A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE,
AFTER A DULY ADVERTISED PUBLIC HEARING,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF SOLE SOURCE; WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDDING
PROCEDURES AND APPROVING THE PROCUREMENT OF
TWENTY-TWO PORTABLE MTS 2000 AND LTS 2000
SERIES MOTOROLA RADIOS WITH THE SMARTNETTm
SOFTWARE SYSTEM, WITH ACCESSORIES, FOR THE
DEPARTMENT OF SOLID WASTE FROM MOTOROLA
COMMUNICATIONS AND ELECTRONICS, INC., SOLE
SOURCE PROVIDER, IN AN AMOUNT NOT TO EXCEED

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th$) affirmative vote,
after a duly advertise public hearing, the City Manager's finding
of sole source, is ratified, approved and confirmed, the
requirements for competitive bidding procedures is waived, and
the procurement of twenty --two portable MTS 2000 and LTS 2000
series Motorola radios with the SMARTNETTI'l software system, with
accessories, for the Department of Solid Waste from

Motorola Communications And Electronics, Inc., sole source
provider, in an amount not to exceed $57,307.70, is approved,
with funds allocated from Capital Improvements Project
No. 353018.329401.6.840.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor. I/

If the Mayor does not sign this Resolution, it shall become effective at
the end of ton calendar_ days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission waive the necessity of competitive sealed
bids and approve the attached Resolution for the sole source purchase of 22 Motorola portable radios
MTS2000 and LTS2000 Series (with SMARTNET Type II software and required accessories) for the
Department of Solid Waste, from Motorola Communications and Electronics, Inc., a Non-local/Non-
Minority vendor located 4660 SW 158 Avenue, Miami, Florida 33185 in an amount not to exceed
$57,307.70.
Funds are available in the Capital Improvement Program, Project No. 353018.329401.6.840.
BACKGROUND:
The Department of Solid Waste has identified a need to purchase additional portable radios for the
Operational Division of the department. This equipment will enhance the overall communications
within the Operational Division relative to equipment breakdowns, complaints and/or accidents in an
efficient and timely manner. Additionally, this equipment will aid in the improved efficiency of
equipment and manpower deployment to ensure improved service collection and/or special event
cleanup activities.
The Director of the Purchasing Department has determined that Motorola Communications and
Electronics, Inc., is the sole manufacturer of the Motorola portable radios MTS2000 and LTS2000
Series (with SMARTNET Type ll software and required accessories).

An investigation wasc nducted by staff to determine whether Motorola Communications and Electronics,
Inc., a non -minority / on -local vendor, located at 4660 SW 158 Avenue, Miami, Florida 33185 is the sole
source provider for the acquisition of 22 Motorola portable radios, MTS 2000 and LTS 2000 series, with the
SMARTNET Type H software and required accessories, for the Department of Solid Waste. Funding, in and
amount not to exceed $57,307.70, is available from the Capital Improvement Program, Project No.
353018.329401.6-840.
According to the Department of Solid Waste, it has identified a need to purchase additional portable radios
with the SMARTNET software, and accessories, for the Operational Division of the department. This
equipment will enhance the overall communications within the Operational Division relative to equipment
breakdowns, complaints, and/or accidents in an efficient and timely manner. Also, this equipment reportedly
will aid in the improved efficiency of equipment and manpower deployment to ensure improved service
collection and/or special event cleanup activities.
It has been determined that Motorola Communications and Electronics, Inc. ("Motorola") is the sole
manufacturer of the City's existing 800 MHz radio system, which was acquired by the City via a sole source
finding. The engineering, original design and installation of the system was executed by Motorola, and the
operating and maintenance software (SMARTNET) for the system is proprietary to Motorola, Inc. The
City has previously determined the acquisition of these portable radios with the SMARTNET software and
related accessories from Motorola was also a sole source.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these
findings be approved: Motorola Communications and Electronics, Inc., is the sole source provider of 22
Motorola portable radios, MTS 2000 and LTS 2000 series, with the SMARTNET Type II software and
required accessories, for the Department of Solid Waste. Funding, in an amount not to exceed $57,307.70,

REASON: The Department of Solid Waste has identified a need to
purchase additional portable radios with the
SMARTNET software, and accessories, for the
Operational Division of the department. This equipment
will enhance the overall communications within the

complaints, and/or accidents in an efficient and timely
manner. Also, this equipment reportedly will aid in the

acquire 22 Motorola portable radios, MTS 2000 and
LTS 2000 series, with the SMARTNET Type II
software and required accessories. All of the radios are
equipped with the Smartnet Type 11 software.
RECOMMENDATION: It is recommended that award be made to Motorola
Communications and Electronics, Inc., the sole
source provider, for the acquisition of 22 Motorola
portable radios, MTS 2000 and LTS 2000 series, with
the SMARTNET Type II software and required
accessories, for the Department of Solid Waste.
