BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. City Commission Meeting of January 24, 2002 Resolution Number 02-93 TO FRO CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM 22 DATE : December 7, 2001 FILE: SUBJECT: Code Enforcement Board January 10, 2002 Agenda REFERENCES: ENCLOSURES: List of Members, Resolution The Code Enforcement Board was created to issue orders having the force of law commanding whatever steps are necessary to bring a Code violation into compliance. Florida Statutes Section 162.05(2) requires members of the Code Enforcement Board to be residents of the City of Miami. City Code Section 2-812 states that whenever possible, the board is to consist of an architect, a businessperson, an engineer, a general contractor, a subcontractor, and a realtor. Pursuant to Florida Statutes Section 162(3)(b), all members serve three year terms. Pursuant to City Code Sec. 2-886(a), any board member shall be automatically removed if, in a given calendar year: (1) he/she is absent from three consecutive meetings; or (2) He/she is absent from four of the board's meetings. The provisions of this section may be waived by a four-fifths vote of the members of the full city commission. Four appointments are needed at this time: • Commissioner Gonzilez has one nomination for seat currently held by Adela Gonzdlez, who exceeded the number of absences allowed by the Code. Ms. Gonzalez, who was nominated by former Commissioner Gort, has indicated she is no longer able to serve as a member. • Commissioner Winton has one nomination for seat currently held by Ruth Hamilton, who exceeded the number of absences allowed per City Code. Ms. Hamilton is requesting to be reappointed (copy of letter attached). • The Commission At -Large has two appointments for seats currently held by Charles McEwan and Paul Debesa, who have both exceeded the number of absences allowed per City Code. For your information, attached please find a copy of the current membership of said board.
