J -02-205(a) SE 02/28/02 • RESOLUTION NO 02- 240 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING A MODIFICATION TO A DECLARA'T'ION OF RESTRICTIVE COVENANT ("ZONING COVENANT") DATED APRIL 17, 1970, AND RECORDED IN OFFICIAL RECORDS BOOK 6867, PAGE 438-447, OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 3150 AND 3250 SOUTHWEST 3RD AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN ATTACHED "EXHIBIT A", IN ORDER TO AMEND PARAGRAPH THREE OF THE ZONING COVENANT TO MODIFY THE PREVIOUSLY APPROVED SITE PLAN; SUBJECT TO THE PROPERTY OWNER RECORDING THE MODIFICATION IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA. WHEREAS, the properties located at approximately 3150 and 3250 Southwest 3rd Avenue, Miami, Florida (the "Property"), more particularly described in attached "Exhibit A," are subject to a Declaration of Restrictive Covenant ("Zoning Covenant"), dated April 17, 1970, and recorded in Official Records Book 6867, Page 438-447, of the Public Records of Miami -Dade County, Florida; and INI ,sa t .i R $� Y C01=1 SON NBETING MAP 0 7 2002 RcasohAiar No. 02- 244 WHEREAS, the property owner desires to modify paragraph three of Zoning Covenant by amending the previously approved site plan; and WHEREAS, the Director of the Planning and Zoning Department has reviewed the request and recommends approval of the requested modification to the Zoning Covenant subject to the conditions set forth in the Planning Fact Sheet attached as "Exhibit B"; and WHEREAS, the City Commission after careful consideration of this matter finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants to approve the Modification to the Zoning Covenant subject to the conditions set forth herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A copy of which is attached as Exhibit "A'. The proposed modification to the Declaration of Restrictive Covenants provides for an amendment to paragraph three in order to modify the prior approved site plan. The proposed site plan includes a six (6) level parking structure to be located at 3250 S.W. 3rd Avenue, Miami, Florida and a Center for Excellence (three story preschool and classrooms) to be located at 3150 S.W. 3rd Avenue. The Center for Excellence will be a state-of-the-art daycare center. Currently, there are surface parking lots where the new garage and Center for Excellence will be located. At this time, we are not requesting approval for the preschool center; only the site plan which shows a footprint and maximum height of the proposed preschool center. No setback variances will be requested. In the next several months, we will submit complete architectural plans and request a Special Exception for the preschool center. Please place this item on the Planping and Zoning City Commission Agenda in December, 2001. We have enclosed a check in the amount of $2,000 for the application fee, as well as the accompanying application for public hearing. Long before the United Way became a neighbor of this predominantly, single-family residential district, the existing structure was used as an office building and the parking lot in the rear was sufficient to meet its off the street parking demands. The parking lot extending into the residential areas was fenced all around and nicely landscaped. The existing property is a good example of how the Coral Way commercially -zoned property can blend with its surrounding single-family residential district without forever changing the long-standing neighborhood life style enjoyed by the property owners who have invested in the Roads/Shenandoah area, many of them, for this specific reason. Two nearby schools serve the neighborhood generating morning and afternoon traffic to and from St. Peter & Paul and Coral Way Elementary. These two schools have traditionally accommodated the children of these area residents. Many children walk by the proposed site every morning to reach Coral Way Elementary. The traffic density that a multi-level parking structure on this site would bring to this neighborhood would deprive homeowners of the safety and tranquility they have, for many years, enjoyed. Long before the United Way became a neighbor of this predominantly, single-family residential district, the existing structure was used as an office building and the parking lot in the rear was sufficient to meet its off the street parking demands. The parking lot extending into the residential areas was fenced all around and nicely landscaped. The existing property is a good example of how the Coral Way commercially -zoned property can blend with its surrounding single-family residential district without forever changing the long-standing neighborhood life style enjoyed by the property owners who have invested in the Roads/Shenandoah area, many of them, for this specific reason. Two nearby schools serve the neighborhood generating morning and afternoon traffic to and from St. Peter & Paul and Coral Way Elementary. These two schools have traditionally accommodated the children of these area residents. Many children walk by the proposed site every morning to reach Coral Way Elementary. The traffic density that a multi-level parking structure on this site would bring to this neighborhood would deprive homeowners of the safety and tranquility they have, for many years, enjoyed. Evaluation and Appraisal Report (EAR) based amendments have been adopted for the following elements: Future Land Use, Housing, Sanitary and Storm Sewers, Natural Groundwater Aquifer Recharge, Potable Water, Solid Waste Collection, and Parks, Recreation and Open Space. EAR based amendments for the Transportation, Coastal Management, Natural Resource Conservation, Capital ' Improvements, and Intergovernmental Coordination elements are tentatively scheduled for consideration by the City Commission in December, 1999. 