A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), GRANTING MIAMI -DADS COUNTY (THE `COUNTY") USE A PORTION OF VIRGINIA KEY PARK (THE "PICNIC AREA") AND A PORTION OF THE MIAMI MARINE STADIUM PARKING LOT, LOCATED AT APPROXIMATELY 3601 RICKENBACKER CAUSEWAY, MIAMI, FLORIDA, TO PROVIDE TEMPORARY PARKING FOR THE ERICCSON OPEN TENNIS TOURNAMENT SCHEDULED FOR MARCH 20, 2002 TO APRIL 1, 2002, AT CRANDON PARK ON KEY BISCAYNE, FLORIDA, IN EXCHANGE FOR THE CITY OF MIAMI'S CONTINUED USE OF THE STABLES AT TROPICAL PARK; AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER OF AGREEMENT WITH MIAMI -DADS COUNTY, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Miami -Dade County's use of a portion of Virginia Key Park (the "picnic area") and a portion of the Miami Marine Stadium parking lot, located at approximately 3601 Rickenbacker Causeway, Miami, Florida, to provide temporary parking for the Ericcson Open Tennis Tournament scheduled for March 20, 2002 to April 1, 2002, at Crandon Park on Key Biscayne, Florida, in exchange for the City of Miami's continued use of the stables at Tropical Park, is granted. .=Y covmsslox ==Nc tv JAN ? 1� 2002 Section 2. If the Mayor vetoes this Resolution, it shall not become effective unless the City Commission overrides the veto. Page 2 of 2 02— 62 • Mr. Steve Shiver County Manager 111 N W I Street, Suite 2910 Miami, FL 33128 RE: Use of City Property for Parking Dear Steve: • This letter serves to confirm that the City of Miami will permit Miami -Dade County ("Licensee") to use a portion of Virginia Key Park commonly known as the "Picnic Area" and a portion of the Marine Stadium parking lot, as depicted in Exhibit A, for purposes of providing parking in connection with the Ericsson Open Tennis Tournament. The City reserves the right to adjust the use area of the Marine Stadium parking lot in the event the film Nautica commences its use of the area for film production. Licensee may utilize the areas for the period of March 20 through April 1, 2002. Additionally, Licensee is hereby granted access to the site effective February 1, 2002 in order to perform preliminary site work including clean-up of the site (the "Clean Up"). In consideration of this permission, Licensee shall extend the boundaries of the Clean Up area to include the portion of City owned land located adjacent to the Miami Marine Stadium, commonly known as Parcel B, as depicted in Exhibit B. Additionally, Licensee shall grant the City continued use of the stables at Tropical Park. The permission herein granted is further subject to Miami Dade County agreeing to indemnify and hold harmless the City to the extent of the limitations included within Florida Statutes, Section 768.28, subject to the provisions of that Statute whereby the Licensee shall not be held liable to pay a personal injury or property damage claim or judgment by any one person which exceeds the sum of $100,000, or any claim or judgments or portions thereof, which, when totaled with all other occurrences, exceeds the sum of $200,000 from any and all personal injury or property damage claims, liabilities, losses and causes of action which may arise solely as a result of the negligence of the Licensee. However, nothing herein shall be deemed to indemnify the City from any Iiability or claim arising out the negligent performance or failure of performance of the City or as a result of the negligence of any unrelated third party. Gimenez City Manager RECOMMENDATION: DATE •Aw5 JAN 14 2002 FILE: SUBJECT: Regarding Granting Parking Access to Miami -Dade County for Ericsson Tennis Tournament REFERENCES: ENCLOSURES: The administration recommends that the City Commission approve the attached Resolution regarding the use by Miami -Dade County of a portion of Virginia Key Park commonly known as the "Picnic Area" and a portion of the Marine Stadium parking lot, in connection with the Ericsson Open Tennis Tournament. This Resolution further authorizes the City Manager to enter into a Letter Agreement with Miami -Dade County for said purpose. As consideration for the use of the Areas, Miami -Dade County has agreed to perform. preliminary site work, which shall include adjacent City owned land. BACKGROUND: The Ericsson Open Tennis Tournament, formally known as the Lipton Tennis Tournament, is scheduled for March 20, 2002 to April 1, 2002. Miami -Dade County has requested to utilize a portion of Miami Marine Stadium and a portion of Virginia Key Beach as parking for event staff and patrons. As in past years, the City has utilized stables at Tropical Park in Miami -Dade County in exchange for Miami -Dade County utilizing parking at Virginia Key and the Marine Stadium for this special event. On November 26, 2001, the Virginia Key Beach Park Trust, approved at its meeting the use of a portion of Virginia Key Beach for temporary parking by Miami -Dade County. Attached is a summary of the justification for granting parking to the County, which shows that the net effect of leasing the stalls from the City and operating the parking ourselves would be in the negative. cis CAGlDB � pk Ericsson 2002.doc UA0-- 62 JUSTIFICATION FOR GRANTING MIAMI-DADE COUNTY PARKING AT VIRGINIA KEY AND MARINE STADIUM IN-KIND SERVICES PROVIDED BY MIAMI-DADE COUNTY TO CITY: 1. STABLES AT TROPICAL PARK': a) 25 STALLS: County rate = 25 stalls year round @ $300/mo x 365 days b) 1 TRAILER: Trailer used by MPD - 40'x 10' = 400 sq. ft. County rental rate = $101sq.ft. x 400 sq. ft. c) 1 PASTURE AREA FOR HORSES: 126'x 80'= 10,000 sq.ft. County rate = $2.50/sq.ft. x 10,000 sq.ft. City uses a maximum of 25 stalls during the year, but the monthly number of stalls used varies. County pays water and electric which is included in its Park budget. County does not charge for employee parking at Marine Stadium site; their potential gross revenues for parking would be only $105,600. Operated expenses are estimates provided by Miami -Dade County and includes bus service to shuttle individuals to the tennis center. The County does not track this event as a cost center. Therefore, actual revenue and expenses for this event are not available. 02- 62
