HomeMy WebLinkAboutO-12307J-02-949 11/7/0.2 E7 ORDINANCE NO.' 12307 AN AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING CHAPTER 14/ ARTICLE II/ DIVISION 1 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "DOWNTOWN DEVELOPMENT/DOWNTOWN DISTRICT/GENERALLY," BY REPEALING SECTION 14-27 IN ITS ENTIRETY AND SUBSTITUTING IN LIEU THEREOF NEW SECTION 14-27 TO SET FORTH NEW BOUNDARIES FOR THE DOWNTOWN DEVELOPMENT AUTHORITY ("DDA") DISTRICT, WHICH SHALL CONSIST OF THE TERRITORY AS ISET FORTH IN "ATTACHMENT A" (THE EXISTING TERRITORY) AND EXPANDED TERRITORY AS SET FORTH IN ATTACHMENT "B," THEREBY ESTABLISHING NEW DDA DISTRICT BOUNDARIES; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 65-1090, Laws of Florida, the City of Miami created the Downtown Development Authority (the "DDA") and established the territory described in "Attachment A", attached and incorporated, as the boundaries (the "DDA District") within which the Authority may exercise its powers; and WHEREAS, the Board of Directors of the DDA and the City Commission find that the inclusion of the territory described in "Attachment B," attached and incorporated, in the DDA District will revitalize and preserve property values in the DDA District and its surrounding areas and such expansion is in the best ' "opin 7,�A,.� Piz L� 1 C 9 K 1 ul la h X230'7 interest of the City of Miami, and most particularly, the DDA; and WHEREAS, pursuant to §166.0497, Florida Statutes (2002), the City Commission by the adoption of Resolution No. 02-1054 on September 26, 2002, declared its intent to expand the boundaries of the DDA District to include the territory described in "Exhibit B" of said Resolution, and set November 19, 2002, as the date for the public hearing for consideration of the adoption of the ordinance for the expansion of the DDA District; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and are incorporated as if fully set forth in this Section. Section 2. Chapter 14, Article II, Division 1, of the Code of the City of Miami, Florida, as amended, entitled "Downtown Development, Downtown District, Generally" is further amended by repealing Section 14-27 in its entirety. Section 3. Chapter 14, Article II, Division 1, of the Code of the City of Miami, Florida, as amended, is further amended by substituting new Section 14-27 as set forth herein in said Code, thereby establishing the boundaries for the DDA District as follows: "CHAPTER 14 DOWNTOWN DEVELOPMENT Page 2 of 8 12307 4 ARTICLE II. Division 1 t DOWNTOWN DISTRICT Generally Sec. 14-27. Boundaries designated. The downtown district described as follows shall be under the jurisdiction and control of the downtown development authority: Begin at the intersection of the centerline of N.W. Fifth Street and N.W. Third Avenue (east side of N -S Expressway (I-95)), thence run southerly along the centerline of N.W. Third Avenue and the easterly side of N -S Expressway to the centerline of West Flagler Street; thence westerly along the centerline of said West Flagler Street to the centerline of the Miami River; thence meandering southeasterly along the centerline of said Miami River to a point of intersection with the easterly right-of-way line of Metro Rapid Transit right-of- way (formerly Florida East Coast (FEC) Railroad right-of-way) said right-of-way line being 50 feet easterly of and parallel with the centerline of said Metro Rapid Transit right-of-way; thence run southerly and southwesterly along said easterly right-of-way line of Metro Rapid Transit to the intersection with the centerline of S.W. 15th Road; thence southeasterly along the centerline of 15th Road to a point of intersection with the southerly prolongation of the westerly line of Costa Bella 'Development Subdivision (107-14); thence northeasterly, northwesterly and northeasterly along said westerly line of Costa Bella to the intersection with the southerly right-of-way line of S.E. 14th Lane; thence southeasterly, northeasterly, northerly, and northwesterly along said southerly and easterly right-of-way line of S.E. 14th Lane and S.E. 14th Terrace to the intersection with the northwesterly property line of lot 31, block 2 of amended plat of Point View as recorded in plat book 2 at page 93 of the public records of Dade County, Florida; thence northeasterly along the northwesterly line of said lot 31, to the northeasterly side of the existing ten -foot alley in block 2 of said Point View; thence southeasterly along the northeasterly side of said ten -foot alley to the intersection with the property line between lots 4 and 5 of Page 3 of 8 12307 a 0 said block 2 of Point View; thence northeasterly along said line of lots 4 and 5 and its prolongation thereof