HomeMy WebLinkAboutO-12268J-02-880 8/22/02 ORDINANCE NO. 12268 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12128, AS AMENDED, THE ANNUAL APPROPRIATIONS AND CAPITAL IMPROVEMENT PROJECT ORDINANCE TO REVISE CERTAIN OPERATIONAL AND BUDGETARY APPROPRIATIONS FOR FISCAL YEAR ENDING SEPTEMBER 30, 2002, AND TO INCREASE APPROPRIATIONS IN CAPITAL IMPROVEMENT PROJECT NO. 353019, "SOLID WASTE REMOVAL PILOT PROGRAM," IN THE AMOUNT OF $4,000,000; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Fiscal Year 2002 Budget includes an operating surplus reserve of $4,045,866 which is budgeted in Undesignated Reserves in Non -Departmental Accounts; and WHEREAS, an amount of $4,000,000 has been identified from these funds for Capital Improvement Project No. 353019, "Solid Waste Removal Pilot Program; and WHEREAS, the remaining amount of $1,500,000 will be appropriated in Fiscal Year 2003 from the Annual General Fund allocation for solid waste capital equipment replacement; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 12268 Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 12128, as amended, adopted September 25, 2001, the Annual Appropriations and Capital Improvement Project Ordinance for Fiscal Year ending September 30, 2002, is further amended in the following particulars:lf "Ordinance No. 12128 Section 1. The following appropriations are made for the municipal operations of the General Fund for Fiscal Year ending September 30, 2002: Reserves Based on Financial Integrity Principles: (Included in General Fund - NDA) Contingency Reserves $ 1,000,000 Designated Reserves 3,900,000 Undesignated Reserves $ 4,945,866 $ 45,866 Total Reserves fig -x,945,866 $ 4,945,866 Section 7. Section 6 of Ordinance No. 11705, as amended, adopted September 28, 1998, Section 5 of Ordinance No. 11839, as amended, adopted September 28, 1999, and Section 7 of Ordinance No. 11970, as amended, adopted September 28, 2000, are further amended in the following particulars to revise previously approved Projects and establish new Projects to be initiated during Fiscal Year 2001-2002: The following appropriations in all Capital Improvement Projects are in the thousands of dollars. The FY 2002 :1 words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. All ordinances or parts of ordinances, insofar as they are in conflict with provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and Page 3 of 4 12268 to generally carry on the functions and duties of municipal affairs . Section 6. The requirement of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Section 7. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
