RESOLUTION NO. 02— 390
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENTS, ACCEPTING THE PLAT
ENTITLED FINGER COMPANY PLAT, A SUBDIVISION
IN THE CITY OF MIAMI, SUBJECT TO ALL OF THE
CONDITIONS OF THE PLAT AND STREET COMMITTEE,
AND FURTHER, SUBJECT TO THE FOLLOWING: (1)
AN EXECUTED INDEMNIFICATION AND HOLD
HARMLESS AGREEMENT IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY; (2) A BOND ACCEPTABLE TO
THE CITY'S RISK MANAGEMENT ADMINISTRATION,
AS REQUIRED BY CITY OF MIAMI CODE SECTION
54-4; (3) AN OPINION OF TITLE OR OTHER TITLE
DOCUMENT(S) SATISFACTORY TO THE CITY
ATTORNEY AND THE DIRECTOR OF PUBLIC WORKS
REGARDING TITLE TO THE REMNANT PARCEL AS
REQUIRED BY THE PLAT AND STREET COMMITTEE;
(4) LETTERS FROM THE DEPARTMENTS OF
FIRE -RESCUE, POLICE AND SOLID WASTE
REGARDING SUITABLE ACCESS EASEMENTS AS
REQUIRED BY CITY CODE SECTION 54-4; AND (5)
A FINAL LEGAL DESCRIPTION AND AN OPINION OF
TITLE SATISFACTORY TO THE DIRECTOR OF PUBLIC
WORKS; AND ACCEPTING THE DEDICATIONS SHOWN
ON SAID PLAT; AUTHORIZING AND DIRECTING THE
CITY MANAGER AND CITY CLERK TO EXECUTE SAID
PLAT AFTER SATISFACTORY COMPLETION OF THE
ABOVE -ENUMERATED CONDITIONS; AND PROVIDING
FOR THE RECORDATION OF SAID PLAT IN THE
PUBLIC RECORDS OF MIAMI-DADE COUNTY,
FLORIDA.
WHEREAS, the Department of Public works recommends the
acceptance of the plat entitled FINGER COMPANY PLAT;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The plat entitled FINGER COMPANY PLAT is a
replat of the property described in Attachment 1, which plat by
reference is made a part hereof as if fully incorporated herein,
and subject to all of the conditions required by the Plat and
Street Committee, is accepted, subject to the following: (1) an
executed Indemnification and Hold Harmless Agreement in a form
acceptable to the City Attorney; (2) a Bond acceptable to the
Risk Management Administrator, as required by City of Miami Code
Section 54-4; (3) an Opinion of Title or other title document(s)
satisfactory to the City Attorney and the Director of Public
Works regarding title to the remnant parcel as required by the
Plat and Street Committee; (4) letters from the Departments of
Fire -Rescue, Police and Solid Waste regarding suitable access
easements as required by City Code Section 54-4; and (5) a final
Legal Description and an Opinion of Title satisfactory to the
Director of Public Works. The dedications shown on the plat
together with the dedications to the perpetual use of the public
of all existing and future planting, trees and shrubbery on said
property are also accepted and confirmed by the City of Miami,
Florida.
Section 2. The City Manager and City Clerk are
authorized and directed to execute the plat after satisfactory

completion of the above enumerated conditions, and cause the
same to be recorded in the Public Records of Miami -Dade County,
Florida.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor."

1� If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt a
resolution accepting the plat FINGER COMPANY PLAT and approving
recording the same in the Public Records of Miami -Dade County,
Florida.
BACKGROUND:
The Department of Public Works has reviewed this plat, and has
determined that it is now in order for acceptance by the City
Commission. The specific intent of this plat is to create two
(2) tracts of land for the construction of (1) a residential
complex, consisting of no more that 437 units, with accessory
recreational space; (2) 19,400 square feet of retail space; and
(3) 701 parking spaces.
The proposed record plat entitled FINGER COMPANY PLAT is a
replat of the property described in the attached Legal
Description. The area platted consists of two (2) tracts
containing approximately 203,686 square feet (4.68± acres). It
is zoned R-4, C-1 and R-4/SD-20.
Also attached are the following documents necessary for the City
Commission to consider in making their decision:
1) Resolution accepting the Plat
2) Plat and Street Letter
3) Print of Proposed Record Plat
