HomeMy WebLinkAboutR-02-0963J-02-783 9/10/02 RESOLUTION NO. 02— 963 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO SUBMIT GRANT APPLICATIONS TO MIAMI-DADE COUNTY, UNDER THE SAFE NEIGHBORHOOD PARK BOND PROGRAM ("SNPB") IN THE TOTAL AMOUNT OF $720,997, AS FOLLOWS: (1) $151,780 FOR SPECIFIED PROJECTS AND $100,000 FOR PER CAPITA PROJECTS FROM BOND SERIES 2002 PROCEEDS, (2) $350,000 FOR COUNTY -WIDE INTEREST EARNINGS LAND ACQUISITION PROJECTS FROM PREVIOUS BOND PROCEEDS, AND (3) $119,217 FOR CITY OF MIAMI MUNICIPAL INTEREST EARNINGS PROJECTS FROM PREVIOUS BOND PROCEEDS; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANTS AND EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; FURTHER, PURSUANT TO THE PROVISIONS CONTAINED IN THE SAFE NEIGHBORHOOD PARKS ORDINANCE, DIRECTING THE CITY MANAGER TO PROVIDE (1) SUPPLEMENTAL FUNDS REQUIRED TO COMPLETE SAID PROJECTS IF THE COSTS OF SAID PROJECTS EXCEED THE GRANT ALLOCATIONS, AND (2) FUNDS TO OPERATE, MAINTAIN AND PROVIDE PROGRAMMING AT EACH PROJECT UPON ITS COMPLETION. WHEREAS, the citizens of Miami -Dade County authorized the issuance of General Obligation Bonds (the "Bonds") for the purpose of financing capital improvement programs for certain parks, beaches, natural areas and recreation facilities; and CITY COMMIMON MEETING Of S E P 1 1 2002 Resolution No. 02- 963 WHEREAS, to implement and give effect to the Bond Program, Miami -Dade County, Florida, enacted Ordinance No. 6-115, the Safe Neighborhood Parks Ordinance (the "Ordinance"); and WHEREAS, it is necessary and desirable to improve the quality of life, to benefit property values, to promote prevention of juvenile crime by providing positive recreation opportunities, and to improve the recreation facilities for youth, adult, and senior citizens in this community through the improvement of our parks and natural areas; and WHEREAS, the projects more specifically designated herein have been identified for reimbursement pursuant to the terms of the Ordinance; and WHEREAS, pursuant to the terms of the Ordinance, the passage of this Resolution and the acts contemplated by this Resolution are conditions to obtaining said grants; and WHEREAS, the City of Miami has made applications to Miami - Dade County for grant monies from the Series 2002 Bond Program and Interest Earnings Bond Proceeds for the projects listed, pursuant to all terms and conditions of the Ordinance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Page 2 of 5 02- 963 Section 2. The City Manager is authorized'I to accept said grants and execute the necessary documents(s) in a form 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Page 3 of 5 62- 963 acceptable to the City Attorney, for acceptance of said grants. Section 4. The City Manager is directed to complete each of the Projects in accordance with the terms of said Grant Agreement(s), the Ordinance, and the administrative rules authorized by the Citizen's Oversiaht Committee (tht= "Committee") to implement the Ordinance. Section 5. The City Manager is further directed to provide (1) supplemental funds required to complete the Projects if the costs of said Projects exceed the grant allocations, and (2) funds to operate, maintain and provide programming at each project upon its completion. The requirement for the City of Miami to provide any supplemental funds may, at the sole discretion of the Committee, be modified in whole or in part by a reduction in scope of work consistent with the Ordinance. Section 6. The City of Miami recognizes and directs that any beach, park, or other public facility acquired, developed, rehabilitated or restored with bond funds, including the Projects, shall be open and accessible to the public without discrimination as to race, color, gender, age, religion, belief, residence, natural origin, marital status or disability. To the extent allowed by law, City of Miami shall commit any and all funds, which may be required to operate, maintain and provide programming at each park project upon its completion. Section 8. All grants received shall be used solely for the projects for which they have been designated. Section 9. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission Page 5 of 5 oo- 963 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM CA -19 TO: Honorable Mayor and Members DATE: tiUv FILE of the 'ty Commission SUBJECT: Resolution Accepting Safe Neighborhood Parks Bond Program 2002 rlos A. imenez Series and Interest FROM: City Manager REFERENCES: Earnings Grant Projects ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution, authorizing the City Manager to accept grants in the total amount of $720,997 from Miami -Dade County Safe Neighborhood Park Bond Program (SNPB), Interest Earnings, and Bond Series 2002 (Year 5) funding. The Resolution further authorizes the City Manager to execute the necessary document(s), in a form acceptable to the•City Attorney, to implement said grants. In addition, pursuant to the provisions of the Safe Neighborhood Parks Ordinance, the Resolution authorizes the payment of: (1) supplemental funds required to complete said projects if the costs of said projects exceed the grant allocation; (2) funds to operate, maintain and provide programming at each project upon its completion. BACKGROUND: The Safe Neighborhood Parks Bond Program includes specified and per capita allocations for all municipalities that are recipients of these funds. Each time the County sells bonds, the City of Miami has the opportunity to draw down from its specified and per capita allocations to fund park projects. Specified allocations refer to already approved fundings amounts for specific parks as stipulated by ordinance. Per Capita dollars are not assigned to specific parks by ordinance. Of the original $21,675,000 approved for the City of Miami from the $200 million Countywide Safe Neighborhood Parks Bond Program, $18 million was for specified projects and $3,675,000 was for per capita projects. In the Bond Series sold in 2002 (Bond Series 2002), the City received a total of $151,780 for four (4) projects from its specified allocation and $100,000 for one (1) project from its per capita allocation. In addition, the Safe Neighborhood Parks Bond Office solicited during 2002, applications for land acquisition interest earning projects .from available interests accumulated by previous bond proceeds. The City of Miami obtained a total of $350,000 to fund two (2) land acquisition projects from Countywide Interest Earnings. Also, this same year, the City was able to obtain funding from interest drawn from its own allocations known as Municipal Interest Earnings. This provided the City with a total of $119,217 to fund three (3) projects and to pay the costs for a construction management employee to supervise and inspect SNPB projects. 026" 963 The following is a listing of the $720,997 in grant funds being accepted by the adoption of this proposed Resolution. In addition, the Resolution authorizes the City Manager to execute the necessary agreements in order to implement the projects funded with these funds.
