A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), AUTHORIZING THE CITY
MANAGER TO ENTER INTO AN AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH FLORIDA
POWER AND LIGHT ("FPL") FOR THE PURPOSE OF
GRANTING TO FPL AN EASEMENT, AS DESCRIBED IN
"EXHIBITS lA and 1B," ATTACHED AND
INCORPORATED, FOR THE PLACEMENT OF TRANSFORMER
PAD AND ELECTRICAL LINE SERVICES TO MARGARET
PACE PARK, LOCATED AT 1745 NORTH BAYSHORE
DRIVE, MIAMI, FLORIDA; FURTHER DIRECTING THE
CITY ATTORNEY TO PREPARE AND FINALIZE SAID
AGREEMENT PRIOR TO JULY 7, 2002.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager is authorized!' to enter into
an agreement, in a form acceptable to the City Attorney, with
Florida Power And Light ("FPL") for the purpose of granting to FPL
an easement, as described in "Exhibits lA and 1B," attached and
incorporated, for the placement of transformer pad and electrical
line services to Margaret Pace Park, located at 1745 North Bayshore
Drive, Miami, Florida.
1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.

Section 2. The City Attorney is directed to prepare and
finalize said agreement prior to July 7, 2002.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor./

effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City
Commission.

Subject: Margaret Pace Park / FPL Easement
RECOMMENDATION
I am respectfully recommending that in order to expedite the Margaret Pace Park project, it is
imperative that the City of Miami grant an easement to Florida Power and Light to install
electrical service to Margaret Pace Park using a portion of the park, located at 1745 North
Bayshore Drive, Miami, Florida (the "Property"); Further requesting the City Manager to enter
into an agreement to grant Florida Power and Light an easement, as shown in attachment
exhibits la and lb, for air and land rights and also permit Florida Power and Light to place a
transformer pad and provide electrical line service to Margaret Pace Park.
BACKGROUND
Florida Power and Light has not been permitted, nor has had accessibility, to provide the above
styled service to Margaret Pace Park. Therefore, the easement requested above must be granted
so that Florida Power and Light can meet their deadline for the completion of the Margaret Pace
Park project.
