V A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, REVERSING THE DECISION OF THE ZONING BOARD THEREBY GRANTING A SPECIAL EXCEPTION FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO ALLOW A SUPPER CLUB, FOR THE PROPERTIES LOCATED AT APPROXTMATFLY 3632-3634 NORTHWEST 25TH AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN ATTACHED "EXHIBIT A," PURSUANT TO PLANS ON FILE, AND SUBJECT TO A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED. WHEREAS, the Miami Zoning Board at its meeting of April 22, 2002, Item No. 9, adopted Resolution No. ZB 2002-0567 by a vote of six to three (6-3), denying a Special Exception, and WHEREAS, the applicant has appealed the decision of the Zoning Board; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the recommendation of the Zoning Board, finds that the stated grounds for the appeal and the facts presented in support thereof do justify reversing the ATTAC€NT (312 f OTAI CITY Coitif a$= MEE-Ta J U N 2 7 2002 kesolwion No. 0 2 -- 7'' �I decision of the Zoning Board and granting the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission grants the appeal and reverses the decision of the Zoning Board, thereby granting a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, to allow a supper club for the properties located at approximately 3632-3634 Northwest 25th Avenue, Miami, Florida, as legally described in attached "Exhibit A." The following findings have been made: • It is found that the structure in which the new use is proposed consists of an existing one story commercial building along NW 250, Street between NW 36th and 37th Streets near the north edge of the city limits. • It is found that the subject property consists of an existing legal non -conforming structure with fifty-two (52) parking spaces on site and it is also found that the proposed use is an appropriate adaptive reuse for the mixed-use one story structure. • It is found that (with the exception of the requested parking variance) the subject proposal has been reviewed and found in compliance with the criteria as set forth in section 1305 of Zoning Ordinance 11000. • It is found that upon compliance with conditions set forth below, this project will not have any adverse impacts on the surrounding area. Based on these findings, the Planning and Zoning Department is recommending approval of the application with the following condition: 1.
