HomeMy WebLinkAboutR-02-0416J-02-226 3/22/02 RESOLUTION NO. 02- 416 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTH (4/5THS) AFFIRMATIVE VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND ACCEPTING THE BID OF METRO EXPRESS, INC., THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, PURSUANT TO INVITATION FOR INFORMAL BIDS, DATED FEBRUARY 12, 2002, FOR THE PROJECT ENTITLED "FAIRLAWN STORM SEWER EMERGENCY OUTFALL RECONSTRUCTION PROJECT, B-5671", IN THE AMOUNT OF $99,600; ALLOCATING FUNDS FROM PROJECT NO. 352265, AS APPROPRIATED BY THE ANNUAL APPROPRIATIONS AND CAPITAL APPROPRIATIONS ORDINANCES, AS AMENDED, IN THE AMOUNT OF $99,600 FOR THE CONTRACT COSTS AND $9,372 FOR EXPENSES, FOR A TOTAL ESTIMATED COST OF $108,972; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a fourth -fifth (4/5th,) affirmative vote of the City Commission, after a duly advertised public hearing, the City Manager's finding of an emergency is ratified, approved CITY COM41SSION N uvxG 6F APS' 1 E 2002 aesalution Mo. 02- 416 and confirmed, the requirements for competitive sealed bidding procedures are waived and the bid of Metro Express, Inc., the lowest responsive and responsible bidder, pursuant to Invitation for Informal Bids, dated February 12, 2002, for the project entitled "Fairlawn Storm Sewer Emergency Outfall Reconstruction Project, B-5671", in the amount of $99,600, for the total bid of the proposal, is accepted at the price stated herein. Section 2. The total estimated project costs of $108,972 are allocated from Project No. 352265, as appropriated by the Annual Appropriations and Capital Improvement Projects Ordinances, as amended. Total project costs consist of $99,600 for contract costs and $9,372 for estimated expenses incurred by the City. Section 3. The City Manager is authorized!' to execute an agreement, in a form acceptable to the City Attorney, with Metro Express, Inc. for the project. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. BACKGROUND As a result of intense rainstorms, the entire stormwater drainage system serving: along NW 4 Terrace between NW 48 Court and NW 52 Avenue along NW.52 Avenue between NW 4 Terrace and the Blue Lagoon Lake Outfall and along NW 4 Street between NW 50 Avenue and NW 51 Avenue experienced severe flooding. The magnitude of the work required exceeds the construction capability of the Public Works Operations Division and formal competitive bid procedures shall be waived in order to initiate the reconstruction of the stormwater system immediately. ti CAGIt /JLL/mm 27/oZ.