02- 240 ' Lands under this designation with specific qualities that make them desirable for commercial photography shall be allowed to be used in this manner conditionally, and only when it is determined that conducting such commercial photography will not endanger significant ' environmental features within the area. Major Institutional, Public Facilities, Transportation and Utilities: Areas designated as "Major Institutional, Public Facilities, Transportation and Utilities" allow facilities for federal, state and local government activities, major public or private health, recreational, cultural, religious or educational activities, and major transportation facilities and public utilities. Residential facilities ancillary to these uses are allowed to a maximum density equivalent to "High Density Multifamily Residential" subject to the same limiting conditions. Restricted Commercial: Areas designated as "Restricted Commercial" allow residential uses (excepting rescue missions) to a maximum density equivalent to "High Density Multifamily Residential" subject to the same limiting conditions; any activity included in the "Office" designation as well as commercial activities that generally serve the daily retailing and service needs of the public, typically requiring easy access by personal auto, and often located along arterial or collector roadways, which include: general retailing, personal and professional services, real estate, banking and other financial services, restaurants, saloons and cafes, general entertainment facilities, private clubs and recreation facilities, major sports and exhibition or entertainment facilities and other commercial activities whose scale and land use impacts are similar in nature to those uses described above, places of worship, and primary and secondary schools. This category also includes commercial marinas and living quarters on vessels as permissible. Central Business District (CBD): The area designated as "Central Business District (CBD) is intended to apply to the central commercial, financial and office core of the metropolitan region, and allows all activities included in the "Office," "Restricted Commercial," and "Major Institutional, Public Facilities, Transportation and Utilities" designations. Residential facilities (except for rescue missions) alone or in combination with other uses are allowable to a maximum density of 1,000 dwelling units per acre, subject to the detailed provisions of the applicable land development regulations and the maintenance of required levels of service for facilities and services included in the City's adopted concurrency management requirements. Also permitted is a mix of uses ranging from high density multifamily residential to high intensity office uses with retail uses on the lower floors of structures. Intensity of uses within the CBD land use designation are generally higher than those allowed in other areas of the city. General Commercial: Areas designated as "General Commercial" allow all activities included in the "Office" and the "Restricted Commercial" designations, as well as wholesaling and distribution activities that generally serve the needs of other businesses; generally require on and off loading facilities; and benefit from close proximity to industrial areas. These commercial activities include retailing of second hand items, automotive repair services, new and used vehicle sales, parking lots and garages, heavy equipment sales and service, building material sales and storage, wholesaling, warehousing, distribution and transport related services, light manufacturing and assembly and other activities whose scale of operation and land use impacts are similar to those uses described above. Despite the research, however, a ' quality pre -K education is still seen as a consumer good instead of an investment in our state's future. I believe that a quality education of young children is the single most important thing our state can do to improve educational achievement, accordingly I have developed a constitutional amendment initiative that would launch a statewide pre -kindergarten program to provide every 4 -year-old in Florida with a quality learning opportunity. On Thursday, March 7, 2002, United Way of Miami -Dade County will request the City of Miami Commission approval to build a state-of-the-art Early Childhood Learning Center named "United Way Success By 0 Center of Excellence" The center will provide high quality early Childhood care for 140 children. The center will have the larger goal of promoting and helping improve early childcare through the entire Miami -Dade County. The center's goal is to become a center of excellence designed to research, and develop: the best practices for child care professionals to increase their skills; to assist businesses and other organizations to develop programs for the care of children of their employees; and, a research center to develop a curriculum and now techniques can be taught about the best practices on early childhood education. The center will focus on helping elevate the quality of early childhood care through Miami - Dade County. This will be accomplished offering opportunities for learning, for educators, professional practitioners, parents and businesses, as well as by establishing collaborations among the entire individual's concerned about early childhood development. Goodwill Industries is located in the Allapattah area where last year we employed 721 single mothers responsible for over 997 dependents — many of them small children. The struggle these women experience everyday is overwhelming. They must make choices between the need to come to work to support the family or stay home to attend the children's needs, and attend to their proper child development. Proper childcare is essential so these women can continue to come to work and have proper childcare so these children can succeed in school and later on in life, thus breaking the inherited cycle of poverty under which they were born. United Way of Miami -Dade County is an organization whose mission is dedicated to improve the quality of life of people in Miami -Dade County — an organization with a proven track record of community service.
