A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE THAT PORTION OF A PUBLIC RIGHT-OF-WAY, BEING THE PORTION OF SOUTHWEST 14TH STREET BETWEEN SOUTHWEST 2ND AVENUE AND THE METRORAIL RIGHT-OF-WAY, MIAMI, FLORIDA, AS LEGALLY DESCRIBED IN ATTACHED "EXHIBIT A," PER PLANS ON FILE, AND SUBJECT TO THE PROVISIONS CONTAINED IN A COVENANT, TO BE APPROVED IN A FORM ACCEPTABLE TO THE CITY ATTORNEY. WHEREAS, the Miami Zoning Board at its meeting of June 17, 2002, Item No. 3, duly adopted Resolution No. ZB 2002-0586 by a seven to one (7-1) vote, RECOMMENDING DENIAL of closing, vacating, abandoning, and discontinuing a portion of a public right-of-way as set forth herein; and WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the subject vacation and closure and determined that it will adversely affect pedestrian or vehicular traffic circulation or access for public service; and TT A CN �,M" T C 0, 1`7 A N-1 i a -CIS J U IL 2 5 2002 iu�n AIo. 02886 WHEREAS, the Plat and Street Committee has reviewed the subject tentative plat and determined that all technical requirements and other matters coming before them have been met; and WHEREAS, notwithstanding the recommendations of the Zoning Board and Plat and Street Committee, the City Commission finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants to grant .the vacation and closure of a portion of the public right-of-way; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section I. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A portion of a public right-of-way, located at Southwest 14th Street between Southwest 2nd Avenue and the Metrorail Right -of -Way, Miami, Florida, as legally described in attached "Exhibit A," is closed, vacated, abandoned and discontinued for public use, per plans on file, and subject to the provisions contained in a Covenant,'/ to be approved in a form acceptable to the City Attorney. 1� The herein approval is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Vote: 7-1 City Commission: N/A. 02- 886 I PLANNING AND ZONING DEPARTMENT ANALYSIS Case No. 2002-0539 VACATION AND CLOSURE OF A PORTION OF SW 14TH STREET BETWEEN SW 2ND AVENUE AND THE METRORAIL RIGHT-OF-WAY Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department has reviewed the proposed street vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right- of-way. The following findings have been made: • It is found that the general public currently utilizes SW 14th Street for convenient public access to the adjacent commercial businesses and parking areas adjacent to Coral Way. • It is found that the Solid Waste Department and emergency vehicles utilize this street and that closing the street would limit emergency and public access to adjacent properties. • It is found that the vacation of the street could have unanticipated long term consequences and could ultimately facilitate the development of a building that is inconsistent with the height, bulk, scale and character of existing buildings south of SW 15th Road. • It is found that the property owner has failed to demonstrate any public benefits that would be provided as a result of the proposed street vacation. The zoning district boundary lines must be corrected in the location sketch and zoning notes. 9. in surveyor's note #7, change the word "express" to "expressed"; also delete any reference to SW 2 Avenue. 10. Surveyor's note #9 must be deleted. 11. The Plat and Street Committee, in reviewing the request to close and vacate SW 14 Street between SW 2 Avenue and the Metrorail right-of-way, has considered the public interest requirements found in Chapter 55 of the City Code. The Committee finds that SW 14 Street provides convenient public access to the adjacent properties and parking lots. The closure of this roadway and enlargement of the building site would allow taller structures with increased square footage, thereby impacting the adjacent residential neighborhood south of SW 15 Road. The general public currently utilizes this road for convenient access to the commercial business and parking areas adjacent to Coral Way. The Solid Waste Department and emergency vehicles utilize this roadway and closing the road would limit public access to commercial properties. Based on these findings, the Plat and Street Committee recommends denial of the vacation and closure of SW 14 Street between SW 2 Avenue and the Metrorai) right-of- way. 12. SW 13 Street (Coral Way) is a State Road. A plat approval letter from the Florida Department of Transportation is required. In addition to the above requirements, you should be aware of the following: 1. State and local laws require the installation of various physical improvements in the public rights-of-way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc. caused by this plat will be at the property owners expense. Also, utility easements may be required on the property being platted. 3. A building permit will not be issued on the property being platted until the final plat Is recorded. Also, the Certificate of occupancy for any building construction will be issued only after all the required subdivision improvements have been completed. ("Coral Station"), the owner of the property upon which the Temporary Lot is located, began working to relocate the Temporary Lot in order to make way for a future development and, at the same time, continue to provide much needed parking to area residents. Proposed Lot The Proposed Lot will provide much needed parking to Publix customers in a newly constructed, well lit and properly landscaped area. (See Site Plan enclosed). In total, the Proposed Lot will provide one hundred and sixteen (116) parking spaces for use by the general public. Without the vacation and closure of the Street, the Proposed Lot will only provide eighty-three (83) parking spaces. As part of the development plan, BVT will also be providing a pedestrian walkway from Publix to the Proposed Lot (the "Walkway"). In addition to proper lighting and landscaping, the Walkway will be covered and will provide direct access from Publix's front entrance directly to the Proposed Lot. In fact, the walking distance from Publix to the Propsed Lot will be shorter than the walking distance from Publix to the Temporary Lot. All required access approvals from Florida Power and Light and an additional property owner have already been obtained. History of Approvals Two (2) years ago, after meeting with City Planning and Zoning officials, BVT submitted the required applications to obtain a Master Plan Amendment and a Zoning Atlas Amendment to rezone the BVT Property from Office to C-1. The purpose of the rezoning was to allow parking for commercial establishments in a C-1 zone. On January 22, 2001, after a presentation to the City of Miami Zoning Board, where BVT reviewed the Site Plan, which included the area of land encompassed by the Street, the Zoning Board approved BVT's application for a Zoning Atlas Amendment. Subsequently, after a similar presentation on February 22, 2001, the City of Miami Commission approved the Comprehensive Plan Amendment and Zoning Atlas Amendment and then again on March 29, 2001 at second hearing. After obtaining these approvals, BVT, began the process of replatting the property in order to develop the Proposed Lot. BVT attended numerous meetings with City Public Works and Zoning Staff in order to resolve several issues that would result from the vacation of the Street. The most prominent was the creation of a tract of land that was divided by a zoning line. In the end, at the instruction of City staff, the T -Plat was modified to create two separate tracts upon the vacation of the Street. Consequently, on February 7, 2002, the T -Plat was approved. 02-- 886 Teresita Fernandez May 7, 2002 Page 3 Public Purpose Pursuant to § 55-15 (c), the vacation and closure of the Street is in the public's interest for several reasons. (1) The construction of the Proposed Lot will allow BVT to provide thirty-three (33) additional parking spaces to the patrons of Publix and the other nearby commercial establishments; (2) The vacation of the Street and the construction of the Proposed Lot will increase safety by relocating traffic to S.W. 15`h Road instead of the intersection of S.W. 2nd Avenue and the Street. The current intersection is dangerous and does not provide proper traffic flow. (3) The Proposed Lot will improve pedestrian safety by providing a properly lit and constructed parking lot and sidewalks. The increased safety will serve to allow more area residents to walk to Publix at all times of the day and night rather than having to drive their cars. (4) The Proposed Lot will not have an adverse impact on the ability to provide police, fire or emergency services to the area or the commercial properties that the lot would be servicing.
