HomeMy WebLinkAboutR-02-0734J-02-593 6/19/02 RESOLUTION NO. 02- 734 A RESOLUTION OF THE MIAMI CITY COMMISSION AMENDING RESOLUTION NO. 01-1297 TO INCREASE COMPENSATION TO SPECIAL COUNSEL FOR THE CIVIL SERVICE BOARD BY $9,000, FROM $30,000 TO $39,000 ANNUALLY; ALLOCATING FUNDS FROM FISCAL YEAR 2001-2002 BUDGETED FUNDS OF THE CIVIL SERVICE OFFICE, ACCOUNT NO. 240101-250, FOR SAID INCREASE. WHEREAS, pursuant to Resolution No. 01-1297, adopted December 13, 2001, the City Commission allocated $30,000 for payment of compensation to Special Counsel for the Civil Service Board; and WHEREAS, the expertise and the scope of legal services provided by the Special Counsel for the Civil Service Board warrants an increase in the annual compensation; and WHEREAS, the increased compensation will be pro -rated effective June 1, 2002; _.. 734 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution No. 01-1297, adopted December 13, 2001, is amended in the following particulars:!:/ "Resolution No. 01-1297 Section 1. The allocation of funds, in an amount not to exceed $39,GGO $39,000, from Fiscal Year 2001-2002 Budgeted Funds of the Civil Service Office, Account No. 240101-250, is authorized for payment of compensation to special counsel for the Civil Service Board, including any required related litigation services.'/ 1� This compensation shall be payable as earned during the period of such counsel's employment. * * * if Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2/ 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. �� If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. If approved, payment of increased compensation, in the amount of $9,000 (from $30,000 to $39,000 annually), for Special Counsel to the Civil Service Board will be authorized. Funds for the compensation increase are available from Fiscal Year 2001-2002 budgeted funds of the Civil Service Office, Account No. 240101-011. The compensation is payable as earned during the period of such counsel's employment, and the increased compensation will be pro -rated effective June 1, 2002. Alonso, Agenda Coordinator 02- 734 CITY OF MIAMI CITY ATTORNEY'S OFFICE MEMORANDUM TO: Mayor and Members of e FROM: Alejandro Vilarello ity DATE: June 17, 2002 RE: Proposed Increased Commission CA -16 Me 27NkO2 City Commission Meeting for Special Counsel to Civil Service Board (J-02-593) The attached proposed Resolution provides for a compensation increase, in the amount of $9,000 (from $30,000 to $39,000 annually) for Special Counsel to the Civil Service Board. Funds for the increase are available from the Fiscal Year 2001-2002 budgeted funds of the Civil Service Office, Account No. 240101-011. Special counsel as legal advisor to the Civil Service Board is required because the City Attorney prosecutes violators of actions in conflict with Civil Service Rules and Regulations, and therefore, cannot both represent and prosecute cases before the Civil Service Board. Due to the increase in the cases scheduled before the Civil Service Board, and the expertise and scope of legal services provided by the Special Counsel, an increase in the previously approved compensation of $30,000 annually is appropriate. The compensation is payable as earned during the period of such counsel's employment, and the increased compensation will be pro -rated effective June 1, 2002.
