in natural
and man-made disasters.
A. FEMA agrees to:
1. Provide coordination, when appropriate, between the City, the local
public agency in who's jurisdiction the City's Task Force has been
sent, the State, and other relevant governmental and private
parties .
2. Provide limited funding and technical support and
,for equipment a
training specifically aimed at preparing the City -s Task Force to be
a fully operational Task Force as described in FEMA's US&R Response
System Manual (the US&R Manual). FEMA will also provide assistance
to the City in obtaining supplies and egnpnent from Federal and
donor sources for training and use in disaster. situations.
3. Provide full reimbursement of all costs incurred by the City -s Task
Force, its Participating Organizations, and its Task Force members
as outlined in section VI. FIMICIAL AGREEMEWS.
4. Provide document control at the Regional office ensuring that all
reports are directed to FEMA Hea Federal Response
Division, Sri -CE -FR -OP, Attn: US&R.
B. 7he State agrees to:
1. Maintain 24-hour alert capabilities, including a point -of -contact or
duty officer available at all times.
2. Implement FEW s alert and activation procedure by contacting the
City whenever called upon to do so by F a-

3. Provide limited furrling, ad n Strative, and technical support for
equipment, training, and staffing specifically aimed at preparing
the City's Task Force to be a fully operational Task Force, as
described in FENA's the S&R Manual.
4. Provide document control at the State office ensuring that all
reports are directed to their respective FEMA Regional Point of
Contact.
C. hinder -Emergency Support Function #9" of the Federal Pespcnoe Plan, Dm
agrees to •
1. Provide all transportation of the Task Force between point -of -
departure, disaster sites and return to point -of -departure.
2. Provide logistical, maintenance, and other support to deployed US&R
Task Forces.
3. Coordinate the replacement and/or rehabilitation of expended,
damaged, lost, or destroyed Task Force equipment and supplies used
in the course of operations.
D. 7he City agrees to:
1. Provide an administrating agency, which will be the City of Miami
Fire Department, who will carry out the herein agreed upon
responsibilities of the City.
2. Recruit and organize an Urban Search and Rescue Task Force, filling
the positions to the best of their ability according to the criteria
and guidelines described in FENA,' s the US&R Mamal .
3. Register and qualify all medical personnel on the Task Force through
the U. S. Public Health Se rvices (the "PHS"), as a specialized
UW. This includes a separate mou with the PIIS, the terms of which
will be appended to this m- , randum as "Attachment B" when
completed.
4. Provide training! with limited support and guidance from the State
and mm, to Task Force me-bers . Training will be consistant with
the objectives of developing, upgrading, and renewing skills as
needed to meet and maintain qualifications for the particular
positions on the Task Force according to the criteria and guidelines
described in FM's the US&R Manual.
5. Maintain 24-hour Task Force alert capabilities, including a 24-hour
phone amber and point -of -contact or duty officer available at all
times .
6. Develop, implement, and practice a Task Force personnel call -Out and
equipment mobilization procedure with the objective of being fully
mobilized at a pre -designated Point-of-de'Parture within six hours
from time of activation as outlined in section V. PROCEDURES.

7. provide administrative, financial, and personnel management as they
relate to the Task Force. All original paperwork will be filed with
the City with copies, as outlined in VIII. REPOEMM REQUIREmEms,
sent via the State to FEMA, Federal Response Division, SLOE -FR -0P,
Attn: US&R.
8. Develop, maintain and provide accountability for US&R-specific
equipment purchased with matching funds fran FEMA.
9. provide personnel and equipment for US&R-related training exercises,
as agreed upon with FEMA and the State, subject to availability of
such Task Force personnel and equipnent which will be based upon
State and local requirements and priorities at the time such
personnel and equipment are needed. Requests for City participation
in sanctioned training will be provided to the City in writing.
A. Alert & Activation
1. Upon request ficin State goveriments for Federal disaster
assistance, or detennination by FEMA that pre -positioning US&R Task
Forces is prudent, FEMA shall request the activation of forces
necessary to respond to the emergency or disaster situation. Alert
notifications can be initiated tly by FEIN.
2. Alert and/or Activation notices shall be cm=z cated by the EICC
or ICC, through the appropriate State Emergency Management Office,
to the City's pre -designated 24-hour emergency point -of -contact.
3. Upon notification frcrn the State of the Task Forces activation,
the City shall info= the State within a reasonable time whether or
not they will be resporxiing to the request, and if responding they
shall activate their Task Force via their pre -established and
practiced personnel call -out and equipment mobilization procedures.
B. Mobilization, Deployment, and Redeployment
1. The City shall mobilize and move their Task Force personnel and
equi mment to the pre -designated point -of for pickup by
DOD aircraft within six hours of official activation.
2. Upon arrival at the mobilization center, DOD will provide an on -
ground briefing, maps, food and housing (as necessary) and other
items essential to the immediate deployment and operation of the
Task Force. DOD will supply a liaison officer and a radio operator
to each Task Force deployed to a disaster site.
3. DOD shall provide transportation to and from the mobilization
center and the disaster site.
4. The US&R Task Force will operate within the guidelines and
constraints outlined in the US&R Manual.