to the centerline of S.E. 14th Street; thence southeasterly along 'said centerline of S.E. 14th Street to a point of intersection with the existing bulkhead and shoreline of Biscayne Bay; thence meandering northerly along the existing bulkhead and shoreline of Biscayne Bay to a point of intersection with the southerly boundary of Claughton Island Bridge; thence easterly along the said southerly right-of-way line of Claughton Island Bridge to the intersection with the westerly bulkhead line of Claughton Island, said bulkhead line being part of the Metropolitan Dade County bulkhead line as recorded in plat book 73 at page 18 of the public records; thence southerly, easterly, northerly and westerly, following said existing bulkhead and its westerly prolongation thereof around the island to the intersection with the mainland on the easterly shoreline of Biscayne Bay; thence meandering in a northwesterly and westerly direction along the shoreline of Biscayne Bay and the Miami River to the intersection with the easterly right-of-way line of Brickell Avenue Bridge (S.E. The Resolution also seeks to formalize the expansion of the DDA's boundaries to include the property located at 17th Street and Bayshore Drive, which was approved, in principle by the Commission at the meeting of September 14, 2000. Additionally, the resolution corrects a scrivener's error in the legal description of the DDA's boundaries, as it currently appears in the Code. BACKGROUND Flagstone Properties, LLC, the intended developer of the Mega Yacht Marina and Mixed Use Destination, requested that the DDA board consider expanding the district boundaries to include the development site on the Northwest Quadrant of Watson Island. The DDA board approved the expansion by resolution No. 31/02 on April 19t`, 2002. The item was heard by the Commission on September 26, 2002 and scheduled at that time for a public hearing pursuant to the Florida Statute governing the DDA. FISCAL IMPACT This will have no fiscal impact on the budget. Secretary to the Board of Directors 47 Alonso Menendez Interim E Y.- —2 +;- �.; -- 2 0 Attachment A CONDITIONS FOR DDA RESOLUTION NO. 31/02 SUPPORTING THE EXPANSION OF THE DDA DISTRICT TO INCLUDE THE NORTHWEST QUADRANT OF WATSON ISLAND Flagstone Properties, LLC ("Flagstone") will pay all reasonable and necessary costs and fees incurred by the DDA for the retention of professional personnel and/or expert consultants to review and evaluate the notice of proposed change (NOPC) and any and all studies submitted as part of the NOPC including but not limited to traffic studies. In addition, Flagstone will pay all agency review fees related to the NOPC. 2. Flagstone shall enter into a contract with DDA prior to filing the NOPC, in which Flagstone formally agrees to pay the fees and costs charged by DDA's consultants for reviewing and evaluating the NOPC filed by Flagstone, together with any and all studies submitted as part of the NOPC, such as a traffic study. DDA shall obtain proposals from its consultants for such additional review services and such proposals shall be attached to and incorporated by reference into such agreement. 3. If, as a result of the filing of the NOPC to include Island Gardens under Increment I, either the City of Miami or the applicable review agencies impose additional conditions on the DRI Development Order for Increment I, or the proposed DRI Development Order for Increment H, Flagstone shall be responsible for (a) the payment of any such additional costs assessed against either Increment I or Increment H, and (b) the performance of any such additional mitigation conditions imposed upon Increment I or Increment II. Flagstone may challenge any such assessment or condition relating to such additional impacts directly to the applicable review agencies. Should Flagstone wish to challenge a decision of the DDA/DRI committee that Flagstone is responsible for either (a) or (b) above, as it relates to Increment H only, then Flagstone may request a review by the DDA Board of Directors in accordance with the review process outlined in paragraph 8 below. 4. Prior to May 11, 2002, Flagstone shall not meet with staff from the South Florida Regional Planning Council (SFRPC) or the Department of Community Affairs (DCA) to discuss thadsland Gardens project. 