HomeMy WebLinkAboutO-12294J-02-886 10/18/02 - ORDINANCE NO. 12294 AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED "ANTI -TERRORISM GRANT AWARD (FY `2001)", CONSISTING OF A GRANT IN THE AMOUNT OF $100,0.00, FROM THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS OFFICE OF EMERGENCY MANAGEMENT, FOR THE PROVISION OF ANTI- TERRORISM TRAINING FOR THE DEPARTMENT OF FIRE -RESCUE, IN ACCORDANCE WITH THE TERRORISM RESPONSE PLAN; AUTHORIZING THE CITY 'MANAGER TO ACCEPT SAID GRANT AND TO EXECUTE, THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE, CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Revenue Fund entitled "Anti -Terrorism Grant Award" is established and resources are appropriated as described below: FUND TITLE: Anti -Terrorism Grant Award Fiscal Year (2001) Fund RESOURCES: Miami -Dade County Board of County $100,000 Commissioners through the Office of Emergency Management APPROPRIATIONS: $100,000 12294. Section 2. The City Manager is authorized" to accept a grant, in the amount of $100,000, from the Miami -Dade County Board of County Commissioners Office of Emergency Management, for the provision of anti -terrorism training for the Department of Fire Rescue, in accordance with the Terrorism Response Plan; and to execute the necessary document(s), in a form acceptable to the City Attorney. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty days after final reading and adoption.2/ 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2/ This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is` later. REFERE`,CE5. ::-CLOS:_..ES, 15 OVT — 8 2,,02 FILE: FM-092.doc Establish a Special Revenue Fund Entitled "Anti -Terrorism Grant Award " Ordinance It is respectfully recommended that the City Commission adopt the attached Ordinance establishing a special revenue fund entitled "Anti -Terrorism Grant Award (FY 2001), and appropriating funds in the amount of $100,000, consisting of a grant from the Miami -Dade County Board of County Commissioners through the Office of Emergency Management. Said grant will be used by the Department of Fire -Rescue to provide anti -terrorism training specific to the department's need, and in accordance with the Terrorism Response Plan. BACKGROUND On September 20, 2001, the Miami -Dade County Board of County Commissioners allocated $1 million in funding for anti -terrorism training for Miami -Dade County Police and the six (6) fire jurisdictions within Miami -Dade County. A grant in the total amount of $100,000 has been awarded to the City of Miami from the Miami -Dade County Board of County Commissioners through the Office of Emergency Management to provide anti -terrorism training to the Department of Fire -Rescue personnel as specified in the Grant Application. Specifically, the City will use these funds as stipulated by the grant, for the purchase of contractual personnel, training, equipment, and indirect charges for said anti -terrorism training. It is now appropriate to accept said grant award, establish a special revenue fund, and appropriate the $100,000 grant award therein for this fiscal year. The BCC determined that the money would come through the Office of Emergency Management (OEM) to ensure training compliant with the Terrorism Response Annex of the Miami -Dade County Comprehensive Emergency Management Plan (CEMP). This letter serves as an invitation to Miami Fire Rescue Department to seek a portion of these funds in the form of a grant application to enable the department to provide training specific to its need, yet in accordance with the Terrorism Response Plan. The amount of money allocated to each department was based on the number of uniformed personnel and population served. A total of $400,000 is available to be allocated to the six (6) fire departments. Miami Fire Rescue Department will be eligible to receive a maximum grant of $100,000 to be used only for anti -terrorism training once the signed Terrorism Response Memorandum of Understanding (MOq between Miami Fire Rescue Department and the OEM is received in our office. A Terrorism Training Committee, with representation from each of the six (6) fire jurisdictions and the OEM, assisted in determining appropriate use of the $500,000 for training for fire departments. Initial steps involve three (3) separate 40 -hour Hazardous Materials courses and a Train -the -Trainer course for all departments on the OEM HazMat cache and call -out procedure. A countywide drill with all jurisdictions participating will be the culmination of this yearlong training initiative. Attached is a Letter of Intent for Miami Fire Rescue Department to sign and return to OEM by February 22, 2002 to .be eligible to apply for funds. OEM will send the grant application package and instructions on February 25, 2002 to the departments that respond and have a signed MOU on file with our office. Grant applications will be due back to OEM by March 22, 2002. Grant applications and instructions will be sent out on February 25, 2002 and due back to the Miami -Dade Office of Emergency Management by March 22, 2002. illiam Bryson, Chief City of Miami Fire Rescue Department Date igne RSCEIVF,D FEB 21 Z.00Z 12294 r MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding (MOU) is entered into by the Miami -Dade County Office of Emergency Management; the Miami -Dade Fire Rescue Department, the City of Miami Fire Rescue Department and the City of Hialeah Fire Rescue Department, the Miami Beach Fire Rescue Department, the Key Biscayne Fire Rescue Department, the Coral Gables Fire Rescue Department and the Homestead Air Reserve Base Fire Rescue Department to provide for a structured, unified and consistent response to incidents known or suspected of being associated with a terrorist attack within Miami -Dade County. The Miami -Dade Fire Alarm Office (MDFAO) shall function as the designated Terrorism Warning Point (TWP) in the Miami -Dade Terrorism Response System; _ I 2. Any and all incidents involving or suspected of involving threats or acts of terrorism are to be reported to the TWP; 3. The TWP will initiate a callout of the Terrorism Response System's tiered response in accordance with the Terrorism Response System Plan; 4. The on -scene commander shall be designated by the fire department with jurisdiction at the site of the incident; 5. The signatories commit to participate in the development and implementation of a training program and training schedule that supports the objectives of the Terrorism Response System Plan and to ensure that appropriate staff within each of the organizations receives the agreed upon training; 6. The signatories will be active members of the Terrorism Response System. As such, they will render assistance, in accordance with the Terrorism Response System Plan and commensurate with their attained training and equipment, when a suspected or confirmed act of terrorism/hazardous materials incident occurs in Miami -Dade County. 7. The signatories will participate in regular exercises designed to test county system -wide preparedness to handle hazardous or Nuclear, Biological or Chemical (NBC) agent incidents; Additionally, the Miami -Dade Fire Rescue Department, the City of Miami Fire Rescue Department and the City of Hialeah Fire Rescue Department agree to the following: 1. Deploy a HAZMAT Task Force to any confirmed terrorism incident as requested by the TWP; 2. The HAZMAT sector of a terrorism response shall be managed by a HAZMAT officer from the first arriving HAZMAT team until such time as command is transitioned to the HAZMAT team with jurisdiction in that area; Revised: 12/06/2001 0,9` y r I 3. Deployed HAZMAT Task Forces will cooperate with, support and report to the HAZMAT sector officer; and 4. . Assume responsibility for routine maintenance of all equipment assigned to them by the Miami -Dade Office of Emergency Management (OEM) in accordance with the manufacturer's instructions. The signatories agree to maintain all equipment in a state of readiness to respond. The OEM will coordinate the procurement of equipment with each of the signatories. To apply for funding under the OEM Grant Agreement, a department must meet the following threshold criteria: 1. A signed Terrorism Response Memorandum of Understanding (MOU) between the department and the OEM must be on file with the OEM. 2. The grant funds must be used for anti -terrorism training -for fire department personnel as outlined in the Grant Agreement. 3. The training must be in accordance with the Terrorism Response Annex of the Comprehensive Emergency Management Plan (CEMP). 4. A component of the training must address the Terrorism Tiered Response Dispatch Process as outlined in the Terrorism Response Plan. 5. The grant application must be completed on this form and the originals forwarded to the OEM by March 22, 2002.