5. Upon completion of the US&R mission, the Task Force shall be
redeployed to their original point -of -departure by DOD.
1. Under Emergency Support Function (ESF) *9 - Urban Search and
Rescue, of the Federal Response Plan, DOD has the overall
management responsibilities of the Task Forces from their
activation to arrival at a declared disaster area, and from
deactivation until their return to their original point -of -
departure.
Z. Tactical employment of US&R Task Forces will be passed fzzm DOD to
the local or on-site Incident Camtanderr within the disaster area.
A. Future funding for training and equipment will be allocated as
determined by FEKk.
B. Fran the time of activation by FEIN, until the Task Force is
returned to a state of readiness within the city, the City and its
Participating Organizations shall be fully compensated in
accordance with the current employee pay schedules, benefits, -and
policies set forth by the City and its Participating Organizations
and/or State, as muned by the parties, and agreed to by the
Federal government. (See attachment "a" for current hourly rates
of Task Force personnel pay schedules and benefits.)
C. Any reasonable expense in�ed by the City and its Participating
Organizations in filling a Task Force member's position while the
Task Force matter has been activated, will be paid for by FEMA.
FEMA will reimburse the Sponsoring Jurisdiction and the
Participating Organizations (through the sponsoring jurisdiction)
the normal rates of pay and backfill costs (excluding personnel
costs associated with mmters of the medical team) accrued as a
result of activation of the task force by Fes. FEKk will not pay
personnel costs above the normal and usual rate for that position.
It is expressly agreed and axierstood by FES, the State, and the
City that such personnel costs reasonably include differential
overtime campensatiom if the organization is required to pay such
eatpensation costs in filling positions deemed critical for public
safety and well being.
D. Any reasonable expense incurred by the City and the Participating
Organizations for the purpose of mobilizing the Task Force in
response to a Federal activation and/or alert and destabilizing
(returning the Task Force to a state of readiness within the City)
shall be paid for by FII.

E. Medical Team personnel shall be registered as a Disaster Medical
Assistance Team members under the guidelines of the PHS "National
Disaster Medical System." (See attachment "B" - PHS MOU). All
medical team personnel, including employees of the Sponsoring
Jurisdiction , are subject to the pay schedule and Federal benefits
established through the National Disaster Medical System. FEMA,
continues to work with the PHS to establish more equitable pay
schedules for medical team personnel.
F. Task Force members shall be reimbursed for travel and per diem
costs in accordance with Federal travel regulations, unless
otherwise authorized.
G. Task Force members shall be reimbursed for reasonable personal
costs of operations and maintenance incurred in conjunction with
disaster operations.
H. Task Force organizational materials, equipment, and supplies
consumed while providing requested assistance shall be reimbursed
to the City on a replacement basis. Replacement and/or
rehabilitation requests shall be sutmitted to DOD prior to
demobilization.
I. Rehabilitation or replacement costs of non-expwx9able operational
equipment will be reimbursed if the piece of equipment was used at
a disaster site or on., disaster exercises, as authorized by FEMA.
FFA, will consider on a case-by-case basis the replacement of lost
or stolen equipment, where that equipment was not lost or stolen as
a result of negligence on the part of the Task Force or its
personnel.
J. No Task Force or any individual Task Force member shall be
reimbursed by FEMA for costs m-curred by activations outside the
scope of this Agreement.
R. The city shall act as central agent for the submission of all
reimbursement claims to FEIP, via the State, and the disbursement of
all compensations fram FE[& regarding all FM, -sanctioned Task
Force Activities.
L. All equipment purchased under this Agreement will become the
property of the City, unless it was received in the name of the
Sponsoring Jurisdiction and the Participating Organizations
jointly. It will then be jointly awned and distributed if the Task
Force is dissolved under the teams and conditions outlined in
Section W. (F) of the participating organization M.O.A. Equipment
purchased and supplied by a Participating Organization is the
property of that organization on loan to the Task Force. The
equipment supplied by the Participating Organization may be
withdrawn frau use by the Task Force upon advance written notice.
M. All financial camnitments herein are made subject to the
availability of funds and subject to continued mutual Agreement of
the parties.

