RESOLUTION NO.
A RESOLUTION OF THE MIAMI CITY COMMISSION
GRANTING AN EXTENSION OF A WAIVER OF USE
FEES FOR THE CAMILLE AND SULETTE MERILUS
FOUNDATION FOR HAITI DEVELOPMENT, INC. (THE
"FOUNDATION") AT THE MANUEL ARTIME COMMUNITY
CENTER, FROM MAY 13, 2002 UNTIL JANUARY 30,
2003; AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AMENDMENT TO THE REVOCABLE
LICENSE AGREEMENT (THE "AGREEMENT"), IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH
THE FOUNDATION FOR SAID PURPOSE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. An extension of a waiver of use fees for the
Camille & Sulette Merilus Foundation for Haiti Development, Inc.
(the "Foundation") at the Manuel Artime Community Center, from
May 13, 2002 until January 30, 2003 is granted.
Section 2.

Agreement
1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.

Section 3. This Resolution shall become effective

It is respectfully recommended that the City Commission deny the request of Mr. Camille
Merilus for an extension to the waiver of monthly fees for the use of office space at the Manuel
Artime Community Center. It is requested that the Camille and Sulette Merilus Foundation for
Haiti Development, Inc. (the "Merilus Foundation") start paying the monthly fee and security
deposit as required in the Revocable License Agreement.
BACKGROUND
On September 25, 2001, the City Commission adopted a motion authorizing the execution of a
Revocable License Agreement with the Merilus Foundation for use of 1,000 square feet office
space at the Manuel Artime Community Center located at 970 SW 1 Street. This motion further
provided for a waiver of the monthly use fees for a period of ninety (90) days from the effective
date of the agreement.
Following the City Commission recommendation, on October 2, 2001 the City forwarded to the
Merilus Foundation a Revocable License Agreement for its execution. Due to delays in the
Merilus Foundation providing proof of insurance and other documentation regarding the Merilus
Foundation's corporate status, the revocable license agreement was not executed until May 13,
2002. In accordance with this motion, the Revocable License Agreement provided for the
monthly use fees to commence ninety (90) days from the date of the execution of the agreement,
August 13, 2002.
As of today, the Merilus Foundation has not incurred a considerable amount of expenses in
improvements to the space to warrant the granting of an additional extension to the waiver of
monthly use fees.
At the present time, the occupancy of the Manuel Artime Community Center is 100%.
Resolution 00-25 adopted by the City Commission on January 13, 2000 established new fees for
the use of office space at the Manuel Artime Community Center. All the new tenants have
committed to pay the newly established rates and the existing tenants had a revision to their
previous rates through the execution of new Revocable License Agreements. The Revocable
License Agreement for the Merilus Foundation reflects the discounted rate for non -profits of
$6.38 per square feet, which translates to a monthly fee of $531.67.

Financial Impact — The impact to the general fund as a result of the initial 90 -day
waiver of fees was $1,595.01. An extension to the waiver of fees to January 1, 2003
will result in an additional loss of revenue in the amount of $2,481.13 which revenue
is used to pay for actual costs incurred by the City associated with maintenance and
utilities at the Manuel Artime Community Center.
