RESOLUTION NO. 02— 470
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE RELOCATION OF THREE ROYAL
PALM TREES BY THE UNITED STATES SAILING
CLUB, SUBJECT TO THE FOLLOWING CONDITIONS:
(1) THE CITY SHALL APPROVE THE SELECTION OF
THE COMPANY AND METHOD FOR RELOCATION OF THE
AFFECTED TREES; (2) THE UNITED STATES
SAILING CLUB WILL REPLACE ANY TREE THAT DIES
AS A RESULT OF RELOCATION WITH ONE OF EQUAL
SIZE, OR, IF UNABLE TO PROVIDE ONE TREE OF
EQUAL SIZE, THEN PROVIDE TWO TREES OF ANY
SIZE FOR EACH ONE; (3) THE UNITED STATES
SAILING CLUB SHALL OBTAIN ALL REQUIRED
PERMITS FOR THE RELOCATION OF THE TREES;
FURTHER DIRECTING THE CITY MANAGER TO
EXECUTE AN AMENDMENT TO THE LEASE, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE
UNITED STATES SAILING CLUB FOR SAID PURPOSE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The United States Sailing Club's relocation
of Royal Palm Trees is authorized, subject to the following
conditions: (1) the City shall approve the selection of the
company and method for relocation of the trees; (2) the United
States Sailing Club shall replace any tree that dies as a result
of relocation with one of equal size, or, if unable to provide
one tree of equal size, then provide two trees of any size for

each one; and (3) the United States Sailing Club shall obtain
all required permits for the relocation of the trees.
Section 2. The City Manager is directedl' to execute an
Amendment to the Lease, in a form acceptable to the City
Attorney, with the United States Sailing Club for said purpose.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor 2/

1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.
ai If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City
Commission.

Dear Mr. Jimenez:
This letter shall serve as our request to personally appear before the city commission at
your meeting to be held on April 25, 2002.
The United States Sailing Center is a tenant of the City of Miami on its property located
on the south end of Kennedy Park. As a part of our lease, we are required to erect a
building to house U.S. Olympic Sailing training activities. The structure has been built
except for the northwest corner of the roof. We cannot complete the roof and the project
because certain Royal Palms are in the way of the construction of the roof (northwest
comer) and driveway. The lease states that we shall not remove or relocate any Royal
Palms without the City's approval. All construction is "on hold" pending the relocation
of the Royal Palms.
Please permit us to personally appear before the commission on April 25, 2002 to
propose an amendment to our lease to relocate certain Royal Palms to another area on the
site. The trees will be replanted within a row of trees that have died approximately fifty
(50) yards from their present location. The relocation of the trees will allow us to
complete the roof and building.

Royal Palms relocation
REFERENCES:

It is respectfully recommended that the City Commission approve United States Sailing Center's
("USSC") request to relocate two Royal Palms within their lease property. This recommendation
is subject to USSC guaranteeing the survival of the palms. In the event the palms do not survive
the replanting, USSC shall be responsible for their replacement.
BACKGROUND:
The City entered into a Lease Agreement with USSC for the leasing of approximately 76,149
square feet in Kennedy Park for the construction and operation of a United States Olympic
Training Facility and supporting uses. USSC has completed the permitting process and
construction of the new building is underway.
According to the Lease Agreement, USSC was required to retain certain existing Royal Palms
within the Lease Property (see attached site plan for location). These Royal Palms may only be
removed if they die and consequently pose harm to individuals and property at the site. Under
the aforementioned circumstances, USSC is responsible to remove the palms upon receiving the
written approval of the City Manager.
Following commencement of construction of the new facility, USSC realized that one palm is
located extremely close to the roof overhang and if left in place, the palm may damage the roof.
It should be noted that the overhang was extended during the permitting process at the request of
the City. Additionally, USSC has found that another palm will hinder their ability to utilize the
boat storage space on the first floor of the building. Therefore, USSC has requested
authorization to relocate these two Royal Palms within the lease property. The aforementioned
matter does not have a fmancial impact to the City.
