THE ZONING ATLAS OF ORDINANCE NO. 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, ARTICLE 4, SECTION 401,
SCHEDULE OF DISTRICT REGULATIONS, BY
CHANGING THE ZONING CLASSIFICATION FROM SD -4
"WATERFRONT INDUSTRIAL" AND R-3 "MULTIFAMILY
MEDIUM -DENSITY RESIDENTIAL" TO R-3
"MULTIFAMILY MEDIUM -DENSITY RESIDENTIAL" FOR
THE PROPERTY LOCATED AT APPROXIMATELY 2415
NORTHWEST 16 STREET, MIAMI, FLORIDA, AS
LEGALLY DESCRIBED ON ATTACHED "EXHIBIT A";
CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Zoning Board, at its meeting of June 17,
2002, Item No. 1, following an advertised hearing, adopted
Resolution No. ZB 2002-0585, by a six to two (6 to 2) vote,
RECOMMENDING APPROV.AL for the requested change of zoning
classification, as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration
of this matter, deems it advisable and in the best interest of
the general welfare of the City of Miami and its inhabitants to

grant this change of zoning classification as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida,
Article 4, Section 401, Schedule of District Regulations, is
amended by changing the zoning classification from SD -4
WATERFRONT INDUSTRIAL AND R-3 MULTIFAMILY MEDIUM -DENSITY
RESIDENTIAL to R-3 MULTIFAMILY MEDIUM -DENSITY RESIDENTIAL for
the property located at approximately 2415 Northwest 16 Street,
Miami, Florida, as legally described on attached "Exhibit A."
Section 2. It is found that this zoning classification
change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) will not create an isolated district unrelated to
adjacent and nearby districts;
(d) is not out of scale with the needs of the neighborhood
or the City;

(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to adjacent
area;
(k) will not adversely affect property value in the
adjacent area;
(1) will not .be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will, not constitute a grant of special privilege to an
individual owner so as to compromise the protection of
the public welfare.
Section 3. Page No. 25 of the Zoning Atlas, made a part
of Ordinance No. 11000, as amended, the Zoning Ordinance of the
City of Miami, Florida, by reference and description in said

Ordinance, is amended to reflect the changes made necessary by
this Amendment.
Section 4. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be
affected.
Section 6. This Ordinance shall become effective
thirty-one (31) days after second reading and adoption thereof
pursuant and subject to §163. 3187 (3) (c) , Fla. Stat. (2000)
PASSED ON FIRST READING BY TITLE ONLY this 27th day of
June. , 2002.
1� This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon
the effective date stated herein, whichever is later.

Pursuant to Article 4, Section 401 and Article 22 of Ordinance 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, the subject proposal for an amendment
to the Zoning Atlas has been reviewed as follows:
The request is to change the Zoning designation from SD -4 "Waterfront Industrial
District' and R-3 "Multifamily Medium -Density" to R-3 "Multifamily Medium -
Density" as follows:
The subject property consist on one parcel fronting NW 16`h Street Road (Complete
legal description on file with Hearing Board Office).
The following findings have been made:
• It is found that the subject property is one plated parcel with two different Zoning use
designations: SD -4 "Waterfront Industrial District" at the north half and R-3
"Multifamily Medium Density" at the south half.
• It is found that the purpose of this application is in order to have only one designation
for the entire parcel.
• It is found that the parcel is adjacent to the Miami River and that this application is in
order to bring residential development to the Miami River.
• It is found that the requested change to R-3 "Multifamily Medium Density" will allow
greater flexibility in developing residential use for this portion of the river.,
Based on these findings, the Planning and Zoning Department is recommending
approval of the application as presented.

In response to you- March 29 and `lay 2 requests, the following is
the Miami River Commission's (MRC) official recommendation
regarding the property located on the river's loath shore, a, 2415 W,
16* Street Road. On May E, 2002, the MRC herrd a presentation from
the applicants regarding thei proposal to charm= tlx zoning from SD -4
Marine Industrial, to R-3 Residential and amending the Land use from
Industrial to Medium Density Multifamily Residentiai.
During t1m aforementioned May b MRC meeting, board member
Janet McAliley made a motion, seconded by Clev_ Janes, Jr., to reject
the applicant's plan as presented, as it does not comply with the
concepts being set forth under the Miami River Corridor Urban
Infill Pian, and the motion passed by a vote of 7-3. The Urban lnfill
Plan Ras created under a Joint Planning Agreement :fat iecludes the
City and County Planning Departments and the -IRC. The proposed
zoning and iand use amendments wculd not pm fide. any buffer zoce
between existing mmne indust-ial zoning to the east, and existing
residential to the west. Currently, residents in r:ediately adiacent to a
marine industrial business often complain_ abcut the incompatible land
uses immediately abutting each other. Therefore, one strong
recommendation of the Miarni River Corridor Infill Plan is to avoid
future conflicts by providing buffer zones between residential and
marine industrial zoning.

VACATION AND CLOSURE OF A PORTION OF SW 14TH STREET BETWEEN
SW 2ND AVENUE AND THE METRORAIL RIGHT-OF-WAY
Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department
has reviewed the proposed street vacation and closure to determine whether it is in the
public interest, or whether the general public would benefit from the vacation of the right-
of-way.
The following findings have been made:
• It is found that the general public currently utilizes SW 14th Street for convenient public
access to the adjacent commercial businesses and parking areas adjacent to Coral Way.
• It is found that the Solid Waste Department and emergency vehicles utilize this street
and that closing the street would limit emergency and public access to adjacent
properties.
• It is found that the vacation of the street could have unanticipated long term
consequences and could ultimately facilitate the development of a building that is
inconsistent with the height, bulk, scale and character of existing buildings south of SW
15th Road.
• It is found that the property owner has failed to demonstrate any public benefits that
would be provided as a result of the proposed street vacation.
Based on these findings, the Planning and Zoning Department recommends denial
of the request.

7. A sketch and legal description, with square footage for the proposed closure, will be
required by the Zoning Board. Provide a copy to the Public Works Department.
Sketch and legal description must be on 8 1/2" x 11" paper.

11. The Plat and Street Committee, in reviewing the request to close and vacate SW 14
Street between SW 2 Avenue and the Metrorail right-of-way, has considered the public
interest requirements found in Chapter 55 of the City Code. The Committee finds that
SW 14 Street provides convenient public access to the adjacent properties and parking
lots. The closure of this roadway and enlargement of the building site would allow
taller structures with increased square footage, thereby impacting the adjacent
residential neighborhood south of SW 15 Road. The general public currently utilizes
this road for convenient access to the commercial business and parking areas adjacent
to Coral Way. The Solid Waste Department and emergency vehicles utilize this
roadway and closing the road would limit public access to commercial properties.
Based on these findings, the Plat and Street Committee recommends denial of the
vacation and closure of SW 14 Street between SW 2 Avenue and the Metrorail right-of-
way.
12. SW 13 Street (Coral Way) is a State Road. A plat approval letter from the Florida
Department of Transportation is required.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the
public rights-of-way when property is platted. These subdivision improvements
include paving, drainage, landscaping, sidewalks, etc. In some cases this could
represent a substantial investment on your part.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers,
electric, telephone, water, etc. caused by this plat will be at the property owners
expense. Also, utility easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat
is recorded. Also, the Certificate of Occupancy for any building construction will be
issued only after all the required subdivision improvements have been completed.

The subject property consist.on one parcel fronting NW 16th Street Road (Complete

The following findings have been made:
• It is found that the subject property is one plated parcel with two different Zoning use
