A RESOLUTION OF THE MIAMI CITY COMMISSION, BY
A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE VOTE, AFTER
A DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING THAT COMPETITIVE BIDDING PROCEDURES
WOULD NOT BE PRACTICABLE OR ADVANTAGEOUS,
WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE
PROCUREMENT OF CHLORINATING BRIQUETTE TABLETS
FOR THE DEPARTMENT OF PARKS AND RECREATION
FROM COMMERCIAL ENERGY SPECIALISTS, INC., TN
AN ANNUAL AMOUNT NOT TO EXCEED $32,000;
ALLOCATING FUNDS FROM PARKS AND RECREATION
GENERAL OPERATING BUDGET, ACCOUNT CODE
NO. 001000.580301.6.704.
WHEREAS, the Department of Parks and Recreation recently
purchased and installed ten US Filter/Stranco automatic pool
water treatment systems from Commercial Energy Specialists,
Inc., the sole manufacturer and distributor for this system; and
WHEREAS, the system requires chlorinating briquette tablets
for the treatment of pool water and Commercial. Energy
Specialists, Inc. can provide, as the sole distributor, the
chlorinating briquette tablets required for the eight pools

currently using the Pulsar system at a lower price than other
competitors; and
WHEREAS, Commercial Energy Specialists, Inc. also provides
a "Chem Plus" water control program, which includes free water
testing, loaners and a preferred service status on the use of
this product; and
WHEREAS, it is practicable and advantageous to waive
competitive sealed bidding procedures and approve the
procurement of chlorinating briquette tablets from Commercial
Energy Specialists, Inc., in an annual amount not to exceed
$32,000; and
WHEREAS, funds are available from Parks and Recreation
General Operating Budget, Account Code No. 001000.580301.6.704.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5t"') affirmation vote of
the City Commission, after a duly advertised pubic hearing, the
City Manager's finding that competitive sealed bidding
procedures would not be practicable or advantageous is ratified,
approved and confirmed, the requirements for competitive sealed

bidding procedures is waived, and the procurement of
chlorinating briquette tablets for the Department of Parks and
Recreation from Commercial Energy Specialists, Inc., in an
annual amount not to exceed $32,000, is approved, with funds
allocated from Parks and Recreation General Operating Budget,
Account Code No. 001000.580301.6.704.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.1/

at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

Resolution Authorizing the
Waiver of Sealed Bids
For the Purchase of Chlorine
Tablets for City Park Pools
It is respectfully recommended that the City Commission adopt
the attached Resolution, by a four-fifths (4/5ths) affirmative
vote of the members of the City Commission, after a duly
advertised public hearing, ratifying, approving and confirming
the City Manager's request for waiving the requirements for
competitive sealed bids and authorizing the procurement of
chlorinating briquette tablets for the water treatment of
eight (8) City park pools, from Commercial Energy specialists,
Inc. (CES) in the estimated annual amount of $32,000, with
funds from the Parks and Recreation Department General
Operating Budget, Account Code No. 001000.560301.6.704.
BACKGROUND:
On April 27, 1999 the City Commission passed Resolution No.
99-262, approving and confirming the City Manager's finding of
a sole service and approving the waiver of competitive bids
and authorizing the purchase and installation of ten (10) U.S.
Filters/Stranco automatic pool water treatment systems from
Commercial Energy Specialists, Inc., the sole manufacturer and
distributor of such a system. This new system requires the
use of chlorinating briquette tablets.
On July 13, 1999 the City Commission adopted Resolution No.
99-493 authorizing the purchase of said chlorinating briquette
tablets from Commercial Energy Specialists, Inc. on an
emergency basis before the opening of the pools for the Summer
season.

The Parks and Recreation Department recommends the purchase of
the chlorinating briquettes in the annual amount of $32,000
from Commercial Energy Specialists, Inc. As its sole
distributor, CES can provide the City this product at a lower
cost than the competition. In addition, CES includes the
"Chem -Plus" program, which provides free testing of water,
free equipment loaners, no -cost replacement of parts on its
water treatment systems and other warranties not available
from other vendors.
Funding in the annual amount of $32,000 is available from the
Parks and Recreation's General Operating Budget, Account Code
No. 001000.580301.G.704.

The Department of Parks and Recreation requests your authorization to waive
competitive sealed bids for the purchase of chlorinating briquette tablets from
Commercial Energy Specialists, Inc., "CES" in the estimated annual amount of $32,000.
The Department recently purchased and installed (10) US Filter/Stranco automated pool
water treatment systems for its park pools. These systems were purchased from the
sole manufacturer and distributor, CES.
These particular water treatment systems use chlorinating briquette tablets that can be
provided by CES. As its sole distributor, CES can offer a lower price than the
competition. In addition, CES includes a special warranty program for free water
testing, free loaner of equipment and other premiums not available from other vendors.
The City needs to purchase these tablets to operate the eight (8) City park pools
currently using briquettes for the system. Accordingly, we are requesting your approval
to purchase the products from CES to take advantage of the product warranty and, to
obtain the lowest possible cost in the market for this item.
