RESOLUTION NO . 02— 908
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), APPROVING THE GRANT OF A
PERPETUAL, NON-EXCLUSIVE TWELVE(12) FOOT
STRIP EASEMENT, AS MORE PARTICULARLY
DESCRIBED IN "EXHIBIT A" ATTACHED AND
INCORPORATED, AT DAVID KENNEDY PARK, LOCATED
AT 2476 SOUTH BAYSHORE DRIVE, FOR THE
CONSTRUCTION, OPERATION AND MAINTENANCE OF
UNDERGROUND ELECTRIC UTILITY FACILITIES,
INCLUDING THE RIGHT TO RECONSTRUCT, IMPROVE,
CHANGE THE VOLTAGE, AND REMOVE SUCH
FACILITIES FROM THE EASEMENT; FURTHER,
AUTHORIZING THE CITY MANAGER TO EXECUTE A
GRANT OF EASEMENT, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR SAID PURPOSE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The grant of a perpetual, non-exclusive
twelve (12) foot strip easement, as more particularly described
in "Exhibit A" attached and incorporated, at David Kennedy Park,
located at 2476 South Bayshore Drive, for the construction,
operation and maintenance of underground electric utility
facilities, including the right to reconstruct, improve, change
the voltage, and remove such facilities from the easement, is
approved.

Section 2. The City Manager is authorized'I to execute a
Grant of Easement, in a form acceptable to the City Attorney, to
Florida Power & Light Company, for said purpose.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor .2/

1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
2/ If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

FPL Easment
A 12 foot strip easement being a portion of Lots 6 through 15, inclusive,
Block 43, NEW BISCAYNE AMENDED, according to the Plat thereof as
recorded in Plat Book "B" at Page 16 of the Public Records of Miami -Dade
County, Florida. Said strip easement lying six feet on each side of the
following described centerline : Commence at the most Northerly corner
of said Lot 14 lying along South Bayshore Drive, thence run S 47° 18'18"
E along the Northeasterly lot line of said Lot 14 for a distance of 388.80
feet to a point; thence run S 42°41'42" W for a distance of 118.51 feet to
the Point of Beginning of the Centerline of the following strip easement
herein described; thence run N 47°15'14" W for a distance of 12.00 feet
to a point; thence run N 05° 16'50" W for a distance of 77.04 feet to a
point; thence N 07°47'53" W for a distance of 48.65 feet to a point;
thence run N 10°23'59" E for a distance of 73.60 feet to a point; thence
run N 22°3349" E for a distance of 332.87 feet to a point; thence run N
47° 19'00" E for a distance of 12.07 feet to the Point of Termination of
said Centerline and said strip -easement.