N. with the-oception of the Medical Team b sonnel, those individuals
who are not employees of the Sponsoring Jurisdiction will be either
brought onto the Sponsoring Jurisdiction or the States payrolls as
contingent employees for purposes of consolidated billing. If the
State or the local jurisdiction cannot accamplish this, FEMA will
register these individuals as federal employees in conjunction with
the National US&R Program.
VII. I-IABII r Y & MMUMCS CtI�EiZSATICN
A. Under Section 305 of the Stafford Act, Task Force members and their
employing agencies, performing a function under the authority of PL
93-288, as amended, are not liable for any claim based upon the
exercise or performance of or the failure to exercise or perform that
function.
B. The Task Force members, including Task Force leaders, search, rescue
and technical teams are considered Federal employees when activated.
Task force members will remain employed by their respective
sponsoring or participating organization for salary and assessments
of other benefits; but upon activation, they will became Federal
employees for the tort liability purposes of the Federal Tbrt Claims
Act.
C. Task Force members engaged in activities outlined in terms of this
Agreement will be afforded the same protection [under the Federal
Tort claims act and the Federal Employees- Catenation Act (FEC,) ]
against personal liability, death, or injury as are regular Federal
employees for actions taken within the scope of their Federal
employment. Federal benefit payments made in reference to this
section will be paid to the City or the Participating Organizations
to offset the obligations paid to their injured/dead personnel and
their beneficiaries.
A. The City will submit quarterly financial statements and activity
reports -to the State, to be forwartkd to the Regional Office,
then to FEI+A headquarters, in accordance with instructions provided
by the State.
B. The City will submit in writing to the State all personnel changes as
they relate to the carposition of the Task Force. This includes
information of personnel training and qualification upgrades. As new
members are admitted to position on the Task Force the relevant
portions of the qualifications list will also be submitted to the
State. The State in turn will forward this information to the FEMA
Regional Office who will then forward the information to FEMA
Headquarters .
C. A copy of the PHS M h will be submitted by the City via the State to
FEMA, Federal Response Division, SLOE -FR -OP, Attn: US&R.
D. Verification of the Task Force manber credentials, as they relate to
the criteria outlined in the US&R manual, will be submitted by the
City to FEMA via the State on an annual basis and at such other times
as requested by FE1k.

A. This Agreement will end on December 31, 1995, at which time all
parties may agree to renew the association. Renewal will be based on
evaluation of the City's ability to conform with procedures, training
and equipment standards as described in the USSR manual.
B. This Agreement may be modified or amended only on written agreement
of all parties, and all amendments shall be attached hereto. This
Agreement may be terminated by any party hereto upon 30 days written
notice.
C. Fes, camplies with the provisions of Executive Order 11246 of
September 24, 1965, as amended; arra with the rules, regulations and
relevant orders of the Secretary of Labor which prohibits
discrimination against any employee or applicant for employment on
the grounds of race, color, religion, sex, or national origin. In
addition, use of Federal facilities, supplies and services will be in
compliance with regulations prohibiting duplication of benefits and
guaranteeing nondiscrimination. Distribution of supplies, processing
of applications, provision of technical assistance and other relief
and assistance activities shall be accamplished in an equitable and
impartial manner without discrimination on the grounds of race,
color, religion, nationality, sex, age, or economic status.

