RESOLUTION NO. 02— 733
A RESOLUTION OF THE MIAMI CITY COMMISSION
AMENDING RESOLUTION NO. 01-1298 TO INCREASE
COMPENSATION TO SPECIAL COUNSEL FOR THE CODE
ENFORCEMENT BOARD BY $9,000, FROM $30,000 TO
$39,000 ANNUALLY; ALLOCATING FUNDS FROM
FISCAL YEAR 2001-2002 BUDGETED FUNDS OF THE
OFFICE OF HEARING BOARDS, ACCOUNT CODE
NO. 001000.850102.6.250, FOR SAID INCREASE.
WHEREAS, pursuant to Resolution No. 01-1298, adopted
December 13, 2001, the City Commission allocated $30,000 for
payment of compensation to Special Counsel for the Code
Enforcement Board; and
WHEREAS, the expertise and the scope of legal services
provided by the Special Counsel for the Code Enforcement Board
warrants an increase in the annual compensation; and
WHEREAS, the increased compensation will be pro -rated
effective June 1, 2002;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 01-1298, adopted December 13,
2001, is amended in the following particulars:11
"Resolution No. 01-1298
Section 1. The allocation of funds, in an
amount not to exceed r'^� $39,000, from Fiscal Year
2001-2002 Budgeted Funds of the Office of Hearing
Boards, Account No. 001000.850102.6.250, is authorized
for payment of compensation to special counsel for the
Code Enforcement Board, including any required related
litigation services."

period of such counsel's employment.

Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.21

Increased Compensa ' n for Special Counsel to Code Enforcement Board

The attached proposed Resolution provides for a compensation increase, in the amount of
$9,000 (from $30,000 to $39,000 annually), for Special Counsel to the Code Enforcement
Board. Funds for the increase are available from Fiscal Year 2001-2002 budgeted funds of the
Office of Hearing Boards, Account No. 001000.850102.6.250.
Special counsel as legal advisor to the Code Enforcement Board is required because the
City Attorney cannot both represent and prosecute code violation cases- before the Code
Enforcement Board.
Due to the increase in the cases scheduled before the Civil Service Board, and the
expertise and scope of legal services provided by the Special Counsel, an increase in the
previously approved compensation of $30,000 annually is appropriate. The compensation is
payable as earned during the period of such counsel's employment, and the increased
compensation will be pro -rated effective June 1, 2002. Services provided by Special Counsel
includes any related litigation services required by the Code Enforcement Board.
