J-02-744 9/11/02 RESOLUTION NO. 02— 978 A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOURTH -FIFTHS (4/5THS ) AFFIRMATIVE VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND ACCEPTING THE BID FROM MEF CONSTRUCTION INC., FOR THE PROJECT ENTITLED "CITYWIDE SIDEWALK REPLACEMENT PROJECT, PHASE XXI, B-4655", IN THE AMOUNT OF $168,250; ALLOCATING FUNDS FROM PROJECT NO. 341182, AS APPROPRIATED BY THE ANNUAL APPROPRIATIONS AND CAPITAL IMPROVEMENTS ORDINANCE, AS AMENDED, FOR THE CONTRACT COSTS AND $16,760 FOR EXPENSES, IN AN ESTIMATED TOTAL COST OF $185,010; AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA Section 1. By a four-fifths (4/5tns) affirmative vote of the City Commission, after a duly advertised public hearing, the City Manager's finding of an emergency is ratified, approved and confirmed, competitive bidding procedures are waived, and the bid of MEF Construction Inc., for the project entitled "Citywide CITY CON M MSION MEETING OF S E P 1 1 2002 Reso'luden No. 02- 978 Sidewalk Replacement Project, Phase XXI B-4655", in the amount of $168,250 for the total bid of the proposal, is accepted. Section 2. The total estimated project costs in the amount of $185,010 are allocated from Project No. 341182, as appropriated by the Annual Appropriations and Capital Improvements Ordinance, as amended. The total project costs consist of $168,250 for the contract costs and $16,760 for estimated expenses incurred by the City. Section 3. The City Manager is authorizedLl to execute an agreement, in a form acceptable to the City Attorney, with MEF Construction Inc., for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.V 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. DIAZ, MAYOR Page 3 of 3 �� _ CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: The Honorable Mayor and Members of the City Commission DATE: RJG n- 7 2002 FILE: SUBJECT: Emergency Project — Citywide Sidewalk Replacement Project, Phase M, B-4655 REFERENCES: ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution ratifying the City Manager's written finding that a valid emergency exists concerning the condition of the sidewalks citywide and waiving formal competitive bidding procedures and authorizing the City Manager to accept the bid of MEF Construction, Inc., a Local, Hispanic -minority corporation, whose principal is Maria Ocana, President, located at 782 N.W. 42 Avenue # 640, Miami, Florida 33126, as the lowest responsive and responsible bid in the amount of $168,250 Total Bid. JUSTIFICATION The Public Works Department has conducted a survey of the condition of sidewalks and curbs citywide and has identified 55,000 square feet of sidewalk as being in poor condition and in need of replacement. Due to their age and condition they represent a potential danger for the pedestrians and therefore should be replaced immediately. On April 29, 2002, the Department of Public Works received and publicly opened and read sealed bids for the above referenced project. The lowest bidder, Hard J. Construction Corporation has withdrawn his bid. In accordance with the "Instructions to Bidders" contained in the bid specifications, Metro Express, Inc., a non -local bidder, submitted the second lowest responsible and responsive bid for the sum of $168,250 for the Total Bid. However section 18-52(h) of the City Code, as amended, states that the City Commission may offer to a responsible and responsive local bidder whose primary office is located in the City of Miami, the opportunity of accepting a contract at the low bid amount, if the original bid amount submitted by the local vendor does not exceed 110 percent of the lowest other responsible and responsive bidder. MEF Construction, Inc., a Hispanic -minority local corporation has accepted and this offer and will reduce their bid to the low bid amount. FISCAL IMPACT None - - BUDGETED ITEM. March 22, 2002 FILE: B-4655 Emergency Finding Waiver of Formal Bids for Citywide Sidewalk Replacement Project, Phase XXI 8-4655 Based on my investigation of numerous damaged sidewalks and curbs throughout the City, l have found that an EMERGENCY exists which justifies the selection of a contractor by informal bids. The Public works Department has conducted a survey of the condition of sidewalks and curbs citywide and has identified 45,500 square feet of sidewalk as being in poor condition and in need of replacement. Due to their age and condition they represent a potential danger for the pedestrians and therefore should be replaced immediately. The total cost estimate, including construction, design, project management, inspection and incidentals, is $ 220, 000. This project is scheduled to be funded from the Local Option Gas Tax. Such conditions indicate the need for extraordinary measures to protect the health,safety and welfare of the community and the tenants and customers of the local business and residential areas throughout the City of Miami. In order to initiate the construction of the sidewalk and curbs as soon as possible, formal competitive sealed bid procedures shall be waived for the procurement of contracting services required for said emergency pursuant to sections 18-83 and 18-84 of the city code. Informal bids shall be obtained and a contract shall be awarded by the city manager to the lowest responsive and qualified bidder. All costs of this project will be funded from CIP Project No. 341182. Estimated total cost for the project is $220, 000.00.
