HomeMy WebLinkAboutR-02-0979J-02-819 9/04/02 RESOLUTION NO. 02- 079 A RESOLUTION OF THE MIAMI CITY COMMISSION AMENDING RESOLUTION NO. 02-878 WHICH AUTHORIZED THE ALLOCATION OF $1,928,400 OF 28TH YEAR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FUNDS AND $960,000 OF PROGRAM INCOME IN THE CATEGORY OF PUBLIC SERVICES, TO REFLECT THE REALLOCATION OF FUNDS, IN THE AMOUNT OF $40,000, FROM PUBLIC SERVICES DISTRICT 5 PRIORITY SET—ASIDE FUNDS TO DISTRICT 2 FOR THE 28TH PROGRAM YEAR BEGINNING OCTOBER 1, 2002; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE INDIVIDUAL AGENCIES FOR SAID PURPOSE. WHEREAS, federal regulations require the City to provide an opportunity for citizen participation in the planning process for U.S. Department of Housing and Urban Development ("HUD") related grant activities; and WHEREAS, a series of Public Hearings were held in each City Commission District to solicit public participation in the HUD planning process; and WHEREAS, the City of Miami conducted a Request for Proposal process to solicit proposals from agencies providing public service activities to City of Miami residents; and •�r,�c is S E r 1 1 2002 Resolution No. 02— 9"n WHEREAS, a Public Hearing was duly advertised and held July 8, 2002, regarding the proposed use for said grant funds; and WHEREAS, the City Commission adopted Resolution No. 02-772 at the Special City Commission Meeting of July 8, 2002, relating to the allocation of $1,928,400 of 28th Year Community Development Block Grant ("CDBG") Program funds and $960,000 of program income in the category of Public Services; and WHEREAS, specific allocations to agencies providing public services in District 2 with the available allocation of $462,144 were not identified at the July 8, 2002 Special City Commission meeting, but were allocated to specified agencies at the July 25, 2002 City Commission meeting through the adoption of Resolution No. 02-878; and WHEREAS, Resolution No. 02-878 further authorized the transfer of $40,000 Public Services District 5 Priority Set - Aside to District 2; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.3J The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 3/ If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. A RESOLUTION OF THE MIAMI CITY COMMISSION AMENDING RESOLUTION NO. 02-878, ADOPTED AT THE CITY COMMISSION MEETING OF JULY 25, 2002, RELATING TO THE ALLOCATION OF $1,928,400 OF 28TH YEAR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM FUNDS AND $960,000 OF PROGRAM INCOME IN THE CATEGORY OF PUBLIC SERVICES, BY SPECIFYING THE AGENCIES PROVIDING SAID SERVICES FROM THE TRANSFER OF $40,000 OF PUBLIC SERVICES DISTRICT 5 PRIORITY SET-ASIDE FUNDS TO DISTRICT 2 FOR THE 28TH PROGRAM YEAR BEGINNING OCTOBER 1, 2002; AND FURTHER AUTHORIZING THE CITY MANAGER TO ENTER AGREEMENT WITH SAID AGENCIES FOR SAID PURPOSE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO APPLICABLE CITY CODE PROVISIONS. WHEREAS, federal regulations require the City to provide an opportunity for citizen participation in the planning process for HUD related grant activities; and WHEREAS, a series of Public Hearings were held in each City Commission District to solicit public participation in the planning process for its .HUD related grant activities; and WHEREAS, the City of Miami conducted a Request for Proposal process to solicit proposals from agencies providing public service activities to City of Miami residents; and 02 1'9 WHEREAS, a Public Hearing was duly advertised and held July 8, 2002 regarding the proposed use for said grant funds; WHEREAS, the City Commission adopted Resolution No. 02-772 at the Special City Commission Meeting of July 8, 2002 relating to the allocation of $1,928,400 of 28th Year Community Development Block Grant (CDBG) Program funds and $960,000 of program income in the category of Public Services; and WHEREAS, specific allocations to agencies providing public services in District 2 with the available allocation of $462,144 mik not identified at the July 8, 2002 Special City Commission meeting, but was allocated to specified agencies at the July 25, 2002 City Commission meeting through the adoption of Resolution 02-878; and WHEREAS, Resolution 02-878 further transferred $40,000 Public Services District 5 Priority Set -Aside to District 2;, NOW, THEREFORE, BE IT RMSOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. BACKGROUND: At the July 8, 2002 Special City Commission Public Hearing discussion on Public Services, the City Commission adopted legislation allocating $1,928,400 of Community Development Block Grant (CDBG) funds available under the entitlement formula and an additional $960,000 of eligible program income in the Public Services category. Due to a combination of factors, which included a reduction of the public services cap from 25% to 15%, a distribution strategy that allocated available funds based on the HUD distribution formula by City Commission District and the $287,000 decrease in the City's CDBG grant, District 2 experienced a dramatic 47% reduction of CDBG funds available in the Public Services category. At the Public Hearing, the District 2 Commissioner indicated that sufficient time had not been provided to formulate a funding strategy to most effectively meet the public service needs with available CDBG funds in District 2. Subsequently, through the adoption of Resolution 02-878 at the City Commission meeting of July 25, 2002, specific public service activities were identified in District 2. In addition, the District 5 City Commissioner, in an effort to lessen the impact of the loss of public service dollars in District 2, transferred $40,000 from the District 5 Priority Set -Aside to fund public service activities in District 2. The transfer was subject to an advertised Public Hearing at the September City Commission meeting.
