A RESOLUTION OF THE MIAMI CITY COMMISSION,
BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE,
RATIFYING, APPROVING AND CONFIRMING THE
CITY MANAGER'S FINDING OF AN EMERGENCY,
WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE
INSTALLATION OF A NEW 8 FEET BY 152 FEET
LINEAL FENCE, TWO SINGLE SWING GATES AND A
DOUBLE SWING GATE AT BARRY UNIVERSITY
MARINE CENTER, LOCATED AT 3601 RICKENBACKER
CAUSEWAY, MIAMI, FLORIDA, IN AN AMOUNT NOT
TO EXCEED $6,500; ALLOCATING FUNDS FROM
ACCOUNT CODE NO. 001000.810101.6.670.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th,) affirmative vote of
the City Commission, the City Manager's finding of an emergency,
waiving the requirements for competitive sealed bids and
approving the installation of a new 8 feet by 152 feet lineal
fence, two single swing gates and a double swing gate at Barry
University Marine Center, located at 3601 Rickenbacker Causeway,
Miami, Florida, in an amount not to exceed $6,500, is ratified,

No. 001000.810101.6.60.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.!'

the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached resolution ratifying,
approving, and confirming the City Manager's fording of an emergency, waiving the requirements for
competitive sealed bids, and approving the emergency procurement for the installation of a new 8 foot by
152 lineal feet fence, the installation of 2 single swing gates, and a double swing gate at the Barry
University Marine Center located at 3601 Rickenbacker Causeway, at a total amount not to exceed
$6,500; allocating funds from Account Code No. 001000.810101.6.670.
BACKGROUND:
The City of Miami (the "City") is the owner of the real property and its improvements located at 3601
Rickenbacker Causeway, Miami Florida (the "Property"). On January 10, 2002 the City Commission
adopted Resolution 02-40 authorizing the City Manager to execute a Management Agreement with Barry
University, Inc. (the "Provider). In accordance with the Management Agreement the City shall provide
initial repairs to the Property including the installation of fencing around the additional paved area of the
Property. During the negotiation process with the Provider it was discovered that the initial fencing
design was not conducive to the daily operations of the Provider. Modifications to the fencing structure
and the installation of larger swing gates had to be procured. The initial purchase order in the amount of
$3,700 was insufficient to cover the cost to include these modifications, making it necessary and practical
to increase the initial purchase order. The City Manager made a fording of emergency authorizing the
procurement of these services and at a total cost not to exceed $6,500. The funds are available in
Account Code No. 001000.810101.6.670.

SUBJECT: Emergency Purchase

The Office of Asset Management respectfully requests your approval to procure fencing
on an emergency basis from Fence Connection in the total amount of $6,500. This
fencing is for the purpose of securing the property located at 3601 Rickenbacker
Causeway (a/k/a Barry University Marine Center at the City of Miami) to prevent
unauthorized waterside access to the site thereby reducing the City's liability.
Last fiscal year, the Office of Asset Management obtained three quotes for the
procurement of fencing at this site. The bids were from Fence Connection, Murray Fence
and Warren Fence in the amounts of $3,700, $3,820 and $3,873, respectively. The City
subsequently issued purchase order 214934 in the amount of $3,700 to Fence Connection
who is one of the vendors listed in the citywide contract for General Building/Specialty
Trade Services. Fence Connection was subsequently authorized to proceed with the
work.
Due to delays in permitting, the vendor did not complete the work by the end of the fiscal
year and the purchase order was closed by the Finance Department. Additionally, Barry
University, the current manager of the site, requested modifications to the scope of work
to include the installation of additional swing gates in order to provide better access to the
water. This change of scope increased the project cost to a total of $6,500.
Based on the fact Fence Connection has already commenced the work and obtained the
necessary permits, it is recommended a purchase order be issued on an emergency basis
to Fence Connection for a total amount of $6,500. Funds to cover the cost of this work
are available in Account No. 810101-670.
