RESOLUTION NO. 02— 871
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENTS, ACCEPTING THE PLAT
ENTITLED FORTUNE OF THE CHI, A SUBDIVISION
IN THE CITY OF MIAMI, SUBJECT TO ALL OF THE
CONDITIONS OF THE PLAT AND STREET COMMITTEE,
AND ACCEPTING THE DEDICATIONS SHOWN ON SAID
PLAT; AUTHORIZING AND DIRECTING THE CITY
MANAGER AND CITY CLERK TO EXECUTE SAID PLAT;
AND PROVIDING FOR THE RECORDATION OF SAID
PLAT IN THE PUBLIC RECORDS OF MIAMI-DADE
COUNTY, FLORIDA.
WHEREAS, the Department of Public Works recommends the
acceptance of the plat entitled FORTUNE OF THE CHI;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The plat entitled FORTUNE OF THE CHI is a
replat of the property described in Attachment 1, which plat by
reference is made a part hereof as if fully incorporated herein,
and subject to all of the conditions required by the Plat and
Street Committee as set forth as "Exhibit A" attached hereto, is
accepted. The dedications shown on the plat together with the
dedications to the perpetual use of the public of all existing

and future planting, trees and shrubbery on said property, are
also accepted and confirmed by the City of Miami, Florida.
Section 2. The City Manager and City Clerk are
authorized and directed to execute the plat and cause the same
to be recorded in the Public Records of Miami -Dade County,
Florida.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor 1/.

1� If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

TENTATIVE PLAT #1595-A

The City of Miami Plat and Street Committee, at its meeting of December 6, 2001,
approved the above tentative plat subject to the following revisions being made
to the tentative plat, additional information being provided and/or variances
being granted. Please be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied.
1. In the location sketch, show the alley to be closed and vacated as being part of
the plat. Shade -in the alley.
2. Provide bearings and distances along the centerline of the adjacent streets.
3. Provide lot and block numbers for the adjacent subdivision to the Northeast in
the main sketch.
4. Show a proposed 25 -foot corner radius, with curve data, at each of the
Northeast and Southeast corners of the proposed plat. if the buildings are to
remain at both corners, a request for waiver of the two 25 -foot corner radii
must be forwarded to the Supervisor of Plats.
5. A plat approval letter from the Florida Department of Transportation is
required prior to the final plat.
6. An opinion of title as to reversionary rights for the alley to be closed and
vacated will be required by the Zoning Board. The opinion of title must also
address whether or not there are any individuals, in addition to the abutting
Property owners, having an interest in the rights-of-way to be closed and
vacated. A copy of the opinion must be provided to the Public Works
Department.
A sketch and legal description, with square footage for the proposed alley
closure, will be required by the Zoning Board. Contact Ms. Teresita Fernandez,
Chief of the Hearing Boards, at 305-416-2030. Provide a copy to the Department
of Public Works on 81/2"x 11" paper.
7. The utilities in the alley to be closed and vacated must be relocated or
easements must be provided.

8. Delete Special Exception #s 1, 3, 4 and 8 from the opinion of title.
9. Be advised that the opinion of title must cover the period from the beginning.
10. In the opinion of title, show the proposed plat name in capital letters.
11. Provide a Corporate Resolution identifying the corporate officers' names and
titles having the authority to execute documents for Fortune of the Chi, Inc.
12. Provide centerline and monument line bearings and distances to the end of
the block.
13. The Plat and Street Committee in reviewing the request to close and vacate the
alley located West of NW 27 Avenue between NW 6 Street and NW 7 Street
recommends denial of the vacation and closure request based on the
following findings:
a. The alley provides access for essential services to the existing commercial
buildings from the rear and provides a buffer between commercial and
residential property.
b. The general public is currently using the alley, including service vehicles and
emergency vehicles.
c. Closing of this alley would adversely affect access for emergency vehicles.
d. Closing of the alley would require service vehicles to load on adjacent
roadways adversely affecting traffic flow on the public streets.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in
the public rights-of-way when property is platted. These subdivision
improvements include paving, drainage, landscaping, sidewalks, etc. In some
cases this could represent a substantial investment on your part.
2. The alteration, relocation or installation of utilities such as storm and sanitary
sewers, electric, telephone, water, etc. caused by this plat will be at the
property owner's expense. Also, utility easements may be required on the
property being platted.
3. A building permit will not be issued on the property being platted until the
final plat is recorded. Also, the Certificate of Occupancy for any building
construction will be issued only after all the required subdivision
improvements have been completed.

4. Approval for fire flow requirements must be obtained from the Fire -Rescue
Department prior to the issuance of a building permit.
5. Additional items must be provided to the City of Miami Department of Public
Works before the final plat is submitted to the City Commission for approval.
You will be notified in writing as to what these items are after the amount of
the bond has been determined for the necessary subdivision improvements.
6. Tentative plat approval is only valid for one (1) year from the date of the Plat
and Street Committee meeting at which time it was approved.
If you have any questions concerning these requirements, please refer to the
attached sheet for the appropriate person to contact.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt a resolution accepting
the plat FORTUNE OF THE CHI and approving recording the same in the Public
Records of Miami -Dade County, Florida.
BACKGROUND:
The Department of Public Works has reviewed this plat, and it has determined that it is
now in order for acceptance by the City Commission. The specific intent of this Plat is
to create two (2) tracts of land for the construction of an Eckerd Drug Store with
parking in the front and at the rear of the store.
The proposed record plat entitled FORTUNE OF THE CHI is a replat of the property
described in the attached Legal Description. The area platted consists of two (2) tracts
containing approximately 69,522 square feet (1.60± acres). It is zoned C-1.
Also attached are the following documents necessary for the City Commission to
consider in making their decision:
1. Resolution accepting the Plat
2. Engineering Report
3. Plat and Street Letter
4. Print of Proposed Record Plat
