CITY COMMISSION Passed First Reading on June 27, 2002. APPLICATION NUMBER 02-21 Item # 1 CITY OF MIAMI -; PLANNING AND ZONING DEPARTMENT 444 SW 2ND AVENUE, 3RD FLOOR • MIAMI, FLORIDA, 33130 PHONE (305) 416-1400 .................................. ................................................. :.............................................. :................................................................................................................... _....... € 7/17/2002 - Page 1 6O ANALYSIS FOR LAND USE CHANGE REQUEST Approximately 2415 NW 16th Street Road. Application No. LU- 2002-007 DISCUSSION The proposal has been reviewed for a change to the Future Land Use Map of the Miami Comprehensive Neighborhood Plan 1989-2000 from "Industrial" to "Restricted Commercial". The subject property consists of a parcel of land between NW 16th Street Road and the Miami River. (Complete legal description on file at the Hearing Boards Office). Miami Comprehensive Neighborhood Plan (MCNP) Land Use Policy 1.6.1., established future land use categories according to the Future Land Use Plan Map and the "Interpretation of the Future Land Use Plan Map". The subject property is currently designated "Industrial" and the same designation is to the east; to the south and west, the area is designated "Medium Density • Multifamily Residential" and, to the north is the Miami River. The "Industrial" land use category allow manufacturing, assembly and storage activities . and generally includes activities that would otherwise generate excessive amounts of noise, smoke, fumes, illumination, traffic, hazardous wastes, or negative visual impact unless properly controlled. Stockyards, rendering works, smelting and refining plants and similar, activities are excluded. Residential uses are not permitted Except for rescue missions and live-aboards.in commercial marinas. The "Medium Density Multifamily Residential" category allow residential structures to a maximum density of 65 dwelling units per acre, subject to the detailed provisions of the applicable land development regulations and the maintenance of the required levels of service for facilities. and services included in the City's adopted concurrency management requirements: Supporting services such as community-based residential facilities (14 clients or less, not including drug, alcohol or correctional rehabilitation facilities) will be allowed pursuant to applicable state law; community-based residential facilities (15-50 clients) and day care centers for children and adults may be permissible in suitable locations. Permissible uses within this land use also include commercial activities that are intended to serve the retailing and personal services needs of the building or building complex, places or worship, primary and secondary schools, and accessory post- secondary educational facilities. 12260 The Planning and Zoning Department is recommending APPROVAL of the application as presented based on the following findings: - • It is found that the subject property is one parcel legally plated with two different land use designations: "Industrial" at the north half and "Medium Density Multifamily Residential" at the south half. • It is found that the purpose of this application is in order to have only one designation for the entire parcel. • It is found that the parcel is adjacent to the Miami River and that this application is in order to bring residential development to the Miami River. • It is found that the requested change to "Medium Density Multifamily Residential" will allow greater flexibility in developing residential use for this portion of the river. • It is found that Goal LU -1. the City's promotes the efficient use of land and minimizes land use conflicts These findings support the position that the existing land use pattern in this neighborhood should be changed. It also should be stated, that whereas MCNP Land Use Policy 1.1.1. requires development or redevelopment, that results in an increase in density or intensity of .land use, to be contingent upon availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) (CIE Policy 1.2.3.). It is found that the attached Concurrency Management Analysis pertaining to concurrency demonstrates that no levels of service would be reduced below minimum levels. On Nlay 6, 2002, ,Lue NIRC h"..xd a presentation from the applicants regarding their proposal to change ti:c zoning from SD -4 Marine Industrial, to R-3 Residential and amending the Land use horn Industrial to IvlediLm Density Multifamily Residential. Daring the aforemenboned Mzy 6 MRC meeting, board member Janet McAliley made a motion, seconded by Cleve Jones, Jr., to reject the applicant's plan as presented, as it does not comply with the concepts being set forth under the Miami River Corridor Urban Infill Plan, and the motion passed by a vote of 7-3. The Urban Infill Plan was created ender z Joint Planr ins Agreement that includes the City and. County Planning Departments and the MRC. The propos zoning and iand use amendments wculd not pro--ide. any buffer zone between existing marine industrial zoning to the east, and existing residential to the west. Cu_--rently, residents immediately adiacent to a marine industrial business often complaLn about the incompatible land uses immediately abutting mch other. Therefore, one strong recommendation of the Miami River Corridor Infill Plan is to avoid future conflicts by providing buffer zoics between residential and marine industrial zoning. And it's not just the planned Marlins ballpark and exciting prospects for downtown's river area. Most of Florida's maritime trade with 29 nations and territories in the Caribbean Basin goes through the Miami River. With an estimated $4 billion in cargo — more than double 1991 levels — the Miami River vies with the Port of Tampa as the equivalent of Florida's fourth largest port in dollar volume. It is truly our "neighborhood port." Nearly 20 percent of the nation's $22.1 billion in trade with the Caribbean Basin passes through the Miami River. And, as civic leaders close ranks and focus on the river, the 5.5 -mile corridor is poised for a new boom from its vibrant downtown on Biscayne Bay to MIAMI RIVER: the busy trade hub near Miami Internationalr Airport. Here are some highlights of the Miami Florida"s Fourth ' Over Commission's 2001 Economic Impact Largest Port* dy, prepared with the Beacon Council, the Miami City of Miami, and Florida International River University economist Dr. Kenneth Lipner, Ph.D.: Sa ■ The Miami River's properties are assessed at $1.3 billion, paying nearly $20 million in taxes a year for city and county services ■ Marine -related river businesses responding tc the survey reported $216 million in revenues. ■ The Miami River serves nearly 100 ports of call in the region, up from 62 in 1991. ■ Jobs have tripled in the last 10 years among reporting marine -related industries — from 400 to 1,200. That's a $35 million payroll with almost $30,000 per job. ■ These stable, mostly home-grown businesses are in Miami for the long haul. Some have been in the community 80 years. They want to stay and grow. ■ The Miami River's role in the region is about to become even more important. The Caribbean Basin Trade Initiative passed in 1999 is expected to increase trade dramatically with this diverse region as it takes effect. Please turn to back page. PARKS, Chairperson, Member at Iarge, appointed by the Governor Miami River Commission Staff: DAVID MILLER, Managing Director, MRC BRETT BIBEAU, Assistant Managing Director ABOUT THIS REPORT This report is based on the Miami River Economic Study 2000, prepared by J. Kenneth Lipner, Ph.D., on behalf of the Miami River Commission. It resulted from surveys of businesses along the river conducted in cooperation with the Beacon Council and City of Miami, with a response rate of about 50 percent. The Commission thanks Miami River Marine Group Executive Director Dr. Frances Bohnsack for her invaluable role in the study's success. This report was prepared by Mark Sell Communications, Inc., and designed by Toni Kirkland. ■ The Miami River stands to gain because it is the only nearby American shallow - draft port that can serve these smaller nations as free markets develop. ■ The new $70 million river dredging project — the river's first in 70 years — will restore the channel to its allotted depth, reduce pollutants, and prepare the Miami River corridor for growing trade demand. ■ For the first time, local governments are working together to bring the river to its full potential for the shipping industry, boaters, visitors, and residents. A system of riverwalks and greenways trails will link downtown with parks, businesses, and residential neighborhoods in the east and central sections. ■ New riverfront downtown revitalization efforts will make downtown more vibrant and offer huge potential for tourism and Miami's hospitality industry. More than $400 million in riverfront projects have been approved, with more on the way. ■ Hotels on the Miami River served more than 496,000 overnight visitors last year. • With a three-day average stay, those stays generate $100 million a year. C 12260 ® Fact Sheet: Reasons to Deny Zoning Change Request to allow Affordable Housing at 2415 NW 16th Street Road Submitted by: Fran Bohnsack, Miami River Marine Group Submitted Into the public Port of Miami River record in connection Vi! h item Z -5 ®n , S rescl a A. Thompson Zoning Change Proposed by: River Run South Residential Development City Clerk Representing Attorney: Vicky Garcia -Toledo Developer/Applicant: Muniz Development Inc. on behalf of Jilla Holding Inc. Proposed Change at waterfront from SD -4 Waterfront Industrial to R-3 Multifamily Medium Density Residential City of Miami District Commissioner: Angel Gonzalez Description of problem: The developer proposes 3 medium density residential buildings of affordable housing (low income, 174 units) to be placed on the south side of the river immediately west of the (former) Florida Yacht Basin, now known as Bernuth Chartering.. In order to do so, the developer needs a change of land use in the Comprehensive Plan and a zoning change. The Miami River Marine Group is opposed to the land use and zoning change because experience has shown that placing residents next to marine industrial facilities creates conflicts of INCOMPATIBILITY. Immediate proximity of residents to industrial businesses inevitably leads to complaints from neighbors, which tend to restrict the river's marine industry operations. Restrictions in operations lead to a loss of jobs in the river's marine industry. Further, we believe that the Planning Advisory Board made their recommendation for a change in land use based upon incorrect and misleading information. The proposed low income housing development on the river's edge within the marine industrial section is INCOMPATIBLE with the City's Neighborhood Comprehensive Plan approved by the state. Reference the Port of Miami River (under Ports, Aviation and Related Facilities), Objective PA -3.1: " The City of Miami through its Land development regulations, shall help protect the Port of Miami River from encroachment by non -water dependent or water related land uses, and shall regulate its expansion and redevelopment in coordination with the City's applicable coastal management and conservation plans and policies." Policy PA -3.1.1: The City shall use its land development regulations to encourage the establishment and