WHEREAS, the Robert T. Stafford Disaster Relief and
Emergency Assistance Act (the "Stafford Act") provides the
authority for the Federal government to respond to disasters and
emergencies in order to save lives and protect public health,
safety, and property; and
WHEREAS, the Federal Response Plan (the "Plan") addresses
the consequences of any disaster or emergency situation where
Federal response assistance is needed under the authority of the
Stafford Act; and

WHEREAS, according to the Plan, the Federal Emergency
Management Agency (FEMA) has created a nationwide network of
Urban Search and Rescue (US&R) Task Forces strategically located
throughout the United States; and
WHEREAS, the scope of US&R activities in response to a
catastrophic disaster includes locating, extricating and
providing for the immediate medical treatment of victims trapped
in collapsed structures; and
WHEREAS, the National US&R Response System will assist and
support local fire departments which sponsor US&R activities and
assume responsibility for developing and training Task Forces
capable of responding to a catastrophic disaster within six
hours; and
WHEREAS, pursuant to Resolution No. 93-226, adopted
April 15, 1993, the City of Miami Department of Fire -Rescue
successfully sponsored the existing US&R Task Force; and
WHEREAS, funding for the training of personnel and the
procurement of US&R equipment is available from a grant from the
State of Florida; and
WHEREAS, Memorandum of Agreements will continue through
December 31, 2005; and
WHEREAS, any and all expenses incurred by the US&R Task
Force mobilized at the request of FEMA in response to an event
requiring said assistance are fully reimbursable by FEMA;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings' contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized!' to execute
Memorandum of Agreements, in substantially the attached form,
with each of the participating agencies listed in "Exhibit A",
attached and incorporated, setting forth the agencies'
responsibilities in connection with the development and support
of a local Urban Search and Rescue Task Force and coordinated by
the City of Miami Department of Fire -Rescue, with all costs to be
reimbursed by State and Federal funding sources.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.21
=� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

MEMORANDUM OF AGREEMENT
FOR PARTICIPATING AGENCIES
This Agreement is entered into this day of , 2001, by
and between the City of Miami, a municipal corporation of the State of Florida, (the
"Sponsoring Agency") and the
(the "Participating Agency").
RECITALS
WHEREAS, the Sponsoring Agency is the coordinating and sponsoring agent of
the South Florida Urban Search and Rescue (US&R) Task Force, FL TF2 (the "Task
Force"); and
WHEREAS, as the Sponsoring Agency ismresponsible for mobilization of the
Task Force, when the Task Force is activated by the Federal Emergency Management
Agency ("FEMA"); and
WHEREAS, the City Commission of the City of Miami, by Resolution No: 01 -
adopted on , 2001, has authorized the City Manager to
enter into this Agreement with each Participating Agency on behalf of the City of Miami;
and
WHEREAS, in executing this Agreement the City of Miami is acting in its
capacity as Sponsoring Agent of the Task Force and not as a direct employer of the
Participating Agency; and

WHEREAS, the Participating Agency possesses the necessary knowledge,
equipment, resources and expertise to perform the services herein required;
NOW THEREFORE, in consideration of the foregoing, the parties hereto agree
as follows:
1. PURPOSE
A. This Agreement delineates responsibilities of the Sponsoring Agency and the
Participating Agency for Urban Search and Rescue activities under the search and
rescue function delineated in the Robert T. Stafford Disaster Relief and Emergency
Assistance Act, P.L. 93-288, as amended, Sec. 403(A)(3)(b).
B. This Agreement serves as the Scope of Work of the Cooperative Agreement
between a Participating Agency and the Sponsoring Agency.
II. SCOPE
A. The provisions of this Agreement apply to National US&R Response System
activities performed at the request of the Federal government, provided at the option
of the Sponsoring Agency, and in conjunction with, preparation for, or in anticipation
of, a Presidential declaration of a major disaster or emergency.
B. No provision in 'this Agreement limits the activities of the Task Force or its
Sponsoring Agency in performing local and state functions.

A. Activation: The status of a System asset placed at the direction, control, and
funding of FEMA in response to, or in anticipation of, a Presidential declaration of a
major disaster or emergency.
B. Activation Order: The FEMA notice that places a System asset onto activation
status.
C. Alert: A state of increased readiness initiated by an Alert Notice.
D. Alert Notice: The FEMA notice that places a System asset onto alert status, or that
an event has occurred or is expected to occur, such that System resources may be
subject to activation.
E. Deactivation: The removal of a System asset from activation status.
F. Demobilization Order: The FEMA notice that disengages a System asset from an
incident and specifies relevant information regarding activation status sLch as task
force personnel rehab time.
G. Deployment: Mobilization of a Task Force, IST or other System resource pursuant
to an Activation Notice.
H. Disaster Assistance Employee (DAE): An individual hired to augment permanent
full-time FEMA personnel in disaster operations in the field.
1. Disaster Medical Assistance Team (DMAT): A functional unit activated under the
National Disaster Medical System (NDMS), a program of the United States Public
Health Service (PHS), Office of Emergency Preparedness (OEP). The six -person
Medical Team deployed as part of the Task Force is classified as a specialty DMAT.

