' 9 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTH (4/5T11) AFFIRMATIVE VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND ACCEPTING THE OCTOBER 12, 2001 BID OF T. J. PAVEMENT CORPORATION, THE LOWEST, RESPONSIVE AND RESPONSIBLE BIDDER, FOR THE PROJECT ENTITLED "CITYWIDE LOCAL DRAINAGE PROJECT E-76, B-56471', IN THE REVISED AMOUNT OF $381,846; ALLOCATING FUNDS FROM PROJECT NO. 352231, AS APPROPRIATED BY THE ANNUAL APPROPRIATIONS AND CAPITAL IMPROVEMENT PROJECTS ORDINANCES, AS AMENDED, IN THE AMOUNT OF $381,846 FOR THE CONTRACT COSTS AND $50,354 FOR EXPENSES, FOR AN ESTIMATED TOTAL COST OF $432,200; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. N BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four -fifth (4/5tns) affirmative vote of the City Commission, after a duly advertised public hearing, the CI7°Y r,OH,I'FISSION City Manager's finding of an emergency is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived and the October 12, 2001 bid of T. J. Pavement Corporation, the lowest responsive and responsible bidder, for the project entitled "Citywide Local Drainage Project N-76, B-5647", in the amount of $381,846, for the total bid of the proposal, is accepted. Section 2. The total estimated project costs of $432,200 are allocated from Project No. 352231, as appropriated by the Annual Appropriations and Capital Improvement Projects Ordinances, as amended. Total project costs consist of $381,846 for contract costs and $50,354 for estimated expenses incurred by the City. Section 3. The City Manager is authorized!' to execute an agreement, in a form acceptable to the City Attorney, with T. J. Pavement Corporation for the project. ii The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Bid Procedures for CITYWIDE LOCAL DRAINAGE PROJECT ENCLOSURES: E-76, B-5647 It is respectfully recommended that the City Commission adopt the attached Resolution ratifying, approving and confirming the City Manager's finding of an Emergency, waiving the requirements of competitive sealed bidding procedures, and awarding a Contract to T. J. PAVEMENT CORPORATION, for the project entitled CITYWIDE LOCAL DRAINAGE PROJECT E-76, B-5647, BACKGROUND As a result of severe rainstorms, the City experienced stormwater flooding at different localized sites. The magnitude of the work exceeds the construction capability of the Public works Operations Division and the services of a private contractor were needed.. In order to initiate this drainage construction as soon as possible, informal bids were obtained with a contract awarded to the lowest responsive and responsible bidder. All costs for this project will be funded from CIP Project No. 352231. The magnitude of the work exceeds the construction capability of the Public Works Operations Division and the services of a private contractor are needed. Memo August 16, 2001 Because of the severe flooding at these locations, there is a need for extraordinary measures to install adequate storm drainage systems. In order to initiate the construction of the new stormwater drainage systems as soon as possible, formal competitive sealed bid procedures shall be waived for the procurement of contracting services required for said EMERGENCY pursuant to sections 18-83 and 18-84 of the City Code. Informal bids shall be obtained and a contract shall be awarded to the lowest responsive and qualified bidder. All costs of this project will be funded from the CIP No. 352231.