5. Subsequent to May 10, 2002, DDA authorizes Flagstone to meet with staff from the SFRPC and DCA to explore the viability of filing the NOPC for Island Gardens as a non - substantial change to Increment I. After the last of the two meetings, and as a result of same, Flagstone and DDA will have a period of ten (10) days to make a written determination that the NOPC should not be filed because (a) it is not feasible, (b) the filing of the NOPC will jeopardize the review and approval of Increment II, or (c) it will cause the agencies to impose unacceptable conditions on Increment U. If it is determined by either party within that ten (10) day period that the NOPC should not be filed, Flagstone will no longer pursue the boundary change and DDA will refrain from scheduling and/or withdraw this Resolution as an agenda item before the City Commission. In the event of a dispute between Flagstone and the DDA/DRI committee or DDA's consultants regarding such determination, Flagstone may request consent from the DDA Board of Directors for the filing or continued processing of the NOPC, and such consent shall not be unreasonably withheld. The request for consent shall be scheduled for consideration by DDA at its next available Board of j)irPrt,. m;,-"4 6. In the event neither party determines that the NOPC should not be filed by the end of the ten (10) day period, Flagstone, in consultation with - DDA, will proceed with tie preparation of the &OPC. DDA shall not be obligated to file and process the NOPC until the earlier to occur of (i) the date that the proposed DRI Development Order for Increment II is approved; or (ii) October 30, 2002. 7. Flagstone's consultants and DDA's consultants shall work together in the preparation of the NOPC in order to insure mutual agreement regarding the underlying assumptions utilized in the technical portion of the application. Upon Flagstone's submission of the final draft of the NOPC to the DDA, which will incorporate all mutually agreed up= technical data, DDA will have twenty (20) days after receipt to provide comments. If DDA has no comments, the NOPC shall be filed immediately. If DDA submits fnai comments, after making any changes acceptable to Flagstone and DDA, the NOPC wild be resubmitted to DDA- and shall be filed within ten (10) days of receipt. Flagstone expressly acknowledges and agrees that DDA will not be required to file the NOPC unless all changes acceptable to Flagstone -and DDA have been incorporated into the NOPC. The procedure for mutual cooperation between Flagstone's consultants and DDA's consultants set forth in this paragraph shall also be applied to any amendments to the NOPC after filing of same. In the event of a dispute between Flagstone and the DDA/DRI committee regarding either the final draft of the NOPC, or any amendment thereto, Flagstone may request a review by the DDA Board of Directors in accordance with the review process outlined in paragraph 8 below. 8. DDA reserves the right not to authorize filing of the NOPC to include Island Gardens under Increment I, if at any time up to July 15, 2002, DDA determines that such filing (a) will jeopardize or unreasonably delay the approval of Increment II, or (b) shall result iT unreasonable additional mitigation conditions being imposed upon Increment II. In the event of a dispute regarding ar'y decision between Flagstone and the DDAJDRI committee or DDA's consultants under any provision of this agreement, Flagstone may request consent from, or review by, the DDA Board of Directors for the filing or continued processing of the NOPC, and such approval shall not be unreasonably withheld. The request for consent shall be scheduled for consideration by DDA at its next available Board of Directors meeting. In the event DDA has not issued the written determination outlined in (a) or (b) above by July 15, 2002, DDA shall proceed with the _ scheduling of this Resolution for consideration by the City Commission and shall thereafter proceed with the filing of the. de ahi, seguir la direcci6n norte de la barrera maritimay orilla de la Bahia de Biscayne hasty el punto de intersecci6n con el lindero sur del Puente de la Isla Claughton; de ahi at este por la linea de derecho de via sur del mencionado Puente de la Isla Claughton haste la inter- secci6n con la linea oeste de la barrera maritima de la Isla Claughton, dicha linea de la bar- rera maritima es parte de la linea de la barrera maritima del Condado Metropolitano de Dade, tal y como este registrado en el libro de planos 73, pagina 18 de los archivos p6blicos; de ahi at sur, este, norte y oeste, siguiendo la linea de dicha barrera maritima y su proton - gaci6n occidental alrededor de la isla hasta Ilegar a la intersecci6n con tierra forme en la costa este de la Bahia de Biscayne; de ahi seguir en direcci6n noroeste y oeste por toda la orilla de la Bahia de Biscayne y el Rio Miami hasty la intersecci6n con la linea este de der - echo de via del Puente de la Avenida Brickell (Segunda Avenida del S.E.); de ahi at norte por todo dicho puente hasta la barrera maritima