HomeMy WebLinkAboutR-02-0573J-02-488 5/15/02 RESOLUTION NO. 02— 57 3 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, APPROVING THE GRANT OF A NON-EXCLUSIVE EASEMENT TO APPROXIMATELY 14,641 SQUARE FEET OF LAND AND AIR RIGHTS ON THE CITY'S PROPERTY LOCATED AT 1802 NORTHWEST 37TH AVENUE, MIAMI, FLORIDA (a/k/a MELREESE GOLF COURSE), TO THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION (FDOT) FOR ITS USE AS A PART OF HIGHWAY IMPROVEMENTS FOR THE CONSTRUCTION OF THE MIAMI INTER -MODAL CENTER; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, SUBJECT TO OBTAINING A JOINDER TO THE EASEMENT FROM THE MELREESE GOLF COURSE OPERATOR AND FDOT PROVIDING CITY/OPERATOR REQUIRED ADDITIONAL IMPROVEMENTS TO SAFEGUARD THE OPERATION OF MELREESE GOLF COURSE. WHEREAS, the State of Florida, Department of Transportation has requested an easement on City property located at 1802 Northwest 37th Avenue, Miami, Florida (a/k/a Melreese Golf Course) that will be used in connection with the construction of the Miami Inter -modal Center, with full right of ingress and egress; and C CITY COMM gSION MEETImC bF MAY � 3 2002 s��Q V �3 WHEREAS, the easement is necessary in order to complete the design and construction of certain highway improvements, which are part of the development of the Miami Inter -modal Center, and shall provide relief to the general public and City of Miami residents in transportation including road improvements and landscaping of roads; WHEREAS, the City Commission desires to grant the aforesaid easement to FDOT and to authorize the City Manager to execute an Easement in substantially the attached form, subject to obtaining a joinder to the easement from the Melreese Golf Course operator and FDOT providing City/Operator required additional improvements to safeguard the operation of the golf course; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Page 2 of 4 0 0 _. 57 3 Section 2. The City Commission authorizes the conveyance of a non-exclusive easement to approximately 14,641 square feet of land and air rights on the City's property located at 1802 Northwest 37th Avenue, Miami, Florida (a/k/a Melreese Golf Course), to the State of Florida, Department of Transportation (FDOT) for its use as a part of highway improvements for the construction of the Miami Inter- modal Center, as more particularly described in attached Exhibit "A," subject to obtaining a joinder to the easement from the Melreese Golf Course Operator and FDOT providing City/Operator required additional improvements to safeguard the operation of the golf course. Section 3. The City Manager is authorized!/ to execute an Easement, in substantially the attached form, on a portion of Melreese Golf Course, as legally described in the Easement, subject to obtaining a joinder to the easement from the Melreese Golf Course Operator and FDOT providing City/Operator required additional improvements to safeguard the operation of the golf course. �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Code and Charter provisions. BACKGROUND: FDOT is in the process of designing and constructing the M.I.C. In order to complete this project, FDOT has requested the City of Miami to grant an Easement on a portion of Melreese Golf Course in connection with the construction of the M.I.C. This Easement shall be used to build highway improvements and shall be maintained by FDOT in connection with the use of public transportation of State Road No. 953, with full right of ingress thereto and egress therefrom. The City of Miami greatly benefits from the construction of this highway improvement because it will alleviate some of the traffic congestion to City residents, and to the Melreese Golf Course with additional road improvements and landscaping.
