BY A FOURTH -FIFTHS (4/5TIS ) AFFIRMATIVE VOTE,
AFTER A DULY ADVERTISED PUBLIC HEARING,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES, AND ACCEPTING THE BID OF
HARD J. CONSTRUCTION CORPORATION, THE LOWEST
RESPONSIVE AND RESPONSIBLE BIDDER, PURSUANT
TO INVITATION FOR INFORMAL BIDS, DATED
JUNE 7, 2002, FOR THE PROJECT ENTITLED
"CITYWIDE LOCAL DRAINAGE PROJECT E-77,
B-5648", IN THE AMOUNT OF $673,250;
ALLOCATING FUNDS FROM PROJECT NO. 352216, AS
APPROPRIATED BY THE ANNUAL APPROPRIATIONS
AND CAPITAL IMPROVEMENTS ORDINANCES, AS
AMENDED, IN THE AMOUNT OF $673,250 FOR THE
CONTRACT COSTS AND $88,750 FOR EXPENSES, FOR
A TOTAL ESTIMATED COST OF $762,000;
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR SAID PURPOSE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA
Section 1. By a four -fifth (4/Stns) affirmative vote of
the City Commission, after a duly advertised public hearing, the
City Manager's finding of an emergency is ratified, approved and
confirmed, the requirements for competitive sealed bidding

procedures are waived and the bid of Hard J. Construction
Corporation, the lowest responsive and responsible bidder, dated
June 7, 2002, for the project entitled "Citywide Local Drainage
Project E-77, B-5648", in the amount of $673,250, for the total
bid of the proposal, is accepted at the price stated herein.
Section 2. The total estimated project costs of
$762,000 are allocated from Project No. 352216, as appropriated
by the Annual Appropriations and Capital Improvements
Ordinances, as amended. The total project costs consist of
$673,250 for contract costs and $88,750 for estimated expenses
incurred by the City.
Section 3. The City Manager is authorizedll to execute
an agreement, in a form acceptable to the City Attorney, with
Hard J. Construction Corporation for the project.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.21
1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.
If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached Resolution ratifying
the City Manager's written finding that a valid emergency exists regarding stormwater flooding
at different sites throughout the City, and waiving formal competitive bidding procedures and
authorizing the City Manager to accept the bid of Hard J. Construction Corporation, a non -local
Black minority firm located at 99 N.W. 183 Street, Suite 108, Miami, Florida, as the lowest
responsive and responsible bid in the amount of $673,250 Total Bid. The total cost of for this
project is $762,000, consisting of $673,250 Total Bid and $88,750 for the City's portion.
JUSTIFICATION
As a result of several severe rainstorms, the City has experienced stormwater flooding at
different localized sites. The magnitude of the work exceeds the construction capability of the
Public Works Operations Division and the services of a private contractor are needed. The
construction work must begin immediately to address the current rainy. season. In order to
initiate this drainage construction as soon as possible, formal competitive sealed bid procedures
shall be waived for the procurement of contracting services required for said EMERGENCY
pursuant to Sections 18-83 and 18-84 of the City Code. Informal bids were obtained and a
contract will be awarded to the lowest responsive and qualified bidder. All costs of this project
will be funded from CIP Project No. 352216.

Based on my investigation of numerous stormwater flooding complaints throughout the
City, I have found that an EMERGENCY exists which justifies the selection of a
contractor by informal bids.
As a result of severe rainstorms, the City has experienced stormwater flooding at
different localized sites. The magnitude of the work exceeds the construction capability
of the Public Works Operations Division and the services of a private contractor are
needed. The construction work must begin immediately at the locations listed in the
Attachment to address the current rainy season.
Because of the severe flooding at these locations, there is a need for extraordinary
measures to expedite the installation of adequate stormwater drainage systems. In order
to initiate the construction of the new stormwater drainage systems as soon as possible,
formal competitive sealed bid procedures shall be waived for the procurement of
contracting services required for said EMERGENCY pursuant to sections 18-83 and 18-
84 of the City Code. Informal bids shall be obtained and a contract shall be awarded to
the lowest responsive and qualified bidder. All costs of this project will be funded from
the CiP No. 352216. Estimated total cost for the project is $500,000.00. This action shall
be ratified at the next available City Commission meeting.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of Miami, Florida, on July 25
2002, at 2 a.m., in the City Commission Chambers at City Hall, 3500 Pan American
Drive, Miami, Florida, for the purpose of hearing objections from any interested parties to
the waiving of formal competitive sealed bid procedures for the project entitled
CITYWIDE LOCAL DRAINAGE PROJECT E-77, B-5648.
All interested persons are invited to appear and may be heard concerning the proposed
sidewalk and curb improvements. Should any person desire to appeal any decision of
the City Commission with respect to any matter considered at this hearing, that person
