J -02-336(a) 05/31/02 RESOLUTION NO. 02— 816 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING AN "EMPLOYMENT OFFICE" USE AS SPECIFIED IN ORDINANCE NO. 11000, AS AMENDED (THE "ZONING ORDINANCE"), WITHIN A C-2 LIBERAL COMMERCIAL ZONING DISTRICT, PURSUANT TO ARTICLE 4, SECTION 401, OF THE ZONING ORDINANCE, SCHEDULE OF DISTRICT REGULATIONS, FOR THE PROPERTY LOCATED AT APPROXIMATELY 1330 NORTHEAST 1ST COURT, MIAMI, FLORIDA, LEGALLY DESCRIBED IN ATTACHED "EXHIBIT A," SUBJECT TO CONDITIONS. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission approves an "Employment Office" use for the property located at approximately 1330 Northeast 1St Court, Miami, Florida (the "Property"), more particularly described in attached "Exhibit A," subject to conditions recommended by the department of Planning and Zoning shown on the Planning Fact Sheet attached as Exhibit "B" and subject further to the conditions proffered by the property owner in its March 6, 2002, letter attached as Exhibit "C". Classroom training using a State of Florida Curriculum designed to impart job skills and work readiness. (From 2 weeks to 4 months depending upon the program). 4. Referral to a cooperating employer for a paid, planned and supervised work site, Customized Training Program. (Each employer agrees to participate in a work site training program for each referral accepted). 5. Weekly monitoring at the work site by PAVE staff to assist with training, job retention, support services when appropriate, removal of barriers, etc. The work site monitoring continues for 3 months after referral. For the record my partners and I wish for it to be stated that we do not believe that this kind of business is setting the right tone for the neighborhood. With the construction of the new PERFORMING ARTS CENTER literally across the road, and my partners and my attempt to lure the WHITNEY MUSEUM OF ART to take up residency on the corner directly adjacent, we feel that setting the tone now is imperative for us to begin creating a new infrastructure. A major problem for us is not so much PAVE and its program but more the repercussions from its location and perception. At this time there is am policing of the area and therefore if any problems were to arise there is nobody to step in and solve them. I understand that the lease is only for another two and a half years and that the lease will not be renewed. These next two and a half years however are when my partners and I and many of the dther local developers plan to open new businesses. The big picture of course is an obvious one. We create a neighborhood known the world over for its commitment to the Arts. The Performing Arts Center, the Whitney, the Miami light Project, relocated New York Galleries, Film and Production facilities, music venues, restaurants, bars, cafes and whatever else it takes. This doesn't even take into account the existing Ice Palace and Eugene's future plans. A dressed -up labor pool doesn't seem to fit into this picture. A quarterly review of PAVE and its program by the areas neighbors. if there have been overt problems with the facility and it's immediate surroundings action would have to be taken which would result in the discontinuation of certificate of occupancy. 2. 24 hr security (except for non work days) _ 3. Removal from program of any student found to be engaged in the drinking of alcohol or taking of illegal drugs. (as per existing student agreement) 4. Maintenance of property to include exterior lighting, fencing and general appearance. 5. Entrance to the facility to be in the rear where the security will be stationed 6. Certificate of Occupancy to run for only the initial term of the lease (maximum 3 years). Mr. Traeger to agree that no similar organization will receive a lease following PAVE's term. 7. No Sublets allowed What we are really asking for in a way is a conditional certificate of use based on the above terms. How can these terms be enforced otherwise? A big picture can only be realized by taking can of all the small things first. We understand Rome wasn't built in a day but according to the schedule it will be built in two and a half years.
