Dear Ms. Fernandez:
As you know the above -referenced Special Exception was scheduled for hearing before
the City Commission at their meeting of Tuesday, December 11, 2001. As you are also aware, I
was not in attendance due to a scheduling change. I also understand that Commissioner
Regalado raised a question regarding the property addresses. This letter addresses these two
matters.
This application was heard and unanimously approved by the Miami Zoning Board on
Monday, October 1st, 2001. On or about November 7, 2001, your staff advised me that this item
would be scheduled for hearing before the City Commission at their Planning and Zoning
meeting on Thursday, December 13, 2001. Later that month, the City Commission decided to
"switch" hearings on that week, i.e., hear the planning and zoning items during their Tuesday
meeting and their regular, non -zoning items, during their Thursday meeting. As a result, our
client's hearing was scheduled for the Tuesday, December d 1 City Commission meeting. The
mailed notices and the agenda correctly reflected the new date. At this time, I had already
scheduled this matter in my calendar based on my earlier informal conversations with staff and
custom of holding the City Planning and Zoning meetings on Thursdays. When the mailed
notices arrived, I did not realize the change in date to the Tuesday agenda. As a result, I was not
present at the meeting on December 11. Because neither the applicant nor myself were present on
Tuesday, the City Commission continued the item to their January 24, 2002 meeting. My error
was an honest, but nonetheless embarrassing, mistake. I regret any inconvenience to the City
Commission and the City Staff and look forward to presenting our requests to the City
Commission on January 24.

I would also like to take this opportunity to clarify a matter that was brought to the
attention of staff regarding the address for one of the lots encompassing the subject property of
the special exception request. SpecifcalIy, one of the propertiesl is described as having an
address at 410 N.W. 2nd Street. I understand that Chairman Regalado correctly pointed out that
this address is not correct for a property that is situated immediately east of N.W. 42nd Avenue.
Please note that the address for that lot was provided to us by the seller at the time of contract.
That designated address is a typographical error, since the individual lot, would in all likelihood
be assigned "4140 N.W. 2nd Street" as an address. However, we have further researched this
matter at the office of the Miami -Dade Property Appraiser's office. We have been advised that
the property has not been assigned an address by either the County or the City because the
property is, and has historically been, vacant. Therefore, the property does not have an assigned
address. Since addresses are assigned by the City at the time of permit, we are at a loss as to how
one can be assigned at this time. The legal description and tax folio identification number for this
individual lot was included in the application materials. For your convenience, a revised
summary chart of legal descriptions, folio numbers and addresses is enclosed. Obviously, I will
be prepared to answer Chairman Regalado's questions on the 24th of January.

The requested Special Exception is in order to provide a surface parking with SD -12
Overlay. Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, the subject proposal to permit a surface parking
with SD -12 Overlay lot has been reviewed as follows:
NOTE: This Special Exception includes City Commission approval subject to unity
of title.
The following findings have been made:
• It is found that the proposed, surface parking lot will be developed on R-2 "Two -
Family Residential" lots with an SD -12 Overlay, adjacent to an existing C-1
"Restricted Commercial" area, to the west, in order to provide additional parking for a
new hotel building.
It is found that the proposed parking will be beneficial to the area by providing a
paved and striped parking area to service the proposed hotel building.
• It is found that since the proposal includes a substantial landscape buffer adjacent to
the residential area, and since all of the proposed vehicular circulation will be
provided through the existing commercial area, and not through the residential area,
the proposed use is in scale and character with the surrounding area. However, more
care should be considered to the landscaping proposed along Le Jeune Road, which is
a major arterial roadway and gateway into the City of Miami from the airport.
• It is found that the proposed layout provides adequate parking and circulation.
• It is found that upon compliance with conditions set forth below, this project will not
have any adverse impacts on the surrounding area.

Based on these findings, the of Planning and Zoning Department is recommending
approval of the application with the following conditions:
1- A new landscape plan, with specifications, depicting a combination of shade trees
with proposed palm trees along the Le Jeune Road corridor.
2- The applicant shall include paint color samples, sign specifications and
illumination scheme of the proposed hotel structure along with new elevation
plans responding to the importance of Le Jeune Road at pedestrian level and the
applicant shall continue meeting with the Planning Department Design Review
Committee for review and approval of the above listed items prior to issuance of
any building permits.

Due consideration shall be given to utilities required, with particular
reference to availability and capacity of sysfems, location of

1305.6 Drainage
Due consideration shall be given for drainage, with particular
reference to effect on adjoining and nearby properties and on
general drainage systems in the area. Where major drainage
volumes appear likely and capacity of available systems is found
marginal or inadequate, consideration shall be given to possibilities
for recharge of groundwater supply on the property, temporary
retention with gradual discharge, or other remedial measures.
1305.7 Preservation of Natural Features
Due consideration shall be given to provision for the preservation of
existing vegetation and geological features whenever possible.
9305.8 Control of Potentially Adverse Effects Generally
In addition to consideration of detailed elements indicated above,
as appropriate to the particular class or kind of special permit and
the circumstances of the particular case, due consideration shall be
given to potentially adverse effects generally on adjoining and
nearby properties, the area, the neighborhood or the City of use or
occupancy as proposed, or its locations, construction, design,
character, scale or manner of operation. Where such potentially
adverse effects are found, consideration shall be given to special
remedial measures appropriate in the particular circumstances of
the case, including screening or buffering, landscaping, control of
manner or hours of operation, alteration of use of such space, or
such other measures as are required to assure that such potential
adverse effects will be eliminated or minimized to the maximum
extent reasonably feasible and that the use of occupancy will be
compatible and harmonious with other development in the area to a
degree which will avoid substantial depreciation of the value of
nearby property.

Within the City generally, or within certain zoning districts, certain structures, uses, and/or occupancies
specified in this ordinance are of a nature requiring special and intensive review to determine whether or
not they should be permitted in specific locations, and if so, the special limitations, conditions, and
safeguards which should be applied as reasonably necessary to promote the general purposes of this
Zoning Ordinance and, in particular, to protect adjoining properties and the neighborhood from avoidable
potentially adverse effects. It is further intended that the expertise and judgment of the Zoning Board be
exercised in making such determinations, in accordance with the rules, considerations and limitations
relating to Special Exceptions (see Article 16 of the Zoning Ordinance).
Formal public notice and hearing is mandatory for Special Exceptions. The Zoning Board shall be solely
responsible for determinations on applications for Special Exceptions except when otherwise provided for
