As you are also aware, I was not in attendance due to a scheduling change. I also understand that Commissioner Regalado raised a question regarding the property addresses. This letter addresses these two matters. This application was heard and unanimously approved by the Miami Zoning Board on Monday, October 1st, 2001. On or about November 7, 2001, your staff advised me that this item would be scheduled for hearing before the City Commission at their Planning and Zoning meeting on Thursday, December 13, 2001. Later that month, the City Commission decided to "switch" hearings on that week, i.e., hear the planning and zoning items during their Tuesday meeting and their regular, non -zoning items, during their Thursday meeting. As a result, our client's hearing was scheduled for the Tuesday, December d 1 City Commission meeting. The mailed notices and the agenda correctly reflected the new date. At this time, I had already scheduled this matter in my calendar based on my earlier informal conversations with staff and custom of holding the City Planning and Zoning meetings on Thursdays. When the mailed notices arrived, I did not realize the change in date to the Tuesday agenda. As a result, I was not present at the meeting on December 11. Because neither the applicant nor myself were present on Tuesday, the City Commission continued the item to their January 24, 2002 meeting. My error was an honest, but nonetheless embarrassing, mistake. SpecifcalIy, one of the propertiesl is described as having an address at 410 N.W. 2nd Street. I understand that Chairman Regalado correctly pointed out that this address is not correct for a property that is situated immediately east of N.W. 42nd Avenue. Please note that the address for that lot was provided to us by the seller at the time of contract. That designated address is a typographical error, since the individual lot, would in all likelihood be assigned "4140 N.W. 2nd Street" as an address. However, we have further researched this matter at the office of the Miami -Dade Property Appraiser's office. We have been advised that the property has not been assigned an address by either the County or the City because the property is, and has historically been, vacant. Therefore, the property does not have an assigned address. Since addresses are assigned by the City at the time of permit, we are at a loss as to how one can be assigned at this time. The legal description and tax folio identification number for this individual lot was included in the application materials. For your convenience, a revised summary chart of legal descriptions, folio numbers and addresses is enclosed. Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal to permit a surface parking with SD -12 Overlay lot has been reviewed as follows: NOTE: This Special Exception includes City Commission approval subject to unity of title. The following findings have been made: • It is found that the proposed, surface parking lot will be developed on R-2 "Two - Family Residential" lots with an SD -12 Overlay, adjacent to an existing C-1 "Restricted Commercial" area, to the west, in order to provide additional parking for a new hotel building. It is found that the proposed parking will be beneficial to the area by providing a paved and striped parking area to service the proposed hotel building. • It is found that since the proposal includes a substantial landscape buffer adjacent to the residential area, and since all of the proposed vehicular circulation will be provided through the existing commercial area, and not through the residential area, the proposed use is in scale and character with the surrounding area. However, more care should be considered to the landscaping proposed along Le Jeune Road, which is a major arterial roadway and gateway into the City of Miami from the airport. • It is found that the proposed layout provides adequate parking and circulation. • It is found that upon compliance with conditions set forth below, this project will not have any adverse impacts on the surrounding area. 0"— t!
