RESOLUTION NO. 02— 288
A RESOLUTION OF THE MIAMI CITY COMMISSION
ESTABLISHING MINIMUM QUALIFICATIONS FOR
PUBLISHING, ON AN AS -NEEDED ROTATIONAL, BASIS,
CITY SUPPLEMENTAL OR COURTESY PUBLIC NOTICES
IN COMMUNITY --BASED NEWSPAPERS; FURTHER
AUTHORIZING THE CITY MANAGER TO QUALIFY AND
INCLUDE ADDITIONAL QUALIFIED COMMUNITY-BASED
NEWSPAPERS ON THE LIST WHEN DEEMED
APPROPRIATE; AND ALLOCATING FUNDS FROM THE
BUDGETS OF INDIVIDUAL USER DEPARTMENTS,
SUBJECT TO AVAILABILITY OF FUNDS.
WHEREAS, the City Commission directed that the administration
establish minimum qualification criteria for publishing City
supplemental or courtesy public notices on an as -needed rotational
basis and a list of qualified community-based newspapers; and
WHEREAS, based upon the responses received per RFLI
No. 01-02-112 issued on February 14, 2002, the administration's
recommendations are set forth herein; and
WHEREAS, funding for such advertising will be allocated from
the budgets of the individual user departments, subject to the
availability of funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The following minimum qualifications are
established for City supplemental or courtesy public notices to be
published in community-based papers on an as -needed rotational
basis:
1. A community-based newspaper shall:
a. have been in continuous operation for at least five
years; and
b. be published on at least a monthly basis; and
C. have a circulation of at least 10,000 per issue in
the City of Miami and provide the City with a
certified statement of circulation or sworn
statement as to circulation average over the past
year; and
d. deliver newspapers to no less than 5o distribution
drops points located within the City of Miami; and
e. be physically located in the City of Miami, and
possess and maintain a current City occupational
license in accordance with the City Code.
2. To effectively service all the citizens of the City of
Miami, the City Manager may waive requirement that the
newspaper be located in City of Miami as required in
subparagraph (1)(e) above for those community-based
newspapers that meet all other minimum qualification
requirements and publish in either the Spanish or Creole
language, providing that said newspapers possess and
maintain a current Miami -Dade County Occupational
License.
Section 3. The City Manager may qualify and include
additional community-based newspapers to the List when deemed
appropriate.

Section 4. Funding costs for such advertising shall be
allocated from the budgets of the individual user departments,
subject to availability of funds.
Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor!'.

1� If the Mayor does not sign this Resolution, it shall become
effective at the end of ten Calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City
Commission.

It is respectfidly recommended that the City Commission adopt the attached Resolution authorizing
the City Commission to establish minimum qualifications for community-based newspapers to
publish City supplemental or courtesy public notices on an as -needed rotational basis; and to
qualify and add additional community-based newspapers to the List from time to time. Funding for
advertisement will be from individual departmental accounts prior to usage.
BACKGROUND
Pursuant to a directive from the City Commission on January 10, 2002, the City issued RFLI 01-
02-112 on February 14, 2002. In years past, the City had utilized community-based newspapers to
publish City supplemental or courtesy public notices on an as -needed rotational basis, and the
issuance of the RFLI was to again solicit community-based newspapers interested in publishing
supplemental or courtesy public notices, The City now seeks establishment by the City
Commission of minimum criteria to be used to qualify community-based newspapers to publish
City supplemental or courtesy public notices on an as -needed rotational basis. Upon adoption of
the minimum qualifications by the City Commission, the community-based newspapers who
responded to the RFLI will be evaluated pursuant to those adopted qualification criteria. These
qualification criteria will be utilized to qualify and add community-based newspapers to the List
from time to time. All qualified newspapers would be mandated to adhere to the City's
requirements regarding placement of supplemental or courtesy public notices.
