HomeMy WebLinkAboutO-12283J-02-861 9/25/02 ORDINANCE NO. 12283 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED "CHILD DAY CARE FOOD PROGRAM" AND APPROPRIATING AND AUTHORIZING THE EXPENDITURE OF FUNDS FOR THE OPERATION OF SAME IN THE ESTIMATED AMOUNT OF $100,135 CONSISTING OF A GRANT FROM THE FLORIDA DEPARTMENT OF EDUCATION; 'AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE- CITY ATTORNEY, FOR SAID PURPOSE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Department of Parks and Recreation Day Care Division of the City of Miami sponsors a year-round food service program for preschool age children which provides nutritional meals as a part of its child day care services programs; and WHEREAS, the Florida Department of Education, Bureau of Child Nutrition Program, as funded by the United States Department of Agriculture ("USDA"), grants funds to conduct a food service program from October 1, 2002 through September 30, 2003 for children up to the age of 18; and 1228` ,= WHEREAS, this grant in the estimated amount of $100,135 is based on Year 2002 figures and reimbursement rates for approximately 25,742 meals ($1.17 for each breakfast, $2.14 for each lunch, and $.58 for each afternoon supplement); NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following Special Revenue Fund is established and resources are appropriated as described: FUND TITLE: Child Day Care Food Program RESOURCES: Florida Department of Education (as funded by the U.S. Department of Agriculture) $100,135 APPROPRIATIONS: $100,135 Section 3. This appropriation is contingent upon the approval by the Florida Department of Education of the City's application for the grant and the City Manager's acceptance. Page 2 of 5 12283 Section 4. The City Manager is authorizedl� to accept the grant from the Florida Department of Education, Bureau of Child Nutrition Program, and to execute all the necessary documents, in a form acceptable to the City Attorney, for acceptance of said grant. Section 5. The expenditure of the grant funds is authorized for the operation of the program: Section 6. The authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. Section 7. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 8. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 10. The requirements of reading this Ordinance on.two separate days is dispensed with an affirmative vote of not less that four-fifths of the members of the Commission. Section 11. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.2/ 2i If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
