This Ordinance is an ordinance of precedent and all other ordinances in conflict with it are held null and void insofar as they pertain to these appropriations; however, no provision contained in this Ordinance shall be construed to violate the Anti -Deficiency Act, as set forth in Sections 18- 500 through Sections 18-503 of the Code of the City of Miami, Florida, as amended. The appropriations are the anticipated expenditure requirements for the City, but are not mandatory should efficient administration of City Departments and Boards or altered economic conditions indicate that a curtailment in certain expenditures is necessary or desirable for the general welfare of the City. The City Manager is specifically authorized to transfer funds between accounts and withhold any of these appropriated funds from encumbrance or expenditure should such action appear advantageous to the economic and efficient operation of the City. The City Manager is also authorized to transfer any excess unrestricted moneys from 12279 other funds to the General Fund provided that those are appropriated moneys which are no longer needed to implement the original purpose of the appropriation and whose expenditure is not limited to use for any other specified purpose. Section 8. All departments and the number of employees designated therein provided for in this budget either by position summary or by the organizational chart are deemed approved by the City Commission. Any permanent change regarding same shall require City Commission approval. Section 9. The City Manager is authorized to administer the executive pay plan and benefit package, to disburse the funds appropriated herein for said purpose in a manner he deems appropriate. The City Manager is authorized to disburse any funds that may be designated by the City Commission as cost -of -living or other pay adjustments to Civil Service, executive and staff employees as may be approved by the City Manager. Section 11. Nothing contained in this Ordinance shall be construed as to prohibit or prevent the City Manager, the administrative head of the City of Miami, who is responsible for the efficient administration of all Departments, from exercising the power granted to and imposed upon him/her in the City Charter to fix, adjust, raise, or lower salaries, and to create, abolish, fill or hold vacant, temporary or permanent positions whenever it has been determined by the City Manager to be in the best interest of efficient and economical administration of the City of Miami and all its Departments. The authority contained in this Section shall also be applicable whenever the City Manager shall cause a Department to reorganize itself to perform its services more efficiently; such reorganization may include reduction of budgeted positions, reclassification of positions, and alteration of the number of budgeted positions in any given classification. Section 12. (a)(1) The transfer of funds between the detailed accounts comprising any separate amount appropriated by the above sections hereof is approved and authorized when such transfer shall have been made at the request of the City Manager and when such transfer shall have been made of any part of an unencumbered balance of an appropriation to or for a 12279 purpose or object for which the appropriation for the herein fiscal year has proved insufficient. (2) The transfer of funds between the detailed accounts comprising any separate amount appropriated by the above sections hereof is approved and authorized when such transfer of funds is made at the request of the City Manager and when such transfer is to be made between the detailed accounts appropriated to the same office, department, or division. (b) (1) To effect salary adjustments, the City Manager is further authorized to make departmental and other transfers from any reserve accounts established in the General Fund, and is authorized to approve transfers for any unforeseen requirements of all appropriated funds as may be required so long as such transfer is consistent with the provisions contained in Chapter 18, Article IX of the Code of the City of Miami, Florida, as amended. Section 13. (a) The City Manager is authorized to invite or advertise for bids for the purchase of any material, equipment, physical improvement, or service provided by the aforementioned appropriations or which may be provided for in accordance with the authority of Section 13, for which formal bidding is required; such bids to be returnable to the City Commission or City Manager in accordance with Charter or Code provisions. (b) Further, expenditure of the herein appropriated funds is authorized in the procurement of goods and services by award or contract for the same by the City Commission following the use, if applicable, of competitive negotiations unless the award of such contract by the City Manager is expressly allowed under City Code provisions. Gimenez City Manager ENCLOSURES: RECOMMENDATION It is respectfully requested that the City Commission adopt the attached ordinance establishing the proposed appropriations for the fiscal year ending September 30, 2003 ("FY03"). The General Fund budget for FY `03 is $375.2 million. The proposed budget for all funds totals $579.2 million. BACKGROUND The proposed appropriations ordinance reflects the City's continued ability to meet its financial obligations and comply with or, with respect to the level of designated General Fund reserves, continue the progress toward compliance with the City's Financial Integrity Ordinance: • Forecasted revenues and other resources equal budgeted expenditures, transfers and reserves. • Recurring revenues exceed recurring expenses. • Prescribed reserves are established. • Additional reserves are budgeted to address contingencies. Summary Comparison: FY02 Amended Budget to FY03 Proposed Budget FY °03 Proposed Fund Bud et FY `02 Amended Bud et Difference Change General Fund 375.2 366.4 8.8 2.41 Special Revenue Funds 162.8 209.1 46.3 22.1 Debt Service Funds 41.2 40.0 1.2 3.0 Total:$579.2 $ 615.5 36.3 5.9 r.Y ' 12279 General Fund Real and personal property taxes represent the most significant revenue source for the General Fund. The proposed millage rate was reduced by 1/10th of a mill from 8.995 to 8.895 mills. This operating millage rate will yield revenues of approximately $141.3 million in FY '03, for a $14.0 million increase over the prior year. Parking surcharge, which was not a component of the FY '02 Adopted Budget due to litigation, is budgeted at $12.4 million for FY '03. During the previous fiscal year, state legislation related to the Parking Surcharge was changed, which the City believes remedied the issues related to the prior litigation, therefore its appropriation is not inhibited. Due to the 'realization of the Communications Services Tax ("CST"), which is budgeted in FY '03 at $35.1 million, the City of Miami was able to effectively allocate local option gas tax revenue, previously utilized in the General Fund for allowable operating expenses, to fund street and sidewalk improvements in the Capital Fund. This change results in recurring funds of $7.0 million annually for transportation -related capital projects. It should be noted, however, that the local option gas tax allocation would need to be returned to the General Fund should the State of Florida impose a change to the current CST revenue levels being distributed to municipalities. For FY '03, the forecast for -nonrevenues reflects a fund balance rollover of approximately $14.9 million which includes the following; $8.6 million of FY '02 fund balance will be used to fund the City's required actuarial payment of $18.6 million, $1.5 million of Strategic Initiative Funds will be used for various efficiency studies, $4.3 million of Blue Ribbon Funds will be used for the funding of the IT Strategic Plan and $0.5 million from AT&T Settlement Funds will be used for City Hall capital improvements. Salary projections for FY '03 are based upon a total of 3,719 permanent positions, both filled and vacant. For all employees, except temporary personnel, a 3.6% cost of living increase is projected for October 2002, per union contracts. Additionally, a 5% step increase is assumed on an employee's anniversary date, where applicable. Attrition is budgeted at $4.0 million, which the City anticipates will occur as a result of normal employee turnover. One significant change for FY '03 is the creation of a Capital Improvements Office, which will coordinate all capital projects, specifically the new projects beginning as a result of the City's recent bond issuance. Twenty-seven positions from the Department of Public Works that worked directly on capital projects will now be managed under this office, along with five additional positions created and approved per Commission in FY '02.
