HomeMy WebLinkAboutO-12270J-02-807 8/22/02 ORDINANCE NO. 12270 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12128, AS AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 2002, TO REPROGRAM APPROPRIATIONS, IN THE AMOUNT OF $500,000, FROM CAPITAL IMPROVEMENT PROJECT NO. 311052, ENTITLED "GSA COMMUNICATIONS 800 MHZ RADIO SYSTEM", TO CAPITAL IMPROVEMENT PROJECT NO. 311709, ENTITLED "RIVER DRIVE WAREHOUSE IMPROVEMENTS"; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance No. 12128, as amended, the Annual Appropriation Ordinance, on September 25, 2001, establishing revenues and appropriations for the City of Miami, Florida, for Fiscal Year ending September 30, 2002; and WHEREAS, the City intends to use the City -owned warehouse located at 1100 Northwest South River Drive, Miami, Florida, as a leased property or as a facility to house certain operations; and WHEREAS, the warehouse is in need of improvements, including replacement or repair of the roof, overhead doors, bathrooms, windows and 40 Year Re -Certification; and WHEREAS, it is necessary to reprogram appropriations in the amount of $500,000, from Capital Improvement Project No. 311052, entitled "GSA Communications 800 MHZ Radio System", to Capital 1.2270 • Improvement Project No. X11709, entitled "River Drive Warehouse Improvements"; WHEREAS, the reprogrammed funds will be reimbursed to Project No. 311052 by a scheduled contribution of $1,000,000 from the Fire Assessment Fee in Fiscal Year 2002-2003; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 12128, as amended, adopted September 25, 2001, the Annual Appropriations Ordinance for Fiscal Year ending September 3,0, 2002, is further amended in the following particulars: l/ "Ordinance No. 12128 Section 7. Section 6 of Ordinance No. 11705, as amended, adopted September 28, 1998, Section 5 of Ordinance No. 11839, as amended, adopted September 28, 1999, and Section 7 of Ordinance No. 11970, as amended, adopted September 28, 2000, are further amended in the following particulars to revise previously approved Projects and establish new Projects to be initiated during Fiscal Year 2001-2002: The following appropriations in all Capital Improvement Projects are in the thousands of dollars. The FY 2002 Budget Allocation represents funding available from June 29, 2001 - Sept. 30, 2002. �i Words and/or figures stricken through shall be deleted. All ordinances or parts of ordinances, insofar as they are in conflict with provisions.of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and to 'generally carry on the functions and duties of municipal affairs. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Section 7. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
