A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CONTINUED ENGAGEMENT OF THE
LAW FIRM OF HOGAN & HARTSON, L.L.P. FOR LEGAL
SERVICES PROVIDED TO THE CITY OF MIAMI IN
CONNECTION WITH ILLEGALLY PLACED BILLBOARDS
AND THE CASE OF NATIONAL ADVERTISING CO. VS.
CITY OF MIAMI, IN THE UNITED STATES DISTRICT
COURT, CASE NO. 01-3039 CIV -KING, IN AN AMOUNT
NOT TO EXCEED $100,000, PLUS COSTS AS APPROVED
BY THE CITY ATTORNEY; ALLOCATING FUNDS FROM
THE SELF-INSURANCE AND INSURANCE TRUST FUND,
ACCOUNT CODE NO. 515001.624401.6.661, FOR SAID
SERVICES.
WHEREAS, pursuant to Resolution No. 01-730, adopted July 19,
2001, the City Attorney was authorized to engage counsel to
render legal services concerning illegally placed billboards in
the City of Miami, related litigation, and remedial actions, if
necessary, in an amount not to exceed $25,000; and
WHEREAS, in September, 2001, the City Attorney engaged
Hogan & Hartson, L.L.P. to represent the City in connection with
the case of National Advertising Co. vs. City of Miami, in the

United States District Court, Case No. 01-3039 Civ -King, and
other related issues concerning illegally located billboards in
the City of Miami; and
WHEREAS, pursuant to Resolution No. 02-67, adopted
January 24, 2002, the continued engagement of Hogan & Hartson was
authorized, in an amount not to exceed $100,000; and
WHEREAS, legal research and litigation is ongoing for this
issue, and more particularly this Case, and additional funding is
necessary for continued representation by Hogan &
Hartson, L.L.P.;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The continued engagement of the law firm of
Hogan & Hartson, L.L.P. for legal services provided to the City
of Miami in connection with illegally placed billboards and the
case of National Advertising Co. vs. City of Miami, in the United
States District Court, Case No. 01-3039 Civ -King, in an amount
not to exceed $100,000, plus costs as approved by the City
Attorney, is authorized, with funds allocated from the
Self -Insurance and Insurance Trust Fund, Account Code
No. 515001.624401.6.661, for said services.

Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

1� If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

Continued engagement of the law firm of Hogan & Hartson, L.L.P. for legal
services provided to the City of Miami in connection with illegally placed
billboards and the case of National Advertising Co. vs. City of Miami, in the
United States District Court, Case No. 01-3039 Civ -King (J-02-603)
The attached proposed Resolution seeks authorization for the continued engagement of
the law firm of Hogan & Hartson, L.L.P., for legal services provided to the City of Miami in
connection with illegally placed billboards and the case of National Advertising Co. vs. City of
Miami, in the United States District Court, Case No. 01-3039 Civ -King, in the amount of
$100,000 plus costs as approved by the City Attorney.
The case is currently pending in the United States Court of Appeals for the 11"' Circuit,
regarding an injunction issue. Consequently, the trial court has not yet addressed the principle
challenges to the City's sign ordinance raised by National Advertising.
To date, costs allocated for this litigation and other billboard matters totals $125,000.
Resolution No. 01-730, adopted July 19, 2001, authorized the allocation of $25,000, and
Resolution No. 02-67, adopted January 24, 2002, authorized $100,000. Approval of this
Resolution will bring the total amount allocated to $225,000.
Funds for these legal services will be allocated from the City of Miami Self -Insurance and
Insurance Trust Fund, Index Code No. 515001.624401.6.661.