J. Emergency Information and Coordination Center (EICC): The facility used by the
Emergency Support Team at FEMA Headquarters during or in anticipation of a
Presidential Major Disaster or Emergency Declaration.
K. Emergency Procurement: Upon Activation, the purchase by the Task Force of
equipment, food and other consumables, medicines, and pharmaceuticals, essential
to the Urban Search and Rescue mission, under the authority of the Stafford Act,
Sec. 306(b)(3).
L. Emergency Response Team (ERT): • The interagency group that provides
administrative, logistical, and operational support to the FEMA regional response
activities in the field. The ERT includes an ESF-9 cell, which consists of the ESF-9
Leader and the IST, and supporting Federal agency representatives, as required.
M. Emergency Support Function (ESF): Pursuant to the Federal Response Plan, the
primary mechanism through which Federal disaster assistance is provided to assist
the State in meeting response requirements in an affected area. Each ESF is
coordinated by a primary agency. FEMA is the primary agency for ESF #9 - Urban
Search and Rescue.
N. Emergency Support Team (EST): Pursuant to the Federal Response Plan, an
interagency group comprised of representatives from each of the primary agencies,
select support agencies and FEMA Headquarters staff. It operates from the FEMA
EICC.
O. Equipment Cache: Equipment on the US&R Equipment Cache List that a Task
Force is required by FEMA to possess.
P. Equipment Cache List: The FEMA approved inventory list of equipment by type
and quantity a Task Force is required to possess for operations.

Q. Federal Emergency Management Agency (FEMA): Pursuant to P.L. 93-288, as
amended, the Federal agency responsible for coordinating Federal assistance to
.State(s) affected by disasters or emergencies, which includes the development and
maintenance of the National Urban Search and Rescue Response System.
R. FEMA Region: The geographical subdivision of the United States through which
FEMA administers its programs; the FEMA administrative unit that is the primary
contact for any disaster occurring within that geographical subdivision.
S. FEMA Sanctioned Training or Exercise: A'kaining session or exercise that has
received FEMA sanction and is sponsored by an organization other than FEMA.
T. FEMA Sponsored Training or Exercise: A training session or exercise arranged
for and financed by FEMA, delivered either by FEMA or by another organization.
U. Federal Coordinating Officer (FCO): The person appointed by the President to
coordinate the Federal disaster assistance activities in each State in which a
disaster or emergency has been declared.
V. Federal Response Plan (FRP): Pursuant to P.L. 93-288, and as amended, the
document that establishes the framework for the provision of Federal assistance to a
State and its affected local governments.
W. Incident Commander: The person, usually from the local jurisdiction, who is
responsible for overall management of an incident.
X. Incident Support Team (IST): An element of the ESF-9 cell of the ERT that is
under the direction of the ESF-9 Leader (a FEMA Regional or Headquarters
employee acting as the authorizing official for ESF-9 expenditures). The IST is

responsible for the overall command and control of all National Urban Search and
Rescue Response System assets deployed for the incident.
Y. Mobilization: The movement of System assets to an incident.
Z. National Disaster Medical System (NDMS): A cooperative effort of the Department
of Health and Human Services (HHS), Department of Defense (DoD), Department of
Veterans Affairs (VA), FEMA, and State and local governments and the private
sector that is designed to care for a large number of casualties resulting from either
a domestic disaster or an overseas war. The Public Health Services (PHS) heads
the program.
AA. National Urban Search and Rescue Response System (System): The Task
Forces, Incident Support Teams, Rapid Needs Assessment Team elements, and
other personnel and technical teams that respond to disasters or emergencies
under the direction and control of FEMA as Emergency Support Function 9 of the
Federal Response Plan.
BB. Participating Agency: An entity with which the Sponsoring Agency has executed
an agreement to satisfy, in part, the Sponsoring Agency's responsibilities under this
Agreement.
CC. Point of Assembly (POA): Is the Miami Fire Rescue Training Center located at
3425 Jefferson Street, Miami, Florida 33133. However, this may change at the
discretion of the Task Force Leader.
DD. Point of Departure (POD): Is currently identified as the Homestead Air Reserve
Station (HARS) located in Homestead, Florida, However, this is subject to change
by FEMA or the Task Force Leader.