en la orilla norte del Rio miami, dicha bar- rera maritima es tambi6n el lindero sur de la propiedad dei Dupont Plaza Center y del Miami Center Joint Venture; de ahi proseguir at noreste por todo el limite meridional de la propiedad del Dupont Plaza center, y del Miami Center Joint Venture al punto de intersecci6n con el lindero oriental de la propiedad de Chopin Associates y Miami Center Limited Part- nerships, dicho lindero de esta propiedad va por toda la orilla de la Bahia de Biscayne; de ahi hacia el norte por todo el lindero oriental de lapropiedad de Chopin Associates y Miami Center Limited Partnerships por toda la Bahia de Biscayne hasta el lindero meridional del Parque Bayfront; de ahi continuar at none, noreste y noroeste por toda la barrera maritima del Parque Bayfront y el Fondeadero del Parque Bayfront (Bayfront Park Miamarina) hasta Ilegar at punto de intersecci6n con la linea meridional de derecho de via de la Carretera Estatal A-1 -A (Calzada Douglas Macarthur)); de ahi proseguir en direcci6n este por todo el derecho de via meridional de la Calzada Douglas Macarthur haste su intersecci6n con la linea oriental de derecho de via de to Intercoastal Waterway, dicho punto de intersecci6n es tanl la linea occidental de la parcela de tierra sumergida del cuadrante N.O. de la Isla Watson, tal y como se destaca en el reconocimiento y levantamiento de Ia parcela del cuadrante N.O. en sus partes sumergidas y en tierra firme (Ciudad de Miami, archivo mis- celaneo #61-398); de ahi en direcci6n sur por toda la linea oriental de derecho de via de la mencionada Intracoastal Waterway hasta el punto de intersecci6n del limite de la cuenca de virajes con la linea septentrional del canal principal para buques de Miami, dicho punto se encuentra a aproximadamente 500 pies de la linea oeste de la barrera maritima de la Isla Watson y a 1200 pies de la linea meridional de derecho de via de la Calzada Douglas Macarthur, de acuerdo at O.R.B. #2454, paginas 77-79; de ahi at noreste, sureste y noreste por toda la linea sureste de dicho cuadrante N.O. de la Isla Watson hasta Ilegar a la punta mas oriental del mencionado cuadrante N.O. de la Isla Watson, dicho cuadrante este en la linea suroeste de derecho de via de la Calzada Douglas Macarthur; de ahi at noroeste y oeste por toda la mencionada linea de derecho de via hasta Ilegar a la punta noroeste de . dicho cuadrante N.O. de la Isla Watson; de ahi hacia el oeste por toda la linea meridional de derecho de via de la Carretera Estatal A-1 -A (Calzada Douglas Macarthur) hasta linea de la barrera maritima de la Bahia de Biscayne; de ahi proseguir hacia el norte por toda la linea de la barrera maritima de la Bahia de Biscayne hasta Ilegar at punto de intersecci6n con la linea central divisoria de la 17 Calle del N.E. extendida hacia el este; de ahi hacia el oeste por toda la linea central divisoria de la 17 Calle del N.E. y su extensi6n hasty Ilegar at punto de intersecci6n con la linea central divisoria de North Bayshore Drive; de ahi seguir hacia el norte por toda la linea central divisoria de North Bayshore Drive hasta su intersec- ci6n con la linea central divisoria de la 17 Terrace dei N.E.; de ahi seguir adelante en direc- ci6n noroeste por toda la linea central divisoria de la 17 Terrace del N.E. hasta su intersecci6n con la extensi6n suroeste del lindero de propiedad del tote 2, bloque 1 de Sea- port, tat y como este registrado en el libro de planos 149 en la 79 de los archivos publicos del Condado de Dade, Florida; de ahi proseguir at noreste por todo el mencionado lindero del tote 2 y su extensi6n at suroeste hasta Ilegar a la esquina del tote 1 del bloque 1 del mencionado Seaport (149-79); de ahi proseguir hacia el sureste y este por toda la linea meridional del mencionado tote 1 y su extensi6n oriental hasta Ilegar a su intersecci6n con la linea central divisoria de North Bayshore Drive; de ahi hacia el noreste por toda la linea central divisoria de North Bayshore Drive basta su intersecci6n con la extension meridional del lindero norte de dicho tote 1 del bloque 1 del mencionado Seaport (140-79); de ahi seguir en direcci6n noroeste por toda la linea norte del mencionado tote y su extensi6n meridional hasta la esquina noroeste del propio tote 1; de ahi proseguir hacia el noroeste, atravesando un callej6n de 10 pies de ancho para Ilegar a la esquina noreste del tote 6 del bloque 8 de Miramar, enmendado tal y como este registrado en el libro de pianos 5 en la pagina 4 de los archivos pOblicos del Condado Dade, Florida; de ahi proseguir hacia el noro- este por todo el lindero septentrional del mencionado tote 6 y su extensi6n noroccidental hasta Ilegar a la linea central divisoria de