HomeMy WebLinkAboutR-02-0474J-02-301 4/15/02 RESOLUTION NO. 02- 4 4 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND ACCEPTING THE BID OF METRO EXPRESS, INC., THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, PURSUANT TO INVITATION FOR INFORMAL BIDS, DATED JANUARY 11, 2002, FOR THE PROJECT ENTITLED "STORMWATER - SANITARY SEWER DISCONNECTION PROJECT, PHASE I, B- 5639", IN THE AMOUNT OF $129,500; ALLOCATING FUNDS FROM PROJECT NO. 351290, AS APPROPRIATED BY THE ANNUAL APPROPRIATIONS AND CAPITAL IMPROVEMENT PROJECTS ORDINANCES, AS AMENDED, IN THE AMOUNT OF $129,500 FOR THE CONTRACT COSTS AND $18,500 FOR EXPENSES, FOR A TOTAL ESTIMATED COST OF $148,000; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE PROJECT. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four -fifth (4/5ths) affirmative vote of the City Commission, after a duly advertised public hearing, the City Managers' finding of an emergency is ratified, approved and •a� APR 2 5 2002 wo. 02- 474 confirmed, the requirements for competitive sealed bidding procedures are waived and the bid of Metro Express, Inc., the lowest responsive and responsible bidder, pursuant to Invitation for Informal Bids, dated January 11, 2002, for the project entitled "Stormwater - Sanitary Sewer Disconnection Project, Phase I, B- 5639", in the amount of $129,500, for the total bid of the proposal, is accepted at the price stated herein. Section 2. The total estimated project costs of $148,000 are allocated from Project No. 351290, as appropriated by the Annual Appropriations and Capital Improvement Projects Ordinances, as amended. Total project costs consist of $129,500 for contract cost and $18,500 for estimated expenses incurred by the City. Section 3. The City Manager is authorized" to execute an agreement, in a form acceptable to the City Attorney, with Metro Express, Inc. for the project. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Gime z ENCLOSURES: FISCAL IMPACT: NONE - BUDGETED ITEM RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution ratifying the City Manager's written finding that a valid emergency exists based on my investigation of several illicit stormwater sewer connections to sanitary sewer systems throughout the City, and waiving formal competitive bidding procedures and authorizing the City Manager to accept the bid of Metro Express, Inc., a Hispanic minority controlled corporation located at 3594 S.W. 143 Court, Miami, Florida, as the lowest responsive and responsible bid in the amount of $129,500 Total Bid. BACKGROUND Based on my investigation of several locations where the City of Miami is in violation of having storm sewer collection systems cross -connected with sanitary sewer systems, I have found that an EMERGENCY exists which justifies the selection of a contractor by informal bids. Miami -Dade County DERM has issued a final notification letter to the City that interconnections of storm water with sanitary sewer systems at five locations are in violation of Chapter 24, Miami -Dade County Environmental Protection Ordinance and Chapter 403 of the Florida Statutes. In order to initiate the construction process to disconnect the storm sewer and sanitary sewer systems from each other as soon as possible, formal competitive sealed bid procedures shall be waived for the procurement of contracting services required for said EMERGENCY pursuant to sections 18-83 and 18-84 of the City Code. Informal bids shall be obtained and a contract shall be awarded to the lowest responsive and qualified bidder. All costs of this project will be funded from the CIP No. 351290. The Emergency Finding dated November 26, 2001 estimated the probable total cost at approximately $128,000. After receiving bids, the final total cost, based on the lowest bid received, is $148,000. A review of the bids received has determined that the increased amount is reasonable based on the construction work to be provided within the time frame recommended by the Miami -Dade County Department of Environmental Resources Management. All costs of this project will be funded from the CIP No. 351290. We are requesting your approval of the increased total cost amount of $148,000.