maintenance of water -dependent and water -related uses along the banks of the Miami River, and to discourage encroachment by incompatible • uses. And 12260 ; Submitted Into the public Srecord in connection `kf,gh item P2-5 on Priscilla A. Thompson Policy PA -3.1.3: The City shall, through its land development regulations,--` - - . City Clerk encourage development of compatible land uses in the vicinity of the Port of Miami River so as to mitigate potential adverse impacts arising from the Port of Miami River upon adjacent natural resources and land uses. The proposed residential development encroaches on the working river by eliminating an important piece of the working waterfront whose history has been to support marine operations; it thus fails to protect the Port of Miami River. Residential zoning is also incompatible with current activities on the waterfront in this area. The land use/zoning change conflicts with the Comprehensive Plan (Policy PA33.1.3) which requires that land uses "in the vicinity of the Port of Miami River" be compatible "so as to mitigate potential adverse impacts arising from the Port of Miami River ...upon adjacent ... land uses" – a fact which was not even considered in the Planning Advisory Board's recommendation. The land use and zoning change proposal creates adverse impacts upon the Port by placing residential facilities too close to port operation facilities. Contrary to suggestions that the proposed development site is surrounded by residences on three sides, the boundaries that separate residential from marine industrial are SW 16 Street itself and the Miami Canal. A City of Miami Zoning map (attached) shows that the contiguous waterfront on the south side of the river between 22"d and 27'h Avenues is entirely active marine industrial with the exception of one property (immediately to the west of the development site), which is undergoing rehabilitation for residential use. All other residential properties are located on the other side of SW 161h Street which is the logical boundary separating marine industry from residential uses; or, they are located on the other side of the river near a large City park. The adjacent waterfront property to the east, the former Florida Yacht Basin (now known as Bemuth Chartering), is not an abandoned property as has been represented, but an actively working site for yacht and ship service (photos attached). The other waterfront properties within this block are all marine industrial, including Florida Detroit Diesel Allison (a marine engines business); an active shipyard owned by Coastal Tug & Barge; a terminal run by Antillean Marine; a boat building business called Jaws; and a marina with an active haul out slip. The final property on the block, which faces 27th Avenue, is zoned commercial. The island in the center of the channel that appears to be residential (Martin's Point) is actually zoned SD -4 and houses Best Yacht Repair, a marine welding business called Tradewinds, and 4 additional lots with houses licensed for marine storage (exhibit ). Additionally, the proposed land use/zoning change would allow a residential project to take limited waterfront property in a working area of marine industrial use for a non -water dependent or water related use; this is incompatible with the public's expressed desire for the waterfront in this area. Since.October of 2001, over nine public hearings have been held about the river, involving all the river's neighborhoods, the marine industry, and development interests. Both the City and the County participated with the Miami River Commission in these public hearings which, at their conclusion, endorsed marine industrial 12260 use for the waterfront in this area. As a consequence of this process and after a complete review of the proposed River Run South project by the Miami River Commission, a recommendation for denial of the proposed land use/zoning change was forwarded to this board. Waterfront residential zoning in an area dominated by marine industrial waterfront is incompatible and damaging to the marine industry. The potential loss of jobs from curtailing marine industrial activities due to the proximity of medium density housing is of far greater adverse economic impact to the city than the potential good to be derived from the project. The waterfront is zoned marine industrial for very good reason: marine industry is defined by water; it cannot function anywhere else. The same cannot be said of affordable housing. I was engaged by the ci*ner, Sally Bendahan, in December, 1993 to market the site for sale. She was part of an investment group which purchased the site in 1981. The site has been actively on the market since that time, approximately 9 years, and the owner has seen many expressions of interest in the site. While there was interest in the site for marine use in the early 1990's, recent activity has been virtually all residentially oriented with several offers to purchase the property for the development of residential projects, including the current contract with Muniz Development. At present, i average approximately 2-3 calls per week regarding the property from parties interested in residential development. During my lengthy involvement with the property, I have spoken to many of the neighbors in the area, all of whom expressed a preference for residential development as opposed to marine use for the site. Moreover, due to the lack of river depth at the site, the imminent and lengthy dredging project, conflicts with Manatees, and the lack of demand for marine use, it is clear that residential use is a higher and better use of the property for the foreseeable future. Barreiro Miami -Dade County Commissioner May 14, 2002 Mr. Jorge Muniz President