EE. Presidential Major Disaster or Emergency Declaration: A determination of the
President that Federal assistance is needed to supplement State and local efforts,
and capabilities to save lives and protect property and public health and safety, or to
lessen or avert the threat of a catastrophe in any part of the United States.
FF. Rapid Needs Assessment (RNA): A pre -designated team of technical experts from
Federal, State and local emergency management agencies, alerted and employed
under the command and control of FEMA to augment or supplement State and local
assessment capabilities.
GG. System: See National Urban Search and Rescue Response System.
HH. Task Force: An integrated collection of personnel and equipment meeting
standardized capability criteria, defined by FEMA, for addressing the special needs
of urban search and rescue.
II. Urban Search and Rescue (US&R): The process of searching for, extricating and
providing for the immediate medical treatment of victims trapped in collapsed
structures, regardless of cause.
IV. THE SPONSORING AGENCY SHALL BE RESPONSIBLE FOR:
A. Providing an administrative department, which shall be the City of Miami Fire -
Rescue Department, authorized to carry out the herein agreed upon responsibilities
of the Sponsoring Agency.
B. Recruiting, organizing, and coordinating trained members for the Task Force,
according to guidelines prescribed by FEMA to the best of their ability.

C. Registering and qualifying all medical personnel on the Task Force through U.S.
Public Health Service (PHS).
D. Implementing a system to maintain and account for the Task Force Equipment
Cache.
E. Providing administrative, financial, and personnel management for the Task Force to
the extent that funding is available.
F. Assure all Task Force members have a FEMA,.„ cognized employment status.
G. Purchasing equipment with FEMA funding according to the latest Equipment Cache
List or other equipment deemed necessary to perform day to day operations of the
task force.
H. Ensuring all personal task force equjpment' issued to Task Force members remains
the property of the Sponsoring Agency.
1. Notifying FEMA when there is a change in the deployment status of the Task Force.
J. Maintaining twenty-four (24) hour Task Force alert capabilities, including a 24-hour
phone number and point -of -contact. This is identified as the City of Miami Fire
Central Information Officer (FCIO) contacted through 305-579-6245 voice and 305-
579-6277 fax.
V. THE PARTICIPATING AGENCY SHALL BE RESPONSIBLE FOR:
A. Implementing a written policy and practicing a reporting procedure for Participating
Agency personnel, with the objective of notifying the Sponsoring Agency of

individuals responding from their organization to the Miami Fire -Rescue Training
Center when the Task Force is mobilized.
B. Faxing a list identifying deploying and non -deploying personnel from the
Participating Agency that are responding to the Miami Fire -Rescue Training Center.
The fax number is: 305-445-5183. This list shall be faxed within thirty (30) minutes
of the Task Force Activation and thereafter as changes are made.
C. Assuring Participating Agency personnel meet FEMA position description general
requirements and Sponsoring Agency specific minimum requirements prior to
submitting application for Task Force membership.
D. Ensuring that Task Force personnel from their organization continue to participate in
training opportunities provided by the Sponsoring Agency to meet the knowledge,
skills and abilities for their primary position.
E. Providing and maintaining a current labor contract on file with the -Sponsoring
Agency.
F. Providing a current benefit percentage calculation for regular and overtime and an
acceptable written justification of this percentage on file with the Sponsoring
Agency.
G. Task Force personal equipment issued by the Sponsoring Agency to the
Participating Agency team member lost, damaged, stolen or not returned when
requested, shall be replaced by and at the expense of the Participating Agency.
H. Within thirty (30) days after the completion of a mission, the Participating Agency
shall provide payroll, time sheets and other administrative documentation identified
by the Sponsoring Agency for activated Participating Agency team members to
assure appropriate and timely reimbursement.

1. Extending workers compensation protection to their personnel while participating in
Sponsoring Agency sanctioned training or cache maintenance activities while on or

J. Designating a primary coordinator and ensure this coordinator has an Electronic
Mail (e-mail) address to expedite distribution of US&R related information.
K. Assuring that the following baseline medical screening/surveillance items are met by
all rostered task force members:
a) Annual physical exam (per 29 CFR 1910.134)
b) Annual medical questionnaire with assessment by physician (per 29 CFR 1910)
Omitted all other requirements for Physicals waiting on description of regulations and
scope of physical requirements.
L. Notifying the Sponsoring Agency

