FOR REPRESENTATION OF OFFICER AGUSTIN CLEMENTE IN THE CASE OF ANGEL ALVAREZ VS. CITY OF MIAMI, ET AL. IN THE U.S. DISTRICT COURT FOR THE SOUTHERN DISTRICT OF FLORIDA, CASE NO. 00 -2151 -CIV -JORDAN, IN THE AMOUNT OF $25,000 PLUS COSTS AS APPROVED BY THE CITY ATTORNEY; ALLOCATING FUNDS FROM THE SELF-INSURANCE AND INSURANCE TRUST FUND, ACCOUNT CODE NO. 515001.624401.6.652, FOR SAID SERVICES. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The engagement of the law firm of Ronald J. Cohen, P.A. for representation of Officer Agustin Clemente in the case of Angel Alvarez vs. City of Miami, et al. in the U.S. District Court for the Southern District of Florida, Case No. 01 -2151 -CIV -JORDAN, in the amount of $25,000 plus costs as approved by the City Attorney, is authorized, with funds allocated from the Self -Insurance and Insurance Trust Fund, Account Code No. 515001.624401.6.652, for said services. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. Cohen, P.A., for representation of Police Officer Agustin Clemente in the case of Angel Alvarez vs. City of Miami, et al., in the U.S. District Court for the Southern District of Florida, Case No. 00 -2151 -Civ -Jordan (J-02-051). The attached proposed Resolution seeks authorization for the engagement of the law firm of Ronald J. Cohen, P.A., for representation of Police Officer Agustin Clemente in the case of Angel Alvarez vs. City of Miami, et al., pending in the U.S. District Court for the Southern District of Florida, Case No. 00 -2151 -Civ -Jordan, in the amount of $25,000 plus costs as approved by the City Attorney. As a result of the conclusion of an Miami Police Department Internal Affairs investigation into the allegations of the complaint by Angel Alvarez against the City of Miami (reached well after the City Attorney assumed the representation of both the City and the Officer in this case), a conflict of interest has arisen which prohibits the City Attorney's Office from further representation of any defendant in this lawsuit, including the City. The motion to withdraw from the representation of both the City and Officer Clemente has been granted by the Court.
