HomeMy WebLinkAboutR-02-0918J-02-805 8/22/02 RESOLUTION NO. 02- 918 A RESOLUTION OF THE MIAMI CITY COMMISSION STRONGLY URGING THE UNITED STATES CONGRESS, THE FEDERAL COMMUNICATION COMMISSION AND THE UNITED STATES CONFERENCE OF MAYORS TO REVIEW AND ADOPT RULES AND REGULATIONS TO PROMOTE DIVERSITY AND ENSURE NON -DISCRIMINATING TREATMENT RELATING TO EXCESSIVE COSTS FOR LOCAL MINORITY LEASED ACCESS PROGRAMMING; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF' THIS RESOLUTION TO THE OFFICIALS DESIGNATED HEREIN. WHEREAS, the City Commission recognizes that the City of Miami is comprised of citizens of very diverse ethnic, cultural and language backgrounds; and WHEREAS, the United States Congress adopted provisions contained in 47 U.S.C. 532 mandating cable operators to provide leased access channels on cable systems to promote competition in the delivery; and WHEREAS, the Federal Communications Commission has determined the maximum reasonable rates that cable operators may establish for leased access channels on their cable systems; and CITY C1010418SSI MEEMW 2 2002 Resolution No. 02- 918 WHEREAS, the City seeks to promote the widest possible diversity of information available to the residents of the City; and WHEREAS, it is the belief of the City Commission that the rates charged local leased access providers of the cable operator are unreasonable and differ among providers which results in limiting the availability of diverse local minority programming in the City and allows for potential discrimination against individual speakers or specific points of view; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The United States Congress, the Federal Communication Commission and the United States Conference of Mayors are strongly urged to review and adopt rules and regulations to promote diversity and ensure non -discriminating treatment relating to excessive costs for local minority leased access programming. Section 3. The City Clerk is directed to transmit a copy of this Resolution to President George W. Bush, Vice -President Richard B. Cheney, Speaker the House J. Dennis Hastert, Senators Bill Nelson and Bob Graham, all the Page 2 of 3 02- 918 members of the United States House of Representatives for Miami - Dade County, the Federal Communication Commission and the United States Conference of Mayors. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.! PASSED AND ADOPTED this 22nd day of Auqust 2002. 14 M/1UEL A. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. Page 3 of 3 02— 918