VI. THE SPONSORING AGENCY AND THE PARTICIPATING AGENCY AGREE:
A. That funding acquired and identified for the purchase of Task Force equipment and
Task Force member training will be administered solely by the Sponsoring Agency.
B. The Sponsoring Agency is not responsible for personnel salaries, benefits, workers
compensation or time related issues of the Participating Agency personnel other
than reimbursement from the Federal Emergency Management Agency.
C. Sponsoring Agency and Participating Agency are state agencies or subdivisions as
defined in Chapter 768.28, Florida Statutes, and each party agrees to be fully
responsible for the respective acts and omissions of its agents or employees to the

extent permitted by law. Nothing herein is intended to serve. as a waiver of
sovereign immunity by any party to which sovereign immunity may be applicable.
Nothing herein shall be construed as consent by a state agency or subdivision of the
State of Florida to be sued by third parties in any manner arising out of this
Agreement or any other contract.
VII. FINANCIAL AGREEMENTS
A. The Participating Agency shall pay their participating team members in accordance
with their local payroll requirements, labor contracts or any other relevant
ordinances or procedures of the Participating Agency.
B. The Participating Agency will be eligible for reimbursement from FEMA of personnel
costs associated with the activation. This will include the straight time wages plus
benefits for all hours an activated team member is scheduled to work and overtime
plus benefits for all hours an activated team member was off duty_ during the
identified activation period.
C. The Participating Agency is eligible to hire overtime personnel on a one-to-one basis
to backfill for a deployed team member. Reimbursement shall be only for the
overtime portion of the salary of personnel used to backfill for activated team
members during the identified activation period. No benefit- percentage shall be
calculated for backfill personnel.
D. All financial commitments herein are made subject to the availability of funds and
the continued mutual agreements of the parties.
VIII. CONDITIONS, AMENDMENTS, AND TERMINATION

A. The Participating Agency will not illegally discriminate against any employee or
applicant for employment on the grounds of race, color, religion, sex, age, or
national origin in fulfilling any and all obligations under this Agreement.
B. Any provision of this Agreement later found to be in conflict with Federal law or
regulation, or invalidated by a court of competent jurisdiction, shall be considered
inoperable and/or superseded by that law or regulation. Any provision found
inoperable is severable from this Agreement, and the remainder of this Agreement
shall remain in full force and effect.
C. This Agreement may be modified or amended only with the written agreement of
each of the parties.
D. This Agreement may be terminated by either party on thirty (30) days written notice
to the other party.
E. This Agreement shall be considered the full and complete agreement between the
undersigned parties, and shall supersede any prior Memorandum of Agreement
among the parties, written or oral, except for any executory obligations that have not
been fulfilled.

F. This Agreement may be executed in several parts, each of which shall be
considered a valid Agreement, provided that each of the parties to this Agreement
has executed at least one (1) original copy of this Agreement and has transmitted a
copy of the signature page hereof to the other parties.
G. This Agreement will end on December 31, 2005, at which time the parties may
_ agree to renew the association. Renewal will be based on evaluation of the
Sponsoring Agency's ability to conform with procedures, training and equipment
standards as prescribed by FEMA.

WHEREAS, Resolution No. 01-330, adopted on April 26, 2001,
authorized the City Manager to execute individual Professional
Services Agreements, with each member of the USAR Team for the
purpose of providing technical assistance for the Department of
Fire -Rescue; and
WHEREAS, on September 11, 2001, the USAR Team was deployed
for fifteen days to participate in the search and recovery
efforts in the World Trade Center disaster; and

WHEREAS, the hourly rates for civilians were increased in
accordance with their area of expertise, such as doctors,
engineers and other professionals; and
WHEREAS, it is necessary to increase the compensation amount
of the Agreements in an amount not to exceed $22,000, from
$15,000 to $37,000 per incident, or as otherwise provided by the
FEMA Cooperative Agreement in order to pay past due and/or future
invoices, and to execute Professional Services Agreement with
each member of the Urban Search and Rescue ("USAR") Team for an
initial term of three years, with the option to extend for two
additional one-year periods; and
WHEREAS, the City Manager and the Director of the Department
of Fire -Rescue recommend this increase and amendment of
Resolution No. 01-330, be approved; and
WHEREAS, funds are available from the FEMA/USAR Grant Fund,
Account Code No. 110095.280906.6.340, to be reimbursed by FEMA
upon submission of appropriate documentation;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.

in New York City from September 11-26, 2001 for a total