River Run South Condominium 1473 Coral Way Miami, FL 33145 Dear Mr. Muniz: After reviewing the proposal for the development of River Run South Condominium by the staff of the Miami Dade Housing Agency, the Board of County Commissioners approved the project and allocated the requested funding of one million dollars. This development represents homeownership opportunities for 174 residents of Miami - Dade within the city of Miami. As the County Commissioner for this district, I encourage homeownership developments, which will contribute to the pride of the neighborhood and help uplift the quality of life of our citizens. Furthermore, I strongly believe in the great potential of the Miami River as a prime residential and commercial area, and River Run South is a pioneer in the redevelopment of the south bank of the river between 22nd and 27`h Avenues. I look forward to the success of this project in providing affordable homeownership, much needed in both the County and the City of Miami. S Bruno A. Th mpson City Clerk RE: Recommended denial of July 25 City Commission agenda items PZ 5 & PZ 6 Dear Clerk Thompson: This letter serves as the Miami River Commission's (MRC) "official statement" to the City Commission, requested in City Resolution 00- 320, regarding July 25, 2002 City Commission agenda items PZ 5 - PZ 6, which directly impact the Miami River. Recommended denial of PZ 5 - PZ 6: The Miami River Commission recommends denial of the applicant's application to change the zoning on this riverfront property from Marine Industrial to Multifamily residential, as the presented plan does not comply with the concepts being set forth under the Miami River Corridor Urban Infill Plan, nor does it comply with the goals and policies set forth in the City of Miami Comprehensive Plan and Zoning Code. The City of Miami Zoning Code Section 604, SD -4 Waterfront Industrial District states, "Intent: This district designation is intended for application in areas appropriately located for marine activities, including industrial operations and major movements of passengers and commodities. In view of the importance of such activities to local economy and the limited area suitable and available for such activities, it is intended to limit principal and accessory uses to those reasonably requiring location within such districts, and not to permit residential, general commercial, service, office or manufacturing uses not primarily related to waterfront activities except for office uses in existing office structures" Denial of the application in question to change the existing waterfront industrial district zoning to Residential would abide and enforce the City of Miami Zoning Code 604. 1, Intent of SD -4 Zoning. 12260 MianifRiver Commtsion Submittnd info the public record ica .;bio # City Commission agenda items PZ 14 - PZ 15 item { a -, i wi 7 W1 7/25/02 a Page 2 Priscilla A- 'ilh=pson The City of Miami Comprehensive Plan states, "The Port Of Miami River: Goal PA -3 The Port of Miami River, a group of privately owned and operated commercial shipping companies located at specific sites along the Miami River, shall be encouraged to continue operation as a valued and economically viable component of the city's maritime industrial base." Policy PA -3.1.1: "The City shall use its land development regulations to encourage the establishment and maintenance of water -dependent and water -related uses along the banks of the Miami River, and to discourage encroachment by incompatible uses." Coastal Management objective 3.1 states: "Allow no net loss of acreage devoted to water dependent uses in the coastal area of the City of Miami". Denial of the application in question would allow no net loss of acreage devoted to water dependent uses and comply with the provisions of the City's Comprehensive Plan. The Miami River Commission respectfully disagrees with the City of Miami Planning Department's, "Analysis for Land Use Change Request" which states, "It is found that Goal LU -1. the City's promotes the efficient use of land and minimizes land use conflicts." In actuality, changing the zoning to Multi -Family Residential would cause a major land use conflict with the adjacent Marine Industrial Zoning and an inefficient use of waterfront property. The $72 million Miami River dredging project will commence before the end of this year. The dredging will result in significantly improving the natural environment, and make marine industrial businesses more efficient and viable than ever. The Marine Industrial SD -4 zoning in the Industrial Upper section of the Miami River should not be rezoned for residential, especially with the dredging project commencing in the near future. The proposed residential development of this Riverfront property includes a 37 slip marina. The Dade County Manatee Protection Plan classifies the Miami River as an, "Essential Manatee Habitat". Therefore this residential development would only be permitted 1 power boat slip per 100 linear riverfront feet, for a grand total of only 6 power boat slips. The Manatee Protection Plan does not restrict large cargo vessels on the River, because they present less danger to the Manatee than recreational powerboats. It is clear that the preservation of the existing Marine Industrial zoning would protect and maximize the water dependent use of this riverfront site and provide significant opportunities for marine industrial jobs. 12260 Mianikiver CommCsion City Commission agenda items PZ 14 - PZ 15 7/25/02 Page 3 The Miami River Commission urges you to protect the existing Marine Industrial zoning at this waterfront site, as required by the City of Miami's Comprehensive Plan and Zoning Code, by denying the zoning change application before you.