la Calle Sevilla (4ta Avenida del N.E.) de Miramar .enmendado, tal y como se habia mencionado (5-4); de ahi proseguir hacia el suroeste por toda to linea central divisoria de la citada Calle Sevilla (4ta Avenida del N. E.) hasta su inter- secci6n con la linea central divisoria de la Calle Vedado (4ta Avenida del N.E.) del anterior- mente citado Miramar enmendado (5-4); de ahi seguir hacia el norte por toda la linea central divisoria de la 4ta Avenida del N.E. (Calle Vedado) hasta su intersecci6n con la linea central divisoria de la Calle 19 del N.E.; de ahi proseguir en direcci6n oeste por toda la linea central divisoria de la Calle 19 del N.E. hasta su punto de intersecci6n corn la extensi6n meridional dei lindero oriental del tote 44 del bloque 1 de Miramar, enmendado y registrado en el libro de planos 5 en la p gina 4 de los archivos p6blicos del Condado Dade, Florida; de ahi seguir hacia el norte por todo el lindero meridiohal del tote 4 y su extensi6n hasta el lindero meridional del tote 8 de Coral Park, tal y como este registrado en el libro de planos 2 en la pagina 66 de los archivos pOblicos del condado Dade, Florida; de ahi proseguir hacia el este por todo el lindero meridional del tote 8 hasta to esquina suroriental de dicho tote 8; de ahi hacia el norte por todo el lindero oriental del tote 8 hasta la linea de derecho de via de la Calle 20 del N.E.; de ahi en direcci6n oriental por toda la linea meridional de derecho de via de la Calle 20 del N.E. hasta la extensi6n meridional del lindero oriental del tote 7 del mencionado Coral Park (2-66); de ahi proseguir hacia el norte por todo el lindero oriental del tote 7 y su extensi6n hasta la esquina noreste del tote 7; de ahi en direcci6n occidental por todo el lindero septrentrional del tote 7 hasta el punto de intersecci6n con la extensi6n meridional del lindero oriental del tote 7 del bloque 4 de Bayside Park, enmendado y regis- trado en el libro de planos 2, en to pagina 40 de los archivos p6blicos del Condado Dade, Florida; de ahi proseguir hacia el norte por el lindero oriental del tote 7y su extensi6n atrave- sando un callej6n de 15 pies de ancho hasta la esquina noreste del late 7; de ahi proseguir hacia el norte, atravesando et derecho de via de la 20 Terrace del N.E. hasta la esquina sur oriental del tote 7 del bloque 1 de Bayside park, enmendado (2-40); de ahi continuar en direcci6n norte por todo el lindero oriental del tote 7 hasta la esquina noreste de dicho tote 7; de ahi se atraviesa un callej6n de 15 pies de ancho hasta la esquina sureste del tote 5, bloque 3 de la Subdivisi6n Bayonne, tal y como fuera registrado en el libro de planos 2, en la pagina 35 de los archivos p6blicos del Condado Dade, Florida; de ahi proseguir en direc- ci6n norte por todo el lindero oriental del tote 5 y la extension septentrional de su lindero oriental hasta Ilegar a la linea central divisoria de la Calle 21 del N.E.; de ahi seguir hacia et este por toda la linea central divisoria de la Calle 21 del N.E. a su punto de intersecci6n con la extensi6n meridional del lindero oriental del tote 3, bloque 1 de la Subdivisi6n Bay- onne (2-35); de ahi proseguir hacia el norte por todo el lindero oriental y su extensi6n, hasta Ilegar at lindero meridional del terreno A de la Subdivisi6n Caruso tal y como se encuentra registrada en el libro de planos 79, en la pagina 23 de los archivos p6blicos del Condado Dade, Florida; de ahi hacia et este por todo el lindero meridional del terreno A hasta la exten- si6n meridional de la linea oriental de derecho de via de la Cuarta Avenida del N. E.; de ahi proseguir at none por toda la linea oriental de derecho de via de la Cuarta Avenida y su extensi6n hasta la linea central divisoria de la Calle 24 del N.E.; de ahi proseguir hacia occi- dente por toda la linea central divisoria de la Calle 24 del N.E. hasta la linea central divisoria de la Segunda Avenida del N.E.; de ahi seguir hacia el sur por toda la tinea central divisoria de to segunda Avenida del N.E. hasta Ilegar a la linea central divisoria de la Calle 17 del N.E.; de ahi seguir at oeste por toda la linea central divisoria de la Calle 17 del N.E.; y la Calle 17 del N.O. hasta Ilegar a la linea oriental de derecho de via del Ferrocarril FEC; de ahi al sur por toda la linea oriental de derecho de via del Ferrocarril FEC hasta la linea cen- tral divisoria de la Calle Quinta del N.O. para proseguir con rumbo occidental por toda la linea central divisoria de la Calle Quinta del N.O. nasta el punto de partida. Por este medio se les invita a todas las personas interesadas a que asistan a esta Audiencia Publica donde podran tener la oportunidad de que se les escuche en to referente a esta Ordenanza